The Council of the City of Kitchener met this date with all members present.
1. COMMENCEMENT —
The meeting began with the singing of "0 Canada".
2. MINUTES —
On motion by Councillor K. Galloway-Sealock, the minutes of the regular meeting held September 25,
2017 and special meetings held September 25 and October 2, 2017, as mailed to the Mayor and
Councillors, were accepted.
3. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF — N/A
4. COMMUNICATIONS REFERRED TO FILE —

5. PRESENTATIONS —
5.a. HMCS Kitchener
Mr. Morley Schwartz presented the Mayor and Council with HMCS Kitchener memorabilia in the form
of a commemorative wall display.
5.b. Governor General Sovereign's Medal for Volunteers
Mayor B. Vrbanovic, on behalf of the Governor General of Canada, presented the Governor General
Sovereign's Medal for Volunteers to Mr. Duc Vu for 10 years of community volunteer service.
5.c. Kitchener -Waterloo Oktoberfest `Harvest Award'
Ms. Victoria Raab, Director of Corporate Communications & Marketing, presented Council with the
Kitchener -Waterloo Oktoberfest Parade `Harvest Award', awarded to the City of Kitchener for parade
float design.
5.d. Government Fleet /APWA's Leading Fleets Award
Mr. Justin Readman, Interim Executive Director, Infrastructure Services, presented Council with the
Government Fleet/APWA's Leading Fleets Award. He explained the international award recognizes
outstanding fleet management within government organizations, noting the City of Kitchener is rated
within the top 50 leading fleets in the industry.
6. DELEGATIONS —
6.a. Homer Watson House & Gallery
Ms. Helena Ball, Executive Director, and Faith Hieblinger, Executive Curator, Homer Watson House
& Gallery, was in attendance to share details of the Homer Watson House & Gallery Holiday Party
and to invite members of Council and the public to participate in a small art project fundraiser at the
Gallery this Fall.
6.b Tenders
Ms. M. Palmer, Director of Supply Services, was in attendance to answer questions arising from the
tender(s) listed on the Committee of the Whole agenda of this date.

"That Tender T17-014 Construction of Strasburg Road Extension (Templewood Drive and the
future Extension of Robert Ferrie Drive), be awarded to Sierra Infrastructure Inc., Woodstock,
Ontario, at their price of $13,823,008.85, including provisional items and contingencies of
$1,456,677., plus H.S.T. of $1,796,991.15, for a total of $15,620,000.; and,
That Tender T17-104 South Strasburg Trunk Sanitary Sewer, Phase II - Construction Contract
- Huron South and Becker Estates Lands (Rockcliffe Drive to Plains Road), be awarded to
Sierra Infrastructure Inc., Woodstock, Ontario, at their price of $1,548,672.57, including
provisional items and contingencies of $155,600., plus H.S.T. of $201,327.43, for a total of
$1,750,000.; and,
That Expression of Interest E17-016 Consultant Services — Contract Administration and
Construction Inspection Strasburg Road Extension (Rush Meadow Street to Robert Ferrie
Drive Extension), be awarded to Amec Foster Wheeler, Environment & Infrastructure a
Division of Amec Foster Wheeler Americas Limited, Cambridge, Ontario, at their corrected
price of $ $525,348.33, including contingencies of $100,000., plus H.S.T. of $ $68,295.28, for a
total of $593,643.61; and further,
That Expression of Interest E17-099 Consultant Services — Five Year Ecological Monitoring
and OBA Implementation Program Strasburg Road Extension, be awarded to SNC-Lavalin
Inc., Toronto, Ontario, at their price of $ $673,515., including contingencies of $100,000., plus
H.S.T. of $ $87,556.95, for a total of $761,071.95"
Councillor Y. Fernandes requested that Expression of Interest E17-099 (Five Year Ecological
monitoring and OBA Implementation Program Strasburg Road Extension), listed as Paragraph 4 of
Item B.1.i on the Committee of the Whole, be voted on separately on a recorded vote.

