Bunn, Committee Administrator Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor J. Gazzola to discuss Item 7, and Councillor Y. Fernandes to discuss Item 6 listed on the Agenda as Consent items, which were voted on and Carried. 1. CSD-17-052 - NOISE EXEMPTION - BINGEMANS OKTOBERFEST - 425 BINGEMANS CENTRE DRIVE - OCTOBER 6 TO 14, 2017 The Committee considered Community Services Department report CSD-17-052, dated May 17, 2017 recommending approval of a noise exemption for Bingemans Oktoberfest at 425 Bingemans Centre Drive, between October 6 and October 14, 2017. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Bingemans for their Oktoberfest event being held at 425 Bingemans Centre Drive, between October 6 and October 14, 2017, as outlined in the letter provided by Mark Bingeman, dated May 10, 2017, and attached to Community Services Department report CSD-17-052 2. CSD-17-057 - NOISE EXEMPTION - CONCORDIA CLUB CANADIAN STUDENT LEADERSHIP CONFERENCE - 429 OTTAWA STREET SOUTH - SEPTEMBER 27, 2017 The Committee considered Community Services Department report CSD-17-057, dated May 17, 2017 recommending approval of a noise exemption for the Concordia Club Canadian Student Leadership Conference at 429 Ottawa Street South being held on September 27, 2017. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Concordia Club for the Canadian Student Leadership Conference being held at 429 Ottawa Street South, on Wednesday September 27, 2017, as outlined in the letter provided by Ruth Rajna, dated May 16, 2017, and attached to Community Services Department report CSD-17-057 3. CSD-17-059 - STREET RENAMING - RIVER VALLEY TRAIL TO HOLLYBROOK TRAIL The Committee considered Community Services Department report CSD-17-059, dated May 15, 2017 regarding the preparation of a draft by-law and reference plan (if required) to rename the street shown as River Valley Trail to Hollybrook Trail. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES JUNE 12, 2017 - 36 - CITY OF KITCHENER 3. CSD-17-059 - STREET RENAMING - RIVER VALLEY TRAIL TO HOLLYBROOK TRAIL On motion by Councillor Y. Fernandes - it was resolved: That staff proceed with the preparation of a draft by-law and reference plan (if required) to rename in itlocated between Forest Creek Drive and Pondcliffe Drive outlined in Community Services Department report CSD-17-059 4. INS-17-044 - LEVEL 2 PEDESTRIAN CROSSOVER (PXO) IMPLEMENTATION - JUBILEE DRIVE & 2018 PRIORITIZATION DEVELOPMENT The Committee considered Infrastructure Services Department report INS-17-044, dated May 23, 2017 recommending approval of the implementation of a Level 2 Pedestrian Crossover (PXO) on Jubilee Drive and 2018 Prioritization Development. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to implement a Level 2 Pedestrian Crossover (PXO) on Jubilee Drive approximately 180 metres west of David Street, as outlined in Infrastructure Services Department report INS-17-044 5. INS-17-045 - U-TURN PROHIBITIONS - KATHERINE CRESCENT & DUNBAR ROAD The Committee considered Infrastructure Services Department report INS-17-045, dated May 19, 2017 recommending approval of the prohibition of U-turns on both approaches on Dunbar Road from Balmoral Drive and Katherine Crescent from Dunbar Road. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit U-turns on both approaches on Dunbar Road from Balmoral Drive to Brandon Avenue, as outlined in Infrastructure Services Department report INS-17-045; and further, That U-turns be prohibited on both approaches on Katherine Crescent from Dunbar Road to Brandon Avenue. 6. INS-17-046 - GRAND TRAILS PROJECT The Committee considered Infrastructure Services Department report INS-17-046, dated May 28, 2017 recommending endorsement of the Grand Trails Project in principle, as per the City of Kitchener Cycling and Trails Advisory Committee resolution of February 14, 2017. Ms. Anne Crowe was in attendance and gave a presentation in support of the Grand Trails Project. She explained the Grand Trails Project aims at creating a network of connected trails following the Grand River and its tributaries, from Dundalk Highlands to Lake Erie. She spoke to the many benefits of project, including: environmental education; positive impacts on public health; additional tourism; and recreational opportunities. In response to questions, she advised the next phase of the project is to identify where gaps exist in the current city-owned trail networks and costs associated. On motion by Councillor Y. Fernandes - it was