CSD-17-056 - HERITAGE PERMIT APPLICATION HPA-2017-IV-017 - 176 VICTORIA STREET NORTH - ALTERATIONS TO FRONT PORCH The Committee considered Community Services Department report CSD-17-056, dated May 1, 2017 recommending approval of alterations to the front porch of the building at 176 Victoria Street North. Ms. M. Drake presented the Report. Mr. Tung Le, property owner, was in attendance in support of the staff recommendation. With regard to the approval process, Ms. Drake advised that if approved by unanimous consent, the Heritage Permit Application would be approved through delegated authority. The following motion was then voted on and was Carried Unanimously. On motion by Mr. S. Miladinovic - it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2017-IV-017 be approved to permit alterations to the front porch of the building located on the property municipally addressed as 176 Victoria Street North, in accordance with the plans and supplementary information submitted with the application and subject to the following condition: 1. That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit. 2. CSD-17-054 - NOTICE OF INTENTION TO DESIGNATE - 710 HURON ROAD - THE GRANT HOUSE - AND - 3. CSD-17-055 - BY-LAW TO ENTER INTO A COVENANT UNDER THE ONTARIO HERITAGE ACT (OHA) FOR THE CONSERVATION OF 710 HURON ROAD - THE GRANT HOUSE The Committee considered Community Services Department report CSD-17-054, dated May 16, 2017 recommending, in accordance with Section 29 of the Ontario Heritage Act (OHA), publication of a Notice of Intention to designate the property currently municipally addressed as 710 Huron Road and known as the Grant House. In addition, the Committee considered Community Services Department report CSD-17-055, dated May 16, 2017 recommending the adoption of a By-law to allow the City to enter into a heritage covenant with the owner of 710 Huron Road for the relocation and conservation of a stone farmhouse known as the Grant House. Mr. L. Bensason presented the Reports, stating the property municipally addressed as 710 th Huron Road is a 5.35 hectare property that currently contains a mid-19 century stone th farmhouse with 20 century additions and is known as the Grant House. He indicated the one- and-one-half storey stone residence is thought to have been constructed circa 1864 and is currently listed on the Heritage Kitchener Inventory of Heritage Buildings. The applicant is in the process of developing the subject parcel of land into a residential subdivision and was HERITAGE KITCHENER MINUTES JUNE 6, 2017 - 18 - CITY OF KITCHENER 2. CSD-17-055 - BY-LAW TO ENTER INTO A COVENANT UNDER THE ONTARIO HERITAGE ACT (OHA) FOR THE CONSERVATION OF 710 HURON ROAD - THE GRANT HOUSE required to complete a Heritage Impact Assessment (HIA) and a Conservation Plan (CP) as part of that process. He stated the HIA, which was presented and discussed at the November 4, 2014 meeting of Heritage Kitchener, concluded the original farmhouse is a significant cultural heritage resource that meets the criteria for heritage designation under Part IV of the OHA. He noted within the HIA, it was identified the farmhouse was a good candidate for relocation and will be relocated to a double-wide lot and incorporated into the proposed subdivision. Mr. Bensason indicated the proposed heritage covenant will allow for the City to receive a letter of credit from the owner as a security to pay for the cost of its relocation and attributes required on account of its move and to ensure its structural soundness. Councillor P. Singh entered the meeting at this time. Mr. Nick Bogaert, MHBC Planning, was in attendance on behalf of the property owner in support of the proposal to enter into a heritage covenant and designation of the stone farmhouse municipally addressed as 710 Huron Road. In response to questions, Mr. Bensason advised the applicant is intending to incorporate the farmhouse into the proposed subdivision, restoring the dwelling and listing it for purchase. Questions were raised about installing signage identifying the significance of the farmhouse. Mr. Bensason indicated there are a number of conditions within the subdivision agreement, noting signage has been considered as part of that approval. He noted consideration is being given for the signage to be located at a new park proposed within the subdivision. In response to questions regarding the relocation of the farmhouse, Mr. Bensason advised the farmhouse was assessed by both, a heritage architect and building specialist who is a member of the Canadian Association of Heritage Professionals (CAHP), as well as a professional house moving company, and it was found to be a good candidate for relocation. Questions were raised regarding the cost to relocate the house. Mr. Bogaert advised the relocation and rehabilitation of the farmhouse is anticipated to cost $500,000. In response to further questions, Mr. Bogaert advised the house will be relocated on to a new foundation, noting there is a possibility the new foundation will be visible above ground. He stated there have been some discussions on whether the visible concrete will be covered with stones similar to those on the farmhouse, or with landscaping, which has yet to be determined. It was noted any recommendations arising from these matters would be forwarded to Council for their consideration on June 26, 2017. On motion by Mr. C. Farley - it was resolved: That pursuant to Section 29 of the Ontario Heritage Act, the Clerk be directed to publish a Notice of Intention to designate the property currently municipally addressed as 710 Huron Road and known as the Grant House as being of cultural heritage value or interest; and further, That the designating by-law be registered on the title of a smaller parcel to be contained within the existing lands, following the relocation of the Grant House which is the subject of the Notice of Intention to Designate, as outlined in Community Services Department report CSD-17-054. CSD-17-055 - BY-LAW TO ENTER INTO A COVENANT UNDER THE ONTARIO HERITAGE ACT (OHA) FOR THE CONSERVATION OF 710 HURON ROAD - THE GRANT HOUSE On motion by Mr. C. Farley - it was resolved: That the draft by-law dated May 16, 2017 attached to Community Services Department report CSD-17-055, to allow the City to enter into a heritage covenant with the owner of d 161, and currently municipally addressed as 710 Huron Road, for the relocation and conservation of a stone farmhouse known as Grant House, be adopted. 