JANUARY 8, 2018 CITY OF KITCHENER
The Community and Infrastructure Services Committee met this date, commencing at 1:11 p.m.

Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by
Councillor J. Gazzola to discuss Consent item 2 on the agenda, regarding the Neighbourhood
Associations for affiliation, which was voted on and Carried.
1. CSD-18-001 - 2018 GRAND RIVER ACCESSIBILITY ADVISORY COMMITTEE (GRAAC)
APPOINTMENTS
The Committee considered Community Services Department report CSD-18-001, dated
November 20, 2017 recommending various appointments to the Grand River Accessibility
Advisory Committee (GRAAC).
On motion by Councillor B. Ioannidis -
it was resolved:
That the following applicants be appointed to the Grand River Accessibility Advisory
Committee (GRAAC) for a 4-year term ending December 31, 2021, pending ratification
by the partnering municipalities of the City of Waterloo, Region of Waterloo, Township
of North Dumfries, Township of Wellesley, Township of Wilmot and Township of
Woolwich, as outlined in Community Service Department report CSD-18-001:

2. CSD-18-003 - ZONE CHANGE REMOVAL OF HOLDING PROVISION - ZC17/016/D/CD

The Committee considered Community Services Department report CSD-18-003, dated
November 22, 2017 recommending approval of Zone Change Application ZC17/016/D/CD, for
lands municipally addressed as 62 Daniel Avenue, for the purpose of removing Holding
Provision 18HSR.
On motion by Councillor B. Ioannidis -
it was resolved:
That Zone Change Application ZC17/016/D/CD (62 Daniel Avenue) for the purpose of
removing Holding Provision 18HSR from the lands specified on the attached Map No.1,
in the form shown in the - dated November 22, 2017, attached to
Community Services Department report CSD-18-003 as Appendix A, be approved.

3. CSD-17-102 - PERFORMANCE SECURITIES POLICY REVIEW
The Committee considered Community Services Department report CSD-17-102, dated
November 14, 2017 recommending approval of the revised Council Policy I-1080
(Performance Securities).
On motion by Councillor B. Ioannidis -
it was resolved:
That the revised Council Policy I-1080 (Performance Securities), attached to
Community Services Department report CSD-17-102 as Appendix A, be approved.
4. CSD-18-002 - 2018 NEIGHBOURHOOD ASSOCATION AFFILIATIONS
The Committee considered Community Services Department report CSD-18-002, dated
December 7, 2017 recommending approval of the Neighbourhood Associations, outlined in
-18-002, for affiliation under Council Policy MUN-FAC-324
(Affiliation - Neighbourhood Association) for 2018, and the addition of the Associations to the
rty liability insurance program.
In response to questions, Mr. M. May agreed to follow-up prior to the Council meeting on the
status of the Pine Grove Neighbourhood Association and whether they should also be included
in the list for affiliation. In addition, he agreed to provide further information on whether there
were any new neighbourhood associations added in 2018.
Councillor S. Davey entered the meeting at this time.
On motion by Councillor B. Ioannidis -
it was resolved:
That the list of proposed Neighbourhood Associations, as attached to Community
Services Department report CSD-18-002, be approved for affiliation for the year 2018
5. CAO-17-026 - COMMUNITY ENGAGEMENT POLICY
The Committee considered report CAO-17-026, dated November
23, 2017 recommending approval of the Community Engagement Policy. Ms. J. MacDonald
presented the Report and responded to questions from the Committee.
The following motion was voted on and was Carried on a recorded vote, with Mayor B.
Vrbanovic and Councillors B. Ioannidis, D. Schnider, P. Singh, S. Davey, J. Gazzola, S. Marsh,
K. Galloway-Sealock, Y. Fernandes and F. Etherington voting in favour; and, Councillor Z.
Janecki voting in opposition.
On motion by Councillor Y. Fernandes -
it was resolved:
That the Community Engagement Policy listed as attached to Chief
Office report CAO-17-026 be approved.
6. CSD-17-104 - NOISE EXEMPTION - EVER AFTER MUSIC FESTIVAL

The Committee considered Community Services Department report CSD-17-104, dated
December 5, 2017 recommending approval of a noise exemption for Ever After Music Festival,
being held at on June 8, 9, and 10, 2018. Ms. G. MacNeil was in attendance and
responded to questions from the Committee.
Mr. Rob Mattacchione, BeyondOz Productions, circulated correspondence from the City of
Ottawa, dated December 22, 2017 pertaining to noise mitigation measures that were put in

place for a festival in Ottawa as well as information on the PK Sound Trinity System. Mr.
Mattacchione advised he was in attendance in support of the Noise Exemption request for the
Ever After Music Festival. He requested consideration be given to approving the Noise
Exemption level of 60 decibel level (dBA) audible rather than the proposed 55 dBA and for the
noise exemption to be allowed until 9:30 p.m. on Sunday rather than the proposed 9:00 p.m.
He provided an overview of the event, stating since the event began ,
they have continually taken measures to reduce the potential of noise complaints. He indicated
for 2018 they have acquired a PK Sound Trinity System which will give the event sound
technicians real-time ability to control the direction of the sound waves to manage the dBA
levels at a distance to minimize potential noise complaints. He further advised they are always
seeking continuous improvement measures as it is their intention to grow and expand the
festival in future years. Mr. Mattacchione stated they had minimal noise complaints in 2016
and minimal noise complaints for the Friday and Saturday night in 2017. He indicated upon
review of the sound levels for the 2017 festival, it was identified there was a weather anomaly
on the Sunday evening, which unexpectedly impacted the dBA levels in the residential
neighbourhoods around the venue. He noted the PK Sound Trinity System was purchased as
a means to mitigate in the event of future anomalies.
In response to questions, Mr. Mattacchione advised the suggestion to shift the closing act to
afternoon hours is not preferred as the show is an electronic dance music (EDM) show where
as part of the performance, there is an accompanied light show. He stated
the headliner acts are booked as the last one or two acts of each day with the expectation a
light show would be included as part of their performance. In response to further questions
regarding the proposed 55 dBA level, he noted it would make it very challenging to achieve
that level due to the expectations of the attendees of the show, as well as the performers
expectations. He indicated he would be more confident in controlling the noise levels with a
permitted sound level of 60 dBA.
The following motion was voted on and was Carried on a recorded vote, with Mayor B.
Vrbanovic and Councillors B. Ioannidis, D. Schnider, S. Davey, J. Gazzola, S. Marsh, K.
Galloway-Sealock, Y. Fernandes and F. Etherington voting in favour; and, Councillors Z.
Janecki and P. Singh voting in opposition.
On motion by Councillor B. Ioannidis -
it was resolved:
That consideration of the following recommendation contained in Community Services
Department report CSD-17-104, be referred to the Council meeting of January 29,
2018, to allow an opportunity for staff to review the circulated information regarding the
PK Sound Trinity System provided by the event promoter; and further, review the
permitted noise exemption end time on Sunday evening, as well as consideration for
permitting the decibel level (dBA) audible at 60 dBA rather than the recommended 55
dBA:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code
be granted for Ever After Music Festival, to be held at Bingemans on June 8, 9
and 10, 2018, between the hours of 5:00 p.m. and 11:00 p.m. on the Friday
evening, 11:00 a.m. and 11:00 p.m. on the Saturday evening, and 11:00 a.m. and
9 p.m. on the