6.c. Heritage Permit Application HPA-2017-V-033 — 474 and 484 Queen Street South
Ms. Vanessa Hicks, MHBC Planning, and Ms. Kate Hagerman, Region of Waterloo, were in
attendance to speak in support of the proposed demolition of 474 and 484 Queen Street South, listed
as Clause 3 on the Heritage Kitchener report.
Mr. Marco Chilanski was in attendance to speak in opposition to the proposed demolition stating the
approval of the Heritage Permit Application would set a precedent for future demolition of heritage
properties. He strongly urged Council to consider the overall impact on future development within the
City.
Ms. Barbara Wallace, Chairperson, Friends of Joseph Schneider Haus, was in attendance to support
the proposed demolition. She indicated removal of the existing buildings would allow for additional
programing opportunities for Joseph Schneider Haus.

Ms. Muriel Praught was in attendance to speak in opposition to the proposed demolition. She
expressed a desire to see the homes renovated and sold for future residential use, with the proceeds
to be used to research ways to better utilize the existing Joseph Schneider Haus property.
Ms. Kae Elgie was in attendance to speak in opposition to the proposed demolition. She expressed
concerns with the application, noting there is no evidence of over -use of the Joseph Schneider Haus'
facilities. She indicated Council has a legal obligation under the Ontario Heritage Act to protect the
heritage resources of the municipality.
Mr. Gail Pool was in attendance to speak in opposition to the proposed demolition. He stated
approval of the demolition would be against the heritage guidelines provided by the Government of
Ontario.
In response to questions, Ms. Michelle Drake, Senior Heritage and Policy Planner, explained the
Victoria Park Heritage Conservation District was established by City Council in 1996. She outlined
staff were unable to support the conclusion of the Heritage Impact Assessment, and due to a
difference of professional opinions, were unable to support the approval of the recommendation to
demolish. She further noted there is intent to remove evergreen trees in front of Joseph Schneider
Haus, but explained mature trees located at the front 474 and 484 Queen Street are in the municipal
right-of-way and will not be removed.
On motion by Councillor J. Gazzola, seconded by Councillor P. Singh, the recommendation listed as
Clause 3 of the Heritage Kitchener Report was brought forward for consideration.
A motion was brought forward by Councillor F. Etherington, seconded by Councillor Y. Fernandes, to
defer this matter until the first Regional Council meeting in 2018 to allow the Region and Schneider
Haus time to find alternative plans for a garden, and suitable housing uses for the homes facing
demolition.
Councillor Etherington's deferral motion was voted on and LOST.
An amendment was brought forward by Councillor K. Gal loway-Sealock, seconded by Councillor P.
Singh, to include a statement clarifying the rationale for approval is based solely on the proximity and
use as a National Historic Site and should not be considered as a precedent for the demolition of
other homes in approved heritage districts.
Councillor Galloway-Sealock's amendment was voted on and was Carried on a recorded voted with
Mayor B. Vrbanovic, Councillors Gal loway-Sealock, S. Marsh, D. Schnider, Y. Fernandes, S. Davey,
B. Ioannidis, and P. Singh voting in favour; and, Councillors J. Gazzola, Z. Janecki, and F.

"That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-
2017-V-033 be approved to permit the demolition of two single detached dwellings on the
properties municipally addressed as 474 and 484 Queen Street South, on the rationale that the
approval is based solely on the proximity and future use as a National Historical Site and
should not be considered as a precedent for demolition within approved heritage districts, as
referenced in Community Services Department report CSD -17-088, subject to the following
conditions:
i. That photo documentation of the single detached dwellings in accordance with
the City's standard Photographic Documentation / Recording Guidelines be
submitted to Heritage Planning staff for review and heritage clearance prior to
issuance of a demolition permit.
ii. That a salvage and commemoration plan/report be submitted to Heritage
Planning staff for review and approval prior to issuance of a demolition permit.
The salvage and commemoration plan will detail how heritage materials will be
salvaged and made available to the public and will detail how the evolution of the

original farmstead, surrounding neighbourhoods and the Queen Street South
corridor will be commemorated and interpreted.
iii. That a landscape plan (e.g. fencing, paths, trees, other landscape features, etc.)
be submitted to Heritage Planning staff for review and approval prior to March
30, 2018 and the landscape plan will be implemented prior to September 28,
2018.

