COMMENCEMENT – The meeting began with the singing of “O Canada”. 2. MINUTES – On motion by Councillor J. Gazzola, the minutes of the regular meeting held April 24, 2017 and special meetings held April 24 and May 1, 2017, as mailed to the Mayor and Councillors, were accepted. 3. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - NIL 4. COMMUNICATIONS REFERRED TO FILE – a. Flag Request under Policy I-442: Toastmasters International – District 86 Spring Conference – April 28-30, 2017 KW Association for Community Living – Life Awareness – May 1-8, 2017 th Kitchener Soccer Club – 50 Anniversary – May 1-8, 2017 5. PRESENTATIONS – My Ideal City On behalf of Council, Mayor B. Vrbanovic presented Certificates of Achievement to the 2017 My Ideal City debate participants: Claire Gosnell; Clara Beamish; Mikaela Milenkovic; Jayden Randall-Eddy; Isaiah Salanic; Alice Carter; Skylar Vinski; Naomi Cubilla; Milkesa Qasim; James Mason; Mohamed Eldoma; Eben Konkle; and, Evaneline Branje. 5.a. Mayor’s City Builder Award Mayor B. Vrbanovic presented the Mayor’s City Builder Award to Theron Kramer who has demonstrated a commitment to making the City and community a better place now and in the future. He indicated Mr. Kramer has had a long career working with community groups and previously served as chair of Compass Kitchener. Ms. Joy Kramer and Ms. Melanie Kramer were in attendance to accept the award on behalf of Mr. Kramer. 5.b. Presentation to Edwin Outwater Mayor B. Vrbanovic presented Mr. Edwin Outwater with an award acknowledging his 10-year contribution as Music Director with the Kitchener-Waterloo Symphony. The meeting then recessed at 7:31 p.m. and reconvened at 7:33 p.m., chaired by Mayor B. Vrbanovic with all members present. COUNCIL MINUTES MAY 15, 2017 -82 - CITY OF KITCHENER 5.d. URISA-OC BeSpatial 2017 Conference Awards Mayor B. Vrbanovic and Mr. D. Murray, Director, Technology Innovation & Services, recognized David van Riel, GIS Technologist, for receiving a Silver Award, GIS Category for Asset Management, Risk Analysis Project; and, Hanna Sjostrom, GIS Technician, for receiving the People’s Choice Application Award, MApps Gallery, Citizen Science Poster at the recent Urban and Regional Information Systems Association (URISA-OC) BeSpatial 2017 Conference. 5.c. Sustainable Waterloo Region Awards Mayor B. Vrbanovic acknowledged the receipt of two awards recently won by the City of Kitchener from Sustainable Waterloo Region. On behalf of Council, he congratulated staff for winning the 2016 Sustainability Promoter of the Year Award; and, the Travelwise for Leadership and Innovation Award. Service Recognition – Jeff Willmer Mayor B. Vrbanovic presented Mr. J. Willmer, Chief Administrator, with an award acknowledging 26 years of municipal service with the City of Kitchener. Acknowledgement – Colin Goodeve Mayor B. Vrbanovic acknowledged Mr. C. Goodeve, Deputy Clerk, congratulating him on 13 years of municipal service with the City of Kitchener and wished him well in his new role as Deputy Clerk for the Region of York. 6. DELEGATIONS – 6.a. Bike Lanes – David Bergey Drive Mr. M. El-Sharnouby addressed Council in opposition to the recommendation to install bicycle lanes and prohibit parking on both sides of David Bergey Drive, listed as Clause 10 of the Community and Infrastructure Services Committee report. He noted he is speaking on behalf the residents of 20 David Bergey Drive and 177 David Bergey Drive who are in opposition to the removal of on-street parking. After his review of the City’s Traffic Calming Policy, his opinion is that City staff has not followed the approved policy in making a recommendation for the installation of cycling lanes and to prohibit on-street parking. He stated the Policy also requires 50% of the residents residing on the street to be in favour of the traffic calming measures for the proposed measures to be implemented and, in this case, indicated approximately 60% of the residents are in opposition to the prohibition of on-street parking. Mr. El-Sharnouby reviewed the revised staff report, which states at peak times there is an average of 7 cars parked on the street. He circulated photos commenting during peak hours there are regularly in excess of 10 cars parked on the street. He further advised the Laurentian Wetlands is a destination attraction where people park for several hours on David Bergey Drive, adding to the congestion with other on-street parking. Mr. El-Sharnouby