RECOMMENDATION:
That Tender T17-091 Wet Pond Retrofit of SWM Facility 10 (SWMF 10) - Zeller
Drive, be awarded to Seawaves Development Services Inc., Hamilton, Ontario, at
their tendered price of $1,278,200., including provisional items and contingencies
of $180,000., plus H.S.T. of $166,166., for a total of $1,444,366.00and;
That Tender T17-053SWM Facility Retrofit of SWM Facility 66 (SWMF66), be
awarded to 560789 Ontario Limited o/a R & M Construction, Acton, Ontario, at
their tendered price of $904,719.15, including provisional items and contingencies
of $186,705., plus H.S.T. of $117,613.49, for a total of $1,022,332.64.
BACKGROUND:
In 2016, the City completed the Integrated Stormwater Management Master Plan
(ISWM – MP), which prioritized pond retrofits based on facility control type, level of
quality protection, available sediment storage and required repairs. The two tenders for
award begin addressing the identified priorities.

T17-053 SWM Facility Retrofit of SWM Facility 66 (SWMF66)
Stormwater Management Facility (SWMF) 66 is located near Strasburg Road and
Trillium Drive. The facility is part of the Huron Business Park and the Strasburg Creek
Provincially Significant Wetland (PSW) Complex. SWMF 66 was identified as a high
priority retrofit project (Section 6.4, ISWM – MP Implementation Plan) due to the need
for major repairs on the facility’s outlet, high sediment volume andlack of water quality.
T17-091 - Wet Pond Retrofit of SWM Facility 10 (SWMF 10) - Zeller Drive
Stormwater Management Facility (SWMF) 10 is located near Lackner Boulevard
(Regional Road 54) and Zeller Drive. It is located adjacent to the IdlewoodCreek
Provincially Significant Wetland (PSW) Complex and forms part of, and drains through
the North Branch of Idlewood Creek. SWMF 10 was identified as a high priority retrofit
project (Section 6.4, ISWM – MP Implementation Plan) due to the need for major
reconfiguration on the facility’s outlet, and insufficient storage volume to provide water
quality control.

Tenderswere advertised publicly on the City of Kitchener website and the internet
through the Ontario Public Buyers Electronic Tendering Information System.
Documents were downloaded seventeen (17) interested parties and by the closing date
of Friday June 9, 2017, five (5)tenders had been received.
The tenders were reviewed by C. Denich, Aquafor Beech Limited,the City’s Consultant
for the projectand L. Walter, Design & Construction Project Managerwho concurswith
the above recommendation.

Tenders were advertised publicly on the City of Kitchener website and the internet
through the Ontario Public Buyers Electronic Tendering Information System.
Documents were downloaded twenty (20) interested parties and by the closing date of
Friday June 16, 2017, two(2) tenders had been received.
The tenders were reviewed by C. Denich, Aquafor Beech Limited,the City’s Consultant
for the projectand S. Brickman, Engineer Technologist (Stormwater)who concurwith
the above recommendation.

ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the city’s strategic
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
In addition to the costs anticipated in this tender, the design and implementation of
these types of projects typically involves city staff and resources from across the
corporation. These costs are included in the line item "Projected Costs: Staff
Time/Permitting/Material testing", and will be itemized when they exceed $125,000.
Included in this line item are staff time and expenses for all city staff in support of the
project such as Engineering, Kitchener Utilities, and Transportation Planning. The line
item also includes all regulatory permitting, geotechnical and material testing, detouring
and traffic control, alternate access and parking requirements and any other
miscellaneous costs. Projects utilizing in-house staff will include costs for inspection
during construction and contract administration.
The net cost of these tenders (A), are fair and reasonable and the upset limit is within
the available funding (B) for the projects. The estimated surplus (D) will remain within
the account to help fund future projects within the SWM Pond Retrofit Program.