Ms. Vanessa Hicks, MHBC Planning, was in attendance to speak in support of the proposed Heritage
Permit Application for 64 Margaret Avenue, listed as Clause 2 on the Heritage Kitchener report.
On motion by Councillor J. Gazzola, seconded by Councillor P. Singh, the recommendation listed as
Clause 2 of the Heritage Kitchener Report was brought forward for consideration.
A motion was brought forward by Councillor S. Marsh, seconded by Councillor Y. Fernandes, to defer
this matter until the November 6, 2017 Council meeting to allow the applicant and neighbouring
residents to discuss the development further.

HPA-2017-V-031 be approved to permit the construction of two multi -residential
buildings located on the property municipally addressed as 64 Margaret Avenue, in
accordance with the plans and supplementary information submitted with the application
and described in Community Services Department report CSD -17-086, subject to the
following conditions:
i. That final samples of the building materials and colours be submitted for review
and approval by Heritage Planning staff, in conjunction with Urban Design staff,
prior to issuance of a building permit.
That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to issuance of a building permit."'

Council was in receipt this date a memorandum submitted by Mr. Brandon Sloan, Manger, Long
Range & Policy Planning, requesting a deferral relating to the implementation of the roadway
connection and parkland identified on the properties municipally addressed as 101 and 105 Glasgow
Street, listed as Clause 5 of the Finance and Corporate Services Report.

Councillor J. Gazzola requested Clause 3 of the Finance and Corporate Services Committee report,
related to natural gas rates be voted on separately on a recorded vote.
An amendment was brought forward by Councillor J. Gazzola, seconded by Councillor Z. Janecki, to
decrease the supply component of the natural gas rate from 9.5000 cents per cubic metre to 8.5000
cents per cubic metre for system gas customers of Kitchener Utilities effective November 1, 2017, as
outlined in Report INS -17-074.
Councillor Gazzola's amendment was voted on and was LOST on a recorded voted with Councillors
J. Gazzola, Z. Janecki, and Y. Fernandes voting in favour; and Mayor B. Vrbanovic, and Councillors
S. Marsh, D. Schnider, K. Galloway-Sealock, S. Davey, B. loannidis, and F. Etherington voting in
opposition. Councillor P. Singh was absent and therefore did not vote.

to decrease the delegated authority for Goods/Services from $100,000-$750,000 to "$100,000-
$550,000".

8. UNFINISHED BUSINESS —
8.a. Heritage Permit Application HPA-2017-IV-023 —1664 Huron Road
On motion by Councillor J. Gazzola, seconded by Councillor P. Singh, the recommendation listed as
Item 8.a. Unfinished Business was brought forward for consideration.
In response to questions, Ms. Denise McGoldrick, Director of Operations — Environmental Services,
advised there is a degree of uncertainty in risk and cost as the site design has not been finalized as of
this date. She noted the additional heritage consulting work approved on September 25, 2017 was
intended to provide further analysis and costing related to the heritage farmhouse. She indicated a risk
contingency of 25% has been applied to alternatives 2 to 4, as outlined in Report INS -17-080, until more
accurate costing is available through additional study.
An amendment was brought forward by Councillor K. Gal loway-Sealock, seconded by Councillor S.
Davey, requesting staff report back prior to the end of January 2018 with additional information once
the in-depth study has been completed, providing additional financial implications between
alternatives 1 and 2, as outlined in Report INS -17-080.