stated the installation of cycling facilities and the removal of on-street parking would not improve the street’s traffic speeds. He suggested speed cushions as a possible alternative to traffic calming on David Bergey Drive rather than cycling facilities. In response to questions, Mr. El-Sharnouby advised he is not in opposition to the installation of cycling facilities if there was a way to maintain on-street parking as well. He further advised if on- street parking was prohibited on David Bergey Drive, the closest on-street parking option available would be in excess of 300m away from 20 David Bergey Drive. Mr. J. Lopes addressed Council also in opposition to the recommendation to install bicycle lanes and prohibit parking on both sides of David Bergey Drive. He indicated David Bergey Drive is a high- density area with minimal availability for overflow parking. He expressed concerns with traffic speeds on the street, noting speeds have been identified in excess of 80/kmh. He indicated the loss of on- street parking may add to the concerns related to traffic. In response to questions, Mr. K. Carmichael, Interim Director, Transportation Services, advised the process for installation of cycling facilities differs from the Traffic Calming Policy as the Cycling Master Plan is already approved. He indicated when facilities are being proposed, staff would notify the residents regarding the implementation but would not actively seek feedback. He further advised COUNCIL MINUTES MAY 15, 2017 -83 - CITY OF KITCHENER when streets have been identified for a traffic calming review it is always the preferred option to install the cycling facilities in advance of the review as cycling lanes often change the traffic conditions. He noted if cycling infrastructure was installed following the review, it may adversely impact the traffic calming measures that were implemented. He further advised if the processes were reversed and the traffic calming review was completed first, it may compromise staff’s ability to install the cycling infrastructure after the completion of the review. Questions were raised regarding the financial implications of installing a parking bay on David Bergey Drive. Mr. Carmichael advised staff have confirmed with the Engineering Division an approximate cost of $30,000. He indicated there would be additional costs for maintenance and snow removal, also noting there is no funding available for the installation of a parking bay. A motion was brought forward by Councillor B. Ioannidis, seconded by Councillor S. Marsh, to approve Clause 10 of the Community and Infrastructure Services Committee report. An amendment was brought forward by Councillor K. Galloway-Sealock, seconded by Councillor P. Singh, to include an additional clause for the installation of a parking bay to accommodate 7 to 10 parking spaces in close proximity of 20 David Bergey Drive, to be funded one-third each through the Cycling, Traffic Calming and Parks budgets. Questions were raised regarding other possible funding sources for the parking bay. In response, Mr. D. Chapman, Deputy CAO, Finance and Corporate Services, advised another possible funding source could be Capital Contingency. He noted there is $180,000 allocated annually to this fund and although staff would not recommend funding larger projects through the Capital Contingency, the amount is modest and it may be appropriate. The meeting then recessed at 8:44 p.m. and reconvened at 8:50 p.m., chaired by Mayor B. Vrbanovic with all members present. A motion was brought forward by Councillor K. Galloway-Sealock, seconded by Councillor S. Davey, to defer this matter pending completion of the Region of Waterloo’s Ottawa Street South Reconstruction project scheduled for 2018/2019, which includes the installation of cycling lanes that may connect to those proposed for David Bergey Drive. In response to questions, Mr. C. Goodeve, Manager Council and Committee Services / Deputy Clerk, advised the deferral motion would take precedence over the motion to amend and would not be out of order. Moved by Councillor K. Galloway-Sealock Seconded by Councillor S. Davey “That consideration of Clause 10 of the Community and Infrastructure Services Committee report be deferred pending completion of the Region of Waterloo’s Ottawa Street South Reconstruction project scheduled for 2018/2019, which includes the installation of bicycle facilities that may connect to the ones