Drive. to Schneider Creek)

RECOMMENDATION:
That Tender T17-001 Balzer Creek Stream Restoration (Old Country Dr. to
Schneider Creek), be awarded to 560789 Ontario Limited o/a R & M Construction,
Acton, Ontario, at their tendered price of $924,638.97, including provisional items
of $5,325.,plus H.S.T. of $120,203.07, for a total of $1,044,842.04.
BACKGROUND:
Balzer Creek, a tributary of Schneider Creek, drains a watershed area of 259 hectares
and is situated entirely within the City of Kitchener. The remaining ‘open channel’
portion of Balzer Creek (that has not been buried and piped) has a length of 1.7 km and
requires reconstruction as it has experienced significant erosion over the past thirty
years. A large impetus for this project was to realign a portion of Balzer Creek where it
has migrated overtop of a sanitary sewer, placing the City at risk for early replacement
of this infrastructure.
In 2015, the City retained Ecosystem Recovery Inc. to complete the Balzer Creek
Schedule ‘B’ Class Environmental Assessment (EA).The EA evaluated a variety of
alternatives and presented preferred alternatives for creek restoration works and for the
construction of a type 2 multi-use trail per the Multi-Use Pathways & Trails Master Plan
(2012). The proposed type 2 multi-use trail will double as a maintenance access road
for the sanitary sewer in the location adjacentto the rear property line of residents living
on Brisbane Court and Brisbane Drive.

In 2017, the City retained Matrix Solutions Inc. to complete engineering design drawings
for the preferred concepts presented in the EA. All design work has been completed
andreviewed by the public at the open house held on December 14, 2016. It is worth
noting that this Balzer Creek restoration project is a candidate for fish habitat banking
pending approval by the Department of Fisheries and Oceans Canada. If approved, for
a fish habit bank any positive enhancements and/or creation of fish habitat during this
project can translate into credits that can be used on future municipal projects involving
DFO.Construction is anticipated to begin inJuly 2017 and be completed byOctober
2017.
REPORT:
Tenderswere advertised publicly on the City of Kitchener website and the internet
through the Ontario Public Buyers Electronic Tendering Information System.
Documents were downloaded sixteen (16) interested parties and by the closing date of
Thursday June 1, 2017,two (2) tenders had been received.
The tenders were reviewed by M. Wilson, Design & Construction Project Managerand
N. Gollan, Manager of Stormwater Utility,who concur with the above recommendation.

ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the city’s strategic
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
In addition to the costs anticipated in this tender, the design and implementation of
these types of projects typically involves city staff and resources from across the
corporation. These costs are included in the line item "Projected Costs: Staff
Time/Permitting/Material testing", and will be itemized when they exceed $125,000.
Included in this line item are staff time and expenses for all city staff in support of the
project such as Engineering, Kitchener Utilities, and Transportation Planning. The line
item also includes all regulatory permitting, geotechnical and material testing, detouring
and traffic control, alternate access and parking requirements and any other
miscellaneous costs. Projects utilizing in-house staff will include costs for inspection
during construction and contract administration.

The net cost for this tender (A), is fair and reasonable for a purchase of this scope and
the upset limit is within the budget allowance (B) provided within the budget. Funding
for this purchase is included within the approved capital budget. The estimated surplus
(E) will be returned to the Watercourse Improvement general account, and will be used
to fund other Watercourse Improvement projects.
