BACKGROUND:Berkshire Building Corporation(“Berkshire”)is the registered owner of theproperty municipally known as 535 Manitou Drive which is located within the Huron Business Park, having purchased the lands from the City in various transactions. Map attached.The lands are subject to Restrictive Covenants registered by the City which, among other things, provide to the City control over any transfer of title to the said lands prior to completion and occupancy of a building on the lands.The subject property is currently undeveloped, vacant land. REPORT: Berkshire has entered into an Agreement of Purchase and Sale for the subject property which is conditional on Berkshire obtaining the City’s consent thereto. Berkshire’s solicitor has indicated that the prospective purchaser intends to develop the subject lands.