proposed for David Bergey Drive.” Carried Unanimously, on recorded vote. Zone Change Application ZC16/013/M/CL (10 Manitou Drive, 655 Fairway Road South, and 569- 579 Fairway Road South Mr. Oz Kemal, MHBC Planning, agent on behalf of the applicant, attended in support of the subject application and the staff recommendation, listed as Clause 2 of the Planning and Strategic Initiatives Committee report. COUNCIL MINUTES MAY 15, 2017 -84 - CITY OF KITCHENER 6.b. Tenders Ms. M. Palmer, Director of Supply Services, was in attendance to answer questions arising from the tender(s) listed on the Committee of the Whole agenda of this date. Mayor B. Vrbanovic advised there was a late-starter item for the Committee of the Whole, noting Council received Finance and Corporate Services Department report FCS-17-097, regarding Tender T17-072 - Duke & Ontario Parking Garage Repairs. Moved by Councillor B. Ioannidis Seconded by Councillor D. Schnider “That Expression of Interest E17-046 Consultant Services – Doon Pioneer Park Community Centre (DPPCC) Alterations and Expansion, be awarded to The Ventin Group Ltd. In response to questions, Mr. M. May, Deputy CAO, Community Services Department, agreed to follow up on promoting green building, including solar panels and geothermal technology. COUNCIL MINUTES MAY 15, 2017 -86 - CITY OF KITCHENER 11. BY-LAWS (FIRST READING) – Council agreed to the request of Mr. C. Goodeve, Deputy City Clerk, to add an additional by-law for three readings this date related to Zone Change Application ZC16/013/M/CL (10 Manitou Drive, 655 Fairway Road South and 569-579 Fairway Road South), listed as Clause 2 of the Planning and Strategic Initiatives Committee report. Moved by Councillor P. Singh Seconded by Councillor S. Davey “That leave be given the Mover and Seconder to introduce the following by-laws, namely: a. Being a by-law to amend Chapter 110 of the City of Kitchener Municipal Code with respect to Appointment of Staff. b. To further amend By-law No. 2008-117, being a by-law to authorize certain on-street and off-street parking of vehicles for use by persons with a disability, and the issuing of permits in respect thereof. d. On motion, the meeting adjourned at 9:31 p.m, MAYOR CF COUNCIL MINUTES MAY 15, 2017 _88- CITY OF KITCHENER REPORTS ADOPTED BY COUNCIL COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE — 1. That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Reid's Heritage Construction (RHC) at 286 Kingswood Drive, on June 21, 2017 and on August 9, 2017, between the hours of 6:00 a.m. and 12:00 a.m., as outlined in Community Services Department report CSD -17-038. 2. That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Pat Lackenbauer for an outdoor street party at 124 Ottawa Street South between the hours of 12:00 p.m. and 11:00 p.m. on July 29, 2017, as outlined in Community Services Department report CSD -17-039. 3. That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Community Support Connections for Tacofest at 10 King Street West, THEMUSEUM, to be held on June 16, 2017 between the hours of 6:00 p.m. and 10:30 p.m., as outlined in Community Services Department report CSD -17-041. 5. That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Sai Bhakti Dham for an outdoor event at 1250 Strasburg Road between the hours of 9:00 a.m. and 7:00 p.m. to be held on July 8, 2017, as outlined in Community Services Department report CSD -17-042. 6. That the Region of Waterloo and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work during the Fischer Hallman Road Surface Asphalt works, in the City of Kitchener. The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. for one week in May or July 2017, as outlined in Infrastructure Services Department report INS -17-034. 7. That the Uniform Traffic Bylaw be amended to prohibit stopping from 8:00 a.m. to 9:30 a.m. and, 2:30 p.m. to 4:00 p.m., Monday to Friday, between September 1 and June 30, on the north (even -numbered) side of Bridlewreath Street from Activa Avenue to Bridlewreath Court, as outlined in Infrastructure Services Department report INS -17-031. 8. That stopping be prohibited from 8:00 a.m. to 9:30 a.m. and, 2:30 p.m. to 4:00 p.m., Monday to Friday, September 1 to June 30, on the south/west (odd -numbered) side of Chapel Hill Drive between Caryndale Drive and Evenstone Avenue, as outlined in Infrastructure Services Department report INS -17-032; and, That a speed limit of 40km/h be implemented on Chapel Hill Drive along the frontage of Carmel New Church School between Caryndale Drive and Evenstone Avenue; and further, That the Uniform Traffic Bylaw be amended accordingly. 