"That in accordance with Section 27(3) of the Ontario Heritage Act, the written Notice of
Intention to Demolish dated August 15, 2017 to demolish the south addition and to remove and

Road, as outlined in Community Services Department report CSD -17-074 be received for
information and that the notice period run its course; and further,
That staff be directed to report back in prior to the end of January 2018 with additional
information once the in-depth study has been completed, providing additional financial
implications between alternatives 1 and 2, as outlined in Report INS -17-080."

10. QUESTIONS AND ANSWERS —
In response to questions, Mr. J. Readman, Interim Executive Director, Infrastructure Services,
advised the primary concern with moving forward with the Fairway -Traynor LRT Pedestrian Crossing
is a lack of available land on the Fairway Road side of the project. He noted the preliminary preferred
alternative is an at -grade crossing which will require the City to enter into easement agreements or
pursue land acquisition.
11. BY-LAWS (FIRST READING) —
Council agreed to the request of Ms. C. Tarling, City Clerk, to add an additional by-law for three
readings this date regarding Municipal Code Chapter 170 — Purchasing and Materials Management,
listed as Clause 4 on the Finance and Corporate Services Committee report dated October 2, 2017.

a. To further amend By-law No. 88-171, being a by-law to designate private roadways as
fire routes and to prohibit parking thereon.
b. To further amend By-law No. 2008-117, being a by-law to authorize certain on -street
and off-street parking of vehicles for use by persons with a disability, and the issuing of
permits in respect thereof.
C. To further amend By-law No. 2010-190, being a by-law to prohibit unauthorized parking
of motor vehicles on private property.
d. To confirm all actions and proceedings of the Council.
e. Being a by-law to repeal and replace Chapter 170 of the City of Kitchener Municipal
Code with respect to Purchasing and Materials Management.

FINANCE AND CORPORATE SERVICES COMMITTEE —
1. That the Uniform Traffic Bylaw be amended to prohibit stopping at any time on the west
(even -numbered) side of Katherine Crescent from a point 163 metres south of Dunbar Road to
a point 6 metres south thereof, as outlined in Infrastructure Services Department report INS -
17 -077.
2. That the Uniform Traffic Bylaw be amended to prohibit parking at any time on the north/west
(odd -numbered) side of Udvari Crescent from a point approximately 70 metres west of
Highbarry Crescent to a point approximately 20 metres west thereof, as outlined in
Infrastructure Services Department report INS -17-078.
3. That the supply component of the natural gas rate be decreased to 9.0000 cents per cubic
metre from 9.5000 cents per cubic metre for system gas customers of Kitchener Utilities
effective November 1, 2017, as outlined in Infrastructure Services Department report INS -17-
074; and,
That the transportation component of the natural gas rate be decreased to 4.5000 cents per
cubic metre from 5.0000 cents per cubic metre for system gas customers of Kitchener Utilities
effective November 1, 2017; and,
That the delivery components of the natural gas rate be changed as outlined in Report INS -17-
074 - Appendix A for all Kitchener Utilities delivery customers effective November 1, 2017; and
further,
That the Ontario Cap & Trade component of the natural gas delivery rate be increased to
3.8719 cents per cubic metre from 3.5647 cents per cubic metre for all gas customers of
Kitchener Utilities that do not manage their own compliance in accordance with Provincial
legislation, effective November 1, 2017.
4. That the Purchasing By-law attached as Appendix 2 to Finance and Corporate Services
Department report FCS -17-038, be approved; and,
That the contents of The City of Kitchener Municipal Code Chapter 170, Purchasing and
Materials Management be repealed and replaced with the provisions of the Purchasing By-
law; and further,
That By-law 2014-109 being a By-law to cover Purchasing and Materials Management policies
be repealed.
5. That the PARTS Midtown Plan, attached as Appendix A, to Community Services Department
report CSD -17-090, save and except for the implementation of the roadway connection and
parkland identified on the properties municipally addressed as 101 and 105 Glasgow Street,
be approved; and,
That staff prepare the appropriate Official Plan Amendment (i.e. incorporate an updated
Secondary Plan), the corresponding Zoning By-law Amendment and related urban design
guidelines, which will include additional public engagement and consultation, to implement the
PARTS Midtown Plan; and,
That the mobility, public realm or any relevant technical and implementation recommendations
identified in the PARTS Midtown Plan be prioritized as a part of future business plan, work
plan and budget processes; and further,
That the recommendations outlined in the PARTS Midtown Plan related to the implementation
of the roadway connection and parkland identified on the properties municipally addressed as
101 and 105 Glasgow Street, and as referred to in Clause 5 of the Finance and Corporate
Services Report, be deferred to December 4th Standing Committee of Council."