resolved: That the Grand Trails Project be endorsed in principle, as per the City of Kitchener Cycling and Trails Advisory Committee resolution of February 14, 2017, as outlined in Infrastructure Services Department report INS-17-046 COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES JUNE 12, 2017 - 37 - CITY OF KITCHENER 7. INS-17-048 - IRON HORSE TRAIL CENTRAL SECTION - CONSULTANT PURCHASE ORDER INCREASE Councillor P. Singh left the meeting at this time. The Committee considered Infrastructure Services Department report INS-17-048, dated May 26, 2017 recommending approval of an extension of the purchase order for Stantec Consulting Waterloo for Public Transit Infrastructure funding to the Iron Horse Trail Central Section improvements. In response to questions, Ms. D. McGoldrick explained the infrastructure funding being received from the Region of Waterloo is a result of an application-based process aimed at transit supporting initiatives. She advised the City was unable to apply the funding to other transit projects. The following motion was voted on and was Carried on a recorded vote, with Councillors B. Ioannidis, D. Schnider, K. Galloway-Sealock, S. Davey, S. Marsh, Y. Fernandes, and Z. Janecki voting in favour; and, Councillor J. Gazzola voting in opposition. Mayor B. Vrbanovic, and Councillors F. Etherington and P. Singh were absent and accordingly did not vote. On motion by Councillor Y. Fernandes - it was resolved: That an extension of the purchase order issued to Stantec Consulting Ltd. for the Iron Horse Trail Central Section (Victoria Street South to Queen Street South) in the amount of $47,058. exclusive of H.S.T., be approved, as outlined in Infrastructure Services Department report INS-17-048; and further, That the City of Kitchener enter into an agreement with the Region of Waterloo for the contribution of Public Transit Infrastructure Fund (PTIF) funding to the Iron Horse Trail Central Section improvements. 8. CSD-17-053 - NEIGHBOURHOOD PLACEMAKING CHALLENGE GRANT Councillor P. Singh re-entered the meeting at this time. The Committee considered Community Services Department report CSD-17-053, dated June 1, 2017 recommending approval of the annual Neighbourhood Placemaking Challenge Grant. Mr. D. Kropf advised he would email Council the total amounts given for each of the nine Placemaking Challenge grants awarded in August 2016, as outlined in Report CSD-17-053. In response to questions, Mr. M. May advised that no Placemaking Challenge Grant would be awarded until 2018. He indicated unused funds from the Placemaking Challenge Grant would be left in the Neighbourhood Development reserve in order to continue the program beyond two years. Councillor S. Davey left the meeting at this time. On motion, Councillor S. Marsh brought the recommendation contained in Report CSD-17-053 forward for consideration. An amendment was brought forward by Councillor S. Marsh directing staff to incorporate additional flexibility in the number of grants available in each category in order to be as responsive as possible to applications received. Councillor S. Carried on a recorded vote with Councillors B. Ioannidis, D. Schnider, K. Galloway-Sealock, P. Singh, S. Marsh, Y. Fernandes, and Z. Janecki voting in favour; and, Councillor J. Gazzola voting in opposition. Mayor B. Vrbanovic, and Councillors F. Etherington and S. Davey were absent and accordingly did not vote. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES JUNE 12, 2017 - 38 - CITY OF KITCHENER 8. CSD-17-053 - NEIGHBOURHOOD PLACEMAKING CHALLENGE GRANT The following motion was voted on and was Carried on a recorded vote with Councillors B. Ioannidis, D. Schnider, K. Galloway-Sealock, P. Singh, S. Marsh, Y. Fernandes, and Z. Janecki voting in favour; and, Councillor J. Gazzola voting in opposition. Mayor B. Vrbanovic, and Councillors F. Etherington, and S. Davey were absent and accordingly did not vote. On motion by Councillor S. Marsh - it was resolved: That the annual Neighbourhood Placemaking Challenge, as outlined in Community Services Department report CSD-17-053, be approved, as amended 9. CSD-17-060 - NEIGHBOURHOOD PROPERTY STANDARDS COMPLIANCE REVIEW AND PROACTIVE BY-LAW ENFORCEMENT Councillor S. Davey re-entered the meeting at this time. The Committee considered Community Services Department report CSD-17-060, dated May 24-law. It was suggested and agreed the following provision, as outlined in clause 10 of the List of Recommended Changes to the Property Standards By-Law, be