Gazzola to discuss Consent Items 5, 7, 8, 10 and 11, and Councillor S. Marsh to discuss item 12, listed on the Agenda as Consent items, which were voted on and Carried. 1. CSD-17-064 - NOISE EXEMPTION - BELMONT VILLAGE BESTIVAL The Committee considered Community Services Department report CSD-17-064, dated July 27, 2017 recommending approval of a noise exemption for Tim Moher for a free music event, located in Belmont Village, between the hours of 10:00 a.m. and 10:00 p.m. on September 16, 2017. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Tim Moher for a free music event being held in Belmont Village on September 16, 2017, between the hours of 10:00 a.m. and 10:00 p.m., as outlined in Community Services Department report CSD-17-064. 2. CSD-17-065 - NOISE AND PARKS CLOSING EXEMPTION - BREITHAUPT PARK The Committee considered Community Services Department report CSD-17-065, dated June 30, 2017 recommending approval of a noise exemption and parks closing exemption to the Mt. Hope Neighbourhood Association for their Camping Event located at Breithaupt Park from the hours of 3:00 p.m. on September 9, 2017 and noon on September 10, 2017. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) and 270 (Parks) of the City of Kitchener Municipal Code be granted to the Mt. Hope Neighbourhood Association for their thth Camping Event being held at Breithaupt Park on September 9 and 10, 2017, between the hours of 3:00 p.m. and 12:00 p.m., as outlined in Community Services Department report CSD-17- 3. CSD-17-071 - NOISE EXEMPTION - GOUDIES LANE - NIGHT SHIFT The Committee considered Community Services Department report CSD-17-071, dated August 1, 2017 recommending approval of a noise exemption for a Night Shift Event located in Goudies Lane between the hours of 6:00 p.m. and 10:00 p.m. on September 14, 2017. On motion by Councillor Y. Fernandes - it was resolved: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 41 - CITY OF KITCHENER 3. CSD-17-071 - NOISE EXEMPTION - GOUDIES LANE - That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Downtown Special Events for an additional Night Shift Event in Goudies Lane being held on September 14, 2017, between the hours of 6:00 p.m. and 10:00 p.m., as outlined in Community Services Department report CSD-17-071 4. CSD-17-068 - REMOVAL OF HOLDING PROVISION - ZC17/008/W/CL - 19 WELLINGTON STREET NORTH, 1836862 ONTARIO INC. The Committee considered Community Services Department report CSD-17-068, dated July 19, 2017 recommending approval of Zone Change Application ZC17/008/W/CL, for lands located at 19 Wellington Street North, for the purpose of removing Holding Provision 6H. On motion by Councillor Y. Fernandes - it was resolved: That Zone Change Application ZC17/008/W/CL (19 Wellington Street North) for the purpose of removing Holding Provision 6H from the lands specified on the attached Map - attached to Community Services Department report CSD-17-068 as Appendix A 5. CSD-17-072 - EXEMPT BUILDING PERMIT FEES FOR KW HABILITATION AT 108 - SYDNEY STREET SOUTH The Committee considered Community Services Department report CSD-17-072, dated July 31, 2017 recommending an exemption of building permit fees for KW Habilitation at 108 Sydney Street South. Mr. M. May was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That KW Habilitation be exempt from paying the building permit fees of $23,063.39 for their affordable housing development at 108 Sydney Street South, as per Council Policy FIN-GRA-2007 (Development Application Fees & Building Permit Fees for Affordable Rental Housing), as outlined in Community Services Department report CSD-17-072 6. INS-17-052 - ON-STREET PARKING REGULATIONS - VISTA CRESCENT The Committee considered Infrastructure Services Department report INS-17-052, dated July 6, 2017 recommending a parking prohibition on the outside curve of Vista Crescent. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit parking at any time on the outside curve (odd-numbered side) of Vista Crescent from Lakeside Drive to Lakeside Drive, as outlined in Infrastructure Services Department report INS-17-052 7. INS-17-053 - ON-STREET PARKING REGULATIONS - HUBER STREET The Committee considered Infrastructure Services Department report INS-17-053, dated July 14, 2017 recommending approval for parking at any time for three consecutive hours on the south side of Huber Street. Mr. K. Carmichael was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 42 - CITY OF KITCHENER 7. INS-17-053 - ON-STREET PARKING REGULATIONS - ) That the Uniform Traffic By-law be amended to permit parking at any time for three (3) consecutive hours on the south (odd-numbered) side of Huber Street from Kinzie Avenue to Jansen Avenue, as outlined in Infrastructure Services Department report INS-17-053 8. INS-17-054 - ON-STREET PARKING REGULATIONS - HOWLAND DRIVE The Committee considered Infrastructure Services Department report INS-17-054, dated July 20, 2017 recommending approval of a parking prohibition on the south side of Howland Drive. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit parking at any time on the south (odd-numbered) side of Howland Drive from Ottawa Street South to Cartier Drive, as outlined in Infrastructure Services Department report INS-17-054 9. INS-17-058 - ON-STREET PARKING REGULATIONS - MANSION STREET The Committee considered Infrastructure Services Department report INS-17-058, dated July 13, 2017 recommending approval of a parking prohibition on the west side of Mansion Street. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit parking at any time on the west (even-numbered) side of Mansion Street between Edna Street to a point approximately 49 metres south thereof, as outlined in Infrastructure Services Department report INS- 17-058 10. INS-17-056 - ALL-WAY STOP CONTROL - PEBBLECREEK DRIVE AT ZELLER DRIVE The Committee considered Infrastructure Services Department report INS-17-056, dated July 10, 2017 recommending approval of the installation of an all-way control stop at Pebblecreek Drive and Zeller Drive. Mr. K. Carmichael was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to install an all-way control stop at the intersection of Pebblecreek Drive and Zeller Drive, as outlined in Infrastructure Services Department report INS-17-056 11. INS-17-065 - GROH PUBLIC SCHOOL - SPEED ZONE AND PARKING REGULATIONS The Committee considered Infrastructure Services Department report INS-17-065, dated August 1, 2017 recommending approval of a 40 km/h school zone speed limit and proposed parking regulations at Groh Public School. Mr. K. Carmichael was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That a 40 km/h School Zone Speed Limit on: Thomas Slee Drive from Blair Creek Drive to Mistywood Street; and, Blair Creek Drive from Thomas Slee Drive to Mistywood Street; and, That stopping be prohibited anytime on the south side (odd-numbered) of Thomas Slee Drive from Mistywood Street to a point 365m west thereof; and, COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 43 - CITY OF KITCHENER 11. INS-17-065 - GROH PUBLIC SCHOOL - SPEED ZONE AND PARKING REGULATIONS That stopping be prohibited from 8:00 a.m. - 9:30 a.m. and 2:30 p.m. - 4:00 p.m. from Monday to Friday between September 1 and June 30, 2017, on the north side (even- numbered) of Thomas Slee Drive from Mistywood Street to a point 365m west thereof; and, That a School Bus Loading Zone be established on the south side (odd-numbered) of Thomas Slee Drive 112m west of Mistywood Street to a point 86m west thereof; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-17-065. 12. INS-17-060 - GUELPH STREET UNDERPASS ILLUMINATION - MINISTRY OF TRANSPORTATION OF ONTARIO (MTO) AGREEMENT The Committee considered Infrastructure Services Department report INS-17-060, dated July 21, 2017 recommending approval of the proposed agreement with the Ministry of Transportation of Ontario to operate, repair, maintain and use of illumination within the highway on the Guelph Street Underpass. Mr. K. Carmichael was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That the Director of Transportation Services be authorized to execute an agreement satisfactory to the City Solicitor, with Her Majesty the Queen in right of the Province of Ontario as represented by the Minister of Transportation for the Province to operate, repair, maintain and use the illumination within the highway on the Guelph Street Underpass; and further, That the Director of Transportation Services be authorized to execute future agreements with respect to operation, repair, maintenance, and use of illumination on highways, as outlined in Infrastructure Services Department report INS-17-060 13. INS-17-061 - BREITHAUPT BALL DIAMONDS LIGHTING The Committee considered Infrastructure Services Department report INS-17-061, dated August 10, 2017 recommending approval of the installation of lights at two ball diamonds in Breithaupt Park. This report is a follow-up to Infrastructure Services Department report INS- 17-008 that was considered at the March 6, 2017 Community and Infrastructure Services Committee meeting. Ms. D. McGoldrick presented an overview of the staff recommendation, noting when staff are asked to accommodate a new program or growth within an existing program, the goal is always to maximize existing infrastructure prior to looking at acquiring new lands or building new infrastructure. She indicated this goal aligns with the Strategic Plan to strengthen the are affordable, dependable and sustainable in the long-term and to continue to encourage active participation in existing recreational facilities while moving forward with the provision of new recreational opportunities in underserved areas of the city. Mr. M. Parris provided an overview of the Report, advising staff have engaged with the neighbouring community, who have expressed concerns with: parking; behaviour and noise; and, hours of operation. Mr. Parris provided an overview of the concerns and the proposed mitigations to address those concerns. He stated since the initial Committee meeting, staff also evaluated alternative scenarios to address near-term diamond capacity needs, noting lighting the Breithaupt Park diamonds represents the most cost-effective way to increase ball diamond inventory, contribute to immediate and short-term needs while also contributing to the medium-term inventory objectives, and is achievable within existing capital budgets. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 44 - CITY OF KITCHENER 13. INS-17-061 - BREITHAUPT BALL DIAMONDS LIGHTING Ms. Patti Moses addressed the Committee on behalf of a number of the property owners in the vicinity of Breithaupt Park who are in opposition to the installation of lights in the park and extension of baseball playing hours in the summer months. She stated she has already raised a number of issues related to the ball diamonds including, but not limited to: littering, trespassing, traffic and cars blocking driveways, public intoxication and urination. She stated in her opinion although staff have made attempts to provide mitigation measures to a number of issues, the one matter which they are unable to address is the in game and spectator noise. She noted often depending on the number of spectators and the game itself and noise from the spectators can be very disruptive. She expressed concerns that adding lights would extend an already disruptive 12 hours of play over the summer, with no respite in the evenings to allow residents to enjoy their yards in peace. Ms. Angela Larraguibel was in attendance in opposition to the recommendation as outlined in Report INS-17-061 for the installation of lights at the baseball diamonds in Breithaupt Park. She expressed concerns with the data outlined in the staff report regarding the use of the diamonds noting the diamonds have been observed by the area residents since the matter n a number of instances where the diamonds have been observed unused. She stated in her opinion further review needs to be completed on the use of the fields and whether they are being booked to their capacity. She stated in 1994/1995 Council considered the installation of lights for Lawn Bowling, similar concerns were raised by the community at that time. She indicated at that time Council had agreed the lights should be shut off between 9:30 and 9:45 p.m. She expressed further concerns that there were a number of other residents interested in attending the meeting this date that were not provided adequate notice by City staff to be in attendance this date. Mr. Ron Mooibroek, Kitchener Minor Baseball Association (KMBA), gave a presentation in support of the installation of the lights at Breithaupt Park. He advised registration has increased year after year, with a current enrollment of over 1000 participants. He stated the program continues to grow with lack of advertising and promotional materials seeking new players. He indicated players are being turned away each year due to lack of fields and Rep teams have lost the opportunity to practice in Kitchener during the season. He stated by adding lights to Breithaupt Park additional diamond times are available and they could accommodate more players. He further advised KMBA has a strict code of conduct, which addresses appropriate behaviours for both the players and fans. Mr. Bill Pegg, President, Kitchener Panthers and President, Kitchener Sports Association (KSA), addressed the Committee in support of the recommendation outlined in Report INS-17- 061. He stated in 1992/1993 the City proposed installing lights at the Lion diamonds and similar concerns were raised by the property owners surrounding the park as are being raised by the community this date regarding Breithaupt Park. He noted the lights were subsequently approved and in his opinion, there were many positive outcomes due to the installation of the lights. He further advised that he is a member of the KSA where their motto reflection of organized sports. Mr. Bob McKillop, Past President, KMBA, noted he was in attendance in support of the installation of the lights at Breithaupt Park. He stated he has been involved with KMBA for 35 years. He indicated the organization has always tried to be respectful of the community and he is confident that a compromise can be found between the association and the neighbouring property owners. Councillor P. Singh entered the meeting at this time. The following motion was voted on and was Carried on a recorded vote, with Mayor B. Vrbanovic and Councillors B. Ioannidis, D. Schnider, P. Singh, S. Davey, S. Marsh, K. Galloway-Sealock, Y. Fernandes and F. Etherington voting in favour; and, Councillors J. Gazzola and Z. Janecki voting in opposition. On motion by Councillor S. Marsh - it was resolved: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 45 - CITY OF KITCHENER 13. INS-17-061 - BREITHAUPT BALL DIAMD) That consideration of the following motion be referred to the August 28, 2017 Council meeting, to allow an opportunity to receive additional feedback from the community regarding the proposed lights at Breithaupt Park: That lights be installed at two ball diamonds in Breithaupt Park to address the immediate need for ball diamond inventory, and to begin to close the gap between demand and availability of diamond inventory as part of a longer-term, city-wide ball diamond inventory management strategy; and further, That the improvements to on-site parking facilities at Breithaupt Park including pedestrian access to all parking facilities, be referred to the 2017-2026 Capital Budget process for consideration, as outlined in Infrastructure Services Department report INS-17-061 14. INS-17-066 - 40 KM/H SPEED LIMIT - SHARED CYCLING ROADWAYS The Committee considered Infrastructure Services Department report INS-17-066, dated August 3, 2017 recommending a speed limit of 40 km/h be established on various roadways that are designated primarily with