4. CSD-17-061 - HERITAGE PERMIT APPLICATION HPA-2017-IV-018 - 37 KING STREET WEST - CLEANING OF FRONT (KING STREET) ELEVATION The Committee considered Community Services Department report CSD-17-061, dated June 2, 2017 recommending approval of a Heritage Permit Application (HPA) to clean the front (King Street) elevation of the building municipally addressed as 37 King Street West to evaluate the extent of smoke and heat damage resulting from a fire on April 14, 2017. Ms. M. Drake presented the report and provided a brief overview of the heritage significance related to the subject property, noting the Designating By-law (By-law 90-160) identifies the entire front elevation above the first storey as heritage attributes. She indicated the By-law references all structural and decorative elements including the colonnade, entablatures, piers, attic and copings, but excluding the later shop-front on the ground level, and references a number of elements specifically regarding the upper floor façade. She noted, the Ontario Heritage Act (HPA) requires property owners to obtain a heritage permit every time they are proposing work that may impact the heritage attributes. Ms. Drake advised the applicant will require a second HPA for the restoration work to be completed in the second phase of the project. She further advised staff are recommending approval of the subject application with two conditions requiring the applicant to submit additional information to confirm the proposed cleaning methods. She stated the staff recommendation contains non-standard conditions so if approved, it would not be eligible for the delegated approval process and would need to be forwarded on to Council for final approval. Messrs. Jason Jackett and Dan Facca, FirstOnSite Restoration, were in attendance in support of the Heritage Permit Application and to respond to questions from the Committee. In response to questions, Mr. Facca advised the front of the building is painted, which the property owner intends to repaint as part of the restoration of the property. In response to questions, Ms. Drake advised staff have been trying to work with the applicant to assist expediting the HPA process to allow the applicant to rehabilitate the building due to the fire. She indicated the application before the Committee this date in staffs opinion is still incomplete, noting Page 5-4 of the Report, indicates a number of items that still require clarification prior to staff providing an approval recommendation without conditions. She indicated staff recognize the challenges related to receiving the necessary heritage approvals, noting Council breaks for the summer and agreed to recommend approval of the application pending additional information from the applicant prior to commencing cleaning of the building. Councillor P. Singh brought forward a motion to approve the subject application. It was noted the earliest Council would be able to consider the recommendation arising from this matter is June 26, 2017. Questions were raised on whether the application could be approved without conditions. CSD-17-061 - HERITAGE PERMIT APPLICATION HPA-2017-IV-018 - 37 KING STREET WEST - CLEANING OF FRONT (KING STREET) ELEVATION (CONTD) further damage to the structure, noting prior to the Council meeting to ensure the proposed cleaning methods will not adversely impact the building materials. On motion by Councillor P. Singh - it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2017-IV-018 be approved, as outlined in Community Services Department report CSD-17-061, to permit cleaning of the front (King Street) elevation of the building located on the property municipally addressed as 37 King Street West, in accordance with the plans and supplementary information submitted with the application and subject to the following conditions: 1. That the applicant submit additional information that confirms the proposed cleaning products and methods will not negatively impact the building materials further, 2. That an in-situ test patch will be conducted for each product and method, and each bu Heritage Planning. 5. HERITAGE BEST PRACTICES SUB-COMMITTEE UPDATES & OPEN FORUM Mr. S. Thompson provided an update on behalf of the Heritage Promotion Sub-Committee noting -year celebration, the sub-committee has recommended providing signs to all homes within the City that were in existence in 1867. He indicated there are 45 homes in total and letters have gone out to those homeowners to inquire whether they would be interested in receiving a Canada 150 heritage sign. He provided an overview of the sign design, noting staff anticipate being able to deliver the signs the following week. Ms. M. Drake advised since sending out the letters, staff have heard back from 60% of the homeowners, all of whom are interested in receiving a sign. Mr. L. Bensason advised at the May 2, 2017 Heritage Kitchener meeting, members considered a Heritage Impact Assessment (HIA) for a property municipally addressed as 369 Frederick Street. The HIA reviewed a proposed addition to the building and members expressed concerns with the proposed addition design and the reduction in the amount of green space available to residents of the long-term care facility. He indicated since that meeting, staff have worked with the applicant to address the proposed design and believe the addition now being proposed is more compatible with the 1993 structure. He provided an overview of the new design indicating although the new structure will mimic the original structure more closely, there will be a clear distinction between the original structure and the addition. He further advised the HIA has now been completed and staff have made an approval recommendation. In response to questions, Mr. Bensason advised the property is still listed on the Heritage Register, noting staff have not approached the property owner to pursue designation at this time. Mr. S. Burrows questioned, as part of the Heritage Best Practices, whether consideration could be given to establishing standards/procedures for instances such as façade cleaning, as an example. He indicated in considering the Heritage Permit Application for 37 King Street West, it may be beneficial to establish general specifications that people could work towards as a base understanding. Ms. M. Drake noted there are already documents staff consult when reviewing Heritage Permits depending on the request. She noted there can be challenges depending on the project and the type of building. She indicated the suggestion is valid and noted it would be something that could be considered further. Mr. Bensason advised as part of the heritage best practices, staff are reviewing the heritage processes with the possibility for establishing a Heritage Process Best Practices By-law.