removed: In response to questions, Ms. G. MacNeil advised staff would be supportive of removing the 24-month demolition provision. She noted the Building Code Act provides the City with authority to issue an order for remedy or demolish, as necessary, and acknowledged the 24- problematic structures. In response to questions, Ms. G. MacNeil indicated staff are currently reviewing by-laws for plain language to make them more accessible to the public. On motion by Councillor K. Galloway-Sealock - it was resolved: That Property Standards By-law, as outlined in Community Services Department report CSD-17-060, as amended 10. INS-17-047 - LOW COST/SEASONAL TRAFFIC CALMING PROGRAM The Committee considered Infrastructure Services Department report INS-17-047, dated May 24, 2017 recommending approval of the commencement of a low cost/seasonal traffic calming program in 2018. Mr. K. Carmichael and Mr. B. Cronkite were in attendance and responded to questions from the Committee. On motion by Councillor K. Galloway-Sealock - it was resolved: That Council approve the commencement of a low cost/seasonal traffic calming program in 2018, as outlined within Infrastructure Services Department report INS-17- 047; and, That each Ward Councillor, in consultation with Transportation Services staff, establish two locations per ward to execute radar speed display signs in 2017; and further, That financial support for the required infrastructure/equipment for 2018 and thereafter, be referred to future budget deliberations. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES JUNE 12, 2017 - 39 - CITY OF KITCHENER 11. INS-17-050 - 2018 SIDEWALK INFILL PROGRAM The Committee considered Infrastructure Services Department report INS-17-050, dated June 7, 2017 recommending approval for sidewalk infill as per the Sidewalk Infill Policy deferred from the May 29, 2017 Community & Infrastructure Services Department meeting for Shantz Lane and Bond Street. The Committee was in receipt this date of a petition against the proposed sidewalk infill on Shantz Lane. Ms. Lucille Waito made a presentation to the Committee in opposition to the recommendation for sidewalk infill on both sides of Shantz Lane. She indicated the residents are against a sidewalk along the residential portion the street, but willing to compromise for a sidewalk on the west side. Mr. K. Carmichael advised he would email Council the Pedestrian Charter and corresponding Staff Report. A motion was brought forward by Councillor D. Schnider recommending sidewalks only be installed on the west side of Shantz Lane, and on the east side of Bond Street. Councillor Y. Fernandes requested that Bond Street and Shantz Lane be voted on separately on a recorded vote. Sidewalk infill on the east side of Bond Street was then voted on and Carried on a recorded vote with Councillors B. Ioannidis, D. Schnider, K. Galloway-Sealock, P. Singh, and S. Davey voting in favour; and, Councillors J. Gazzola, S. Marsh, Y. Fernandes, and Z. Janecki voting in opposition. Mayor B. Vrbanovic and Councillor F. Etherington were absent and accordingly did not vote. Sidewalk infill on the west side of Shantz Lane was voted on and was Carried on a recorded vote with Councillors B. Ioannidis, D. Schnider, P. Singh, S. Davey, S. Marsh, and Y. Fernandes voting in favour; and, Councillors J. Gazzola, K. Galloway-Sealock, and Z. Janecki voting in opposition. Mayor B. Vrbanovic and Councillor F. Etherington were absent and accordingly did not vote. The following motion was voted on and was Carried on a recorded vote with Councillors B. Ioannidis, D. Schnider, K. Galloway-Sealock, P. Singh, S. Davey, S. Marsh, and Y. Fernandes voting in favour; and, Councillors J. Gazzola and Z. Janecki voting in opposition. Mayor B. Vrbanovic and Councillor F. Etherington were absent and accordingly did not vote. On motion by Councillor D. Schnider- it was resolved: That save and except the Sidewalk Infill Policy attached to Infrastructure Services Department report INS-15-051 approved by Council June 1, 2015, and as outlined in Infrastructure Services Department report INS-17-041, that Shantz Lane be approved for sidewalks only on the west side between Weber Street and the existing trail connection between Prospect Avenue and Ross Avenue; and further, That Bond Street be approved for sidewalk infill as per the Sidewalk Infill Policy attached to Infrastructure Services Department report INS-15-051 approved by Council June 1, 2015, and as outlined in Report INS-17-041 12.