sharrows. Mr. K. Carmichael was in attendance and responded to questions from the Committee. Ms. Laura Paprocki, Cycling Advisory Committee member, addressed the Committee in support of the staff recommendation. Councillor S. Marsh suggested and it was agreed the boundary for the proposed 40 km/h on Queen Street North and South be amended to reflect Queen Street South from Courtland Avenue to King Street and Queen Street North from King Street to Lancaster Street East. In response to questions, Mr. Carmichael agreed to follow up on the number of collisions, traffic volumes and speeds, as well as possible education/implementation strategies with regards to the proposed 40 km/h speed limits on roadways that are designated primarily with sharrows. The following motion was voted on and was Carried on a recorded vote, with Mayor B. Vrbanovic and Councillors J. Gazzola, Z. Janecki, D. Schnider, P. Singh, S. Davey, S. Marsh, Y. Fernandes and F. Etherington voting in favour; and, Councillors K. Galloway-Sealock and B. Ioannidis voting in opposition. On motion by Councillor J. Gazzola - it was resolved: That consideration of the following motion be referred to the August 28, 2017 Council meeting, to allow staff an opportunity to provide additional information on the collisions, traffic volumes and speeds, as well as possible education/implementation strategies with regards to the proposed 40 km/h speed limits on roadways that are designated primarily with sharrows: That the Uniform Traffic By-law be amended to establish 40 km/h speed limits on roadways that are designated primarily with sharrows (shared-use) for a minimum of 75 meters at the following locations: COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 46 - CITY OF KITCHENER 14. INS-17-066 - 40 KM/H SPEED LIMIT - SHARED CYCLING ROADW Cedar Street North from Weber Street East to King Street East; Courtland Avenue South from David Street to Queen Street South; Duke Street East from Frederick Street to Cedar Street North; East Avenue from Stirling Avenue North to Borden Avenue North. Heritage Drive from Ottawa Street North to Ottawa Street North; Joseph Street from Victoria Street South to Queen Street South; King Street East from Madison Avenue to Queen Street North; King Street West from Queen Street North to Francis Street South; Nyberg Street from Sydney Street South to Borden Avenue South; Park Street from Victoria Street South to Jubilee Drive; Queen Street South from Courtland Avenue to King Street; Queen Street North from King Street to Lancaster Street East; Water Street from Jubilee Drive to Joseph Street; Zeller Drive from Lackner Boulevard to Wild Meadow Street; and further, That 40 km/h speed limits be established on any new roadways designated primarily with sharrow bicycle markings (shared-use) for a minimum of 75 meters Councillor J. Gazzola left the meeting at this time. 15. INS-17-064 - 2017/2018 SCHOOL SAFETY REVIEW The Committee considered Infrastructure Services Department report INS-17-064, dated August 1, 2017 regarding the 2017/2018 School Safety Review and the approval of two new adult crossing guards. On motion by Councillor S. Davey - it was resolved: That an Adult Crossing Guard assisted School Crossing be established for the east and south leg crosswalk locations of the signalized intersection for Fairway Road North at Lackner Boulevard; and, That an Adult Crossing Guard assisted School Crossing be established at the proposed pedestrian crossover for Lackner Boulevard at Corfield Drive; and, That funding for the two new crossing guard locations identified in Infrastructure Services Department report INS-17-064 be referred to the 2018 budget process; and, That stopping be prohibited anytime on the east and west side of Corfield Drive from Lackner Boulevard to a point 35m south thereof; and, That a School Bus Loading Zone be established on the west side (even-numbered) of Burlington Drive from a point 17m north of Rosemount Drive to a point 80m north thereof; and, That a School Bus Loading Zone be established on the west side of Confederation Drive (even-numbered) from a point 30m south of Halifax Drive to a point 40m south thereof; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Report INS-17- 064. 16. INS-17-059 -RITTENHOUSE ROAD TRAFFIC CALMING REVIEW The Committee considered Infrastructure Services Department report INS-17-059, dated July 17, 2017 recommending approval of the installation of a pedestrian refuge island on Rittenhouse Road, a raised crosswalk south of Rosebank Crescent, and proposed parking prohibition in these areas. COMMUNITY &INFRASTRUCTURE SERVICES COMMITTEEMINUTES AUGUST 21, 2017 - 47 - CITY OF KITCHENER 16. INS-17-059 -RITTENHOUSE ROAD TRAFFIC CALMING REVIEW On motion by Councillor P. Singh - it was resolved: That a pedestrian refuge island be installed on Rittenhouse Road approximately 40 metres east of Brookfield Crescent at the trail crossing; and, That a raised crosswalk be installed at the trail crossing approximately 50 metres south of Rosebank Crescent; and, That parking be prohibited at any time in the immediate area of the pedestrian refuge island and the raised crosswalk; and further, That the Uniform Traffic By-law be amended accordingly, as outlined in Infrastructure Services Department report INS-17-059. 17.