9. That the Kitchener Fire Department Master Plan (KFDMP) attached as Appendix A to Community Services Department report CSD -17-017, be approved as the guiding document for the Kitchener Fire Department; and that staff be directed to refer implementation of the strategic and operational actions to the departmental business planning process as applicable. 10. That consideration of the following motion be deferred pending completion of the Region of Waterloo's Ottawa Street South Reconstruction project scheduled for 2018/2019, which includes the installation of bicycle facilities that may connect to the ones proposed for David Bergey Drive: COUNCIL MINUTES MAY 15, 2017 _89- CITY OF KITCHENER REPORTS ADOPTED BY COUNCIL COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE — (CONT'D) 10. (Cont'd) "That on -street bicycle lanes be installed on both sides of David Bergey Drive from Ottawa Street to Activa Avenue, as outlined in Infrastructure Services report INS -17- 033; and, That on -street parking be prohibited on both sides of David Bergey Drive between Ottawa Street South and Activa Avenue; and further, That the Uniform Traffic Bylaw be amended accordingly." That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Holy Trinity Serbian Orthodox Church at 700 Fischer Hallman Road, for two (2) festivals to be held on May 28, 2017 and, July 29 and July 30, 2017, between the hours of 11:00 a.m. and 11:00 p.m., as outlined in Community Services Department report CSD -17-037. 12. That the Ministry of Transportation and its contractor(s) be exempt from the provisions of Chapter 450 (Noise) of the City of Kitchener Municipal Code Article 6 Construction Work during the Highway 8 resurfacing from approximately 100 metres north of the Franklin Street underpass, southeasterly to 100 metres north of the Grand River Bridge. The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00 a.m. from mid-July until completion in November 2017, as outlined in Infrastructure Services Department report INS - 17 -035. 13. That intersection narrowings be installed on Doon South Drive at Windrush Trail and Forest Edge Trail, as outlined in Infrastructure Services Department report INS -17-029; and, That three (3) speed cushions be installed along Doon South Drive between Doon Mills Drive and Robert Ferrie Drive; and, That a pedestrian refuge island be installed on Doon South Drive approximately 60 metres west of Woodsmere Drive at the trail crossing; and, That intersection improvements be made at Doon South Drive and Doon Village Road to provide safer pedestrian road crossings; and, That parking be prohibited at any time in the immediate area of the speed cushions; and, That parking be prohibited at any time in the immediate area of the pedestrian refuge island; and further, That the Uniform Traffic By -Law be amended accordingly. 14. That a new Council Policy regarding Development Charges Payment Milestone for Affordable Rental Housing effective July 1, 2017, attached to Community Services Department report CSD -17-034 as Appendix A, as amended, be approved; and, That a new Council Policy regarding Development Application Fees and Building Permit Fees for Affordable Rental Housing effective July 1, 2017, attached to Report CSD -17-034 as Appendix B, be approved, and that a budget of $30,000 annually for a period of five years be referred to the 2018 budget process; and, That staff update internal processes and procedures in order to implement new Council Policies regarding affordable rental housing by July 1, 2017; and further, COUNCIL MINUTES MAY 15, 2017 -90 - CITY OF KITCHENER REPORTS ADOPTED BY COUNCIL COMMUNITY AND INFRASTRUCTURE SERVICES COMMITTEE – (CONT’D) 14. (Cont’d) That the City of Kitchener encourage the Region of Waterloo to investigate development incentives for affordable housing and should the Region initiate a related Community Improvement Plan (CIP) for their jurisdiction, City of Kitchener staff are authorized to proceed with any formal CIP public process (if required at the local level) in order to partner on a joint initiative. FINANCE AND CORPORATE SERVICES COMMITTEE – 1. That the revised Council Policy GOV-COR-217 (Accessibility Policy), as attached to Community Services Department report CSD-17-019, be approved. 2.
