McCormick, Manager, Parking Enterprise,519 741- 2200 x7155 WARD(S) INVOLVED: Ward 9 DATE OF REPORT: September 20, 2017 REPORT NO.: INS-17-075 SUBJECT: Sanguen Health Centre Van Green Street Lot #12 ___________________________________________________________________________ RECOMMENDATIONS: That the Mayor and Clerk be authorized to execute an amendment satisfactory to the City Solicitor to the existing parking management agreement with the Waterloo Region District School Board with respect to the property located at 787 King Street West to permit alternative community service uses at the Green Street parking lot; ThatCouncil enter into a one (1) year pilot agreement satisfactory to the City Solicitor with Sanguen Health Centre to allow their use of the Green Street parking lot as a location for their mobile community health van for approximately one (1) hour on Wednesday evening, subject to the City of Kitchener being named ance policy; and further, Thatthe Infrastructure Services Department Head be authorized to execute future agreements with Sanguen Health Centre to facilitate community services uses of City owned or operated parking lots,said agreements to be satisfactory to the City Solicitor. BACKGROUND: approached T requesting permission to park their Community Health Van at the pay & display lot off of Green Street as part of Community Ministry Program (See Appendix A). It is currently proposed that the Van would be parked in the lot on Wednesday evenings for approximately one (1) hour,between 5:30 pm and 6:30 pm. *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. 6 - 1 Sanguen is a registered charity that provides various items and services including but not limited to health testing, supportive counselling, nursing services, snacks & drinks, clothing, hygiene products, pregnancy testing and pick-ups for filled sharps containers. Additional information is available on line at htttp://sanguen.com. advises that their own parking areas are not appropriate for the Van as these spaces are filled fairly quickly with volunteers assisting with dinner, customers coming to dinner, andother church activities during the proposed Van support time.The City has offered to provide 2 to Green Street lot during the t indicated this solution is not feasible as their parking areas are fairly busy and it would be inconvenient for their volunteers to have to once the Van has left for the evening. The pay & display Green Street parking lot is owned by the Waterloo Region District School . The City and the School Board are parties to an existing agreement that allows the City to use the property only as a municipal parking lot and to have metered and monthly parking (Staff Report DTS-10-092). The City may operate the parking lot 7 days a week, 24 hours a day.The City and the School Board share a 50/50 split of the net revenue from the pay & display parking operation. REPORT: Legal Services has confirmed that parking the Van on the property is not a permitted use and that to facilitate this proposed use, the Agreement will require an amendment. The School Board has confirmed it will allow the City to change the Agreement clause to include parking the Van on its property, but it is not willing to assume any additional liability and will require indemnification on all liability regarding this new use. Risk Management has indicated that there is liability associated with entering into an agreement with Sanguen. The City has asked Sanguen to amend its insurance policy to add the City and the School Board as additional insured in order for them to use the Green Street Parking Lot. Risk Management recommends the City should only Sanguen obtains appropriate liability insurance, acceptable to the City, listing the City and the School Board as additional insured. In addition, by amending the Agreement with the School Board the City would indemnify them of any risk associated with permitting this use. The City would be responsible for any residual risk that it may incur by permitting this use on site through Joint and Several Liability. That said there are overall community benefits by supporting the Should Council not support the recommendations within staff report INS-17-075 then Council could consider one of the following alternatives: 1. Decline the request and surrounding community; or 6 - 2 2. Maintain that the Vanwillwith the City and School Boardbeing parking passes provided to volunteers at the Green Street Parking Lot for the same time period. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: vision through the delivery of core service. FINANCIAL IMPLICATIONS: The revenue for one (1) hour of parking in the Green Street pay & display lot is $1.99 + HST. It is anticipated that the Van will take two (2) parking spaces. The annual loss of revenue to provide 1 hour free parking over 52 weeks for two spaces is just over $200 andis considered immaterial.Staff recommends waiving the fees for the pilot period. By indemnifying the School Board and allowing this use on the property the City of Kitchener will incur some risk. Potential liability to the City will be reduced by the requirement for Sanguen to hold reasonable liability insurance naming the City as an additional insured. COMMUNITY ENGAGEMENT: INFORM advance of the council / committee meeting. CONSULT The Waterloo Region District School Board was consulted in regards to the Community Services Van.
