SUBJECT: Encroachment Agreement Request — 120 McBrine Drive — fibre
optic cables beneath road allowance
RECOMMENDATION:
"That, subject to obtaining all necessary approvals, the Mayor and Clerk be
authorized to execute an Encroachment Agreement, satisfactory to the City
Solicitor, with the property owner of 120 McBrine Drive for two fibre optic cables
enclosed in conduit under the road at McBrine Drive."
BACKGROUND:
The corporate property owner, 1090536 Ontario Inc., has hired TEF LINK Security
Group Inc. to connect their neighboring properties across McBrine Drive. TEF LINK
Security Group Inc. has approached the City of Kitchener for permission to install fibre
optic cables and conduit about 36 inches deep underneath McBrine Drive. The
proposed connection would facilitate telecommunications and security between the
other two properties, located at 15 McBrine Place and 55 McBrine Place.
REPORT:
The proposed work includes two conduits. The South conduit will run for a total of 500
feet from building to building, but only about 100 feet under the City's road allowance,
and will interconnect the properties at 120 McBrine Drive and 15 McBrine Place to
upgrade existing network for telecommunications. The North conduit will run about 300
feet (less than 100 feet under the City's road allowance) and connect the other private
property at 55 McBrine Place for a new video surveillance system to prevent theft. The
fibre optic cable is described as 6 strand OM3 -MM direct burial fibre. In summary, this
work will provide the corporation with a stable communication line to properly support
their security needs and any future business growth.

Through the circulation process, the utilities engineer has mentioned the gas and water
pipes will need to be exposed when TEF LINK Security Group Inc. is directionally
drilling this conduit. Once it is installed, the corporation is required to register with
Ontario One -Call to provide the City and other utility companies specific locates for
future road work.
Furthermore, the corporation, 1090536 Ontario Inc., will be responsible for the
maintenance and repair of the fibre optic cables and conduit.
Attached is an engineered drawing for reference of the proposed work.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation outlined in this report supports the achievement of the city's
strategic vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
All fees associated with encroachments will be paid by the corporation to the City
accordingly. The Application fee of $274.00 has been paid. Processing fee of $235 will
become payable after Council approval.