FINANCE AND CORPORATE SERVICES COMMITTEE — (CONT'D)
That beginning January 1, 2019, the 1/3 tax free portion of Council remuneration be eliminated
in compliance with Federal legislation, as outlined in Finance and Corporate Services
Department report FCS -17-164; and further,
That the current matching RRSP program for Councillors be replaced with participation in the
OMERS program on a cost -neutral basis to the City as of November 30, 2018.
HERITAGE KITCHENER —
That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-
2017-V-029 be approved to permit the alterations to the front (Joseph Street) and side
elevations, including: enclosing the porch; replacing the windows and doors; removing the
siding and shutters; installing signs; recladding the canopy; and adding a new roof and glazing
to the attached garage, of the building located on the property municipally addressed as 119
Joseph Street, in accordance with the plans and supplementary information submitted with the
application and described in Community Services Department report CSD -17-085, subject to
the following conditions:
i. That the final design of the frameless glass entrance door and the main door and
door surround (including transom and sidelights) be provided to Heritage
Planning staff for review and approval, in conjunction with the Victoria Park Area
Heritage Conservation District representative, prior to issuance of a building
permit.
ii. That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to issuance of a building permit.
iii. That the final sign permit drawings be provided to Heritage Planning staff for
review and approval, in conjunction with the Victoria Park Area Heritage
Conservation District representative, prior to issuance of a sign permit.
That the following resolution be deferred until the November 6, 2017 Council Meeting in
order to allow the applicant and neighbouring residents to discuss the development further:
That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application
HPA-2017-V-031 be approved to permit the construction of two multi -residential
buildings located on the property municipally addressed as 64 Margaret Avenue, in
accordance with the plans and supplementary information submitted with the application
and described in Community Services Department report CSD -17-086, subject to the
following conditions:
i. That final samples of the building materials and colours be submitted for review
and approval by Heritage Planning staff, in conjunction with Urban Design staff,
prior to issuance of a building permit.
That the final building permit drawings be reviewed and heritage clearance
provided by Heritage Planning staff prior to issuance of a building permit.

That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-
2017-V-033 be approved to permit the demolition of two single detached dwellings on the
properties municipally addressed as 474 and 484 Queen Street South, on the rationale that the
approval is based solely on the proximity and future use as a National Historical Site and
should not be considered as a precedent for demolition within approved heritage districts, as
referenced in Community Services Department report CSD -17-088, subject to the following
conditions:

That photo documentation of the single detached dwellings in accordance with
the City's standard Photographic Documentation / Recording Guidelines be
submitted to Heritage Planning staff for review and heritage clearance prior to

ii. That a salvage and commemoration plan/report be submitted to Heritage
Planning staff for review and approval prior to issuance of a demolition permit.
The salvage and commemoration plan will detail how heritage materials will be
salvaged and made available to the public and will detail how the evolution of the
original farmstead, surrounding neighbourhoods and the Queen Street South
corridor will be commemorated and interpreted.
iii. That a landscape plan (e.g. fencing, paths, trees, other landscape features, etc.)
be submitted to Heritage Planning staff for review and approval prior to March
30, 2018 and the landscape plan will be implemented prior to September 28,
2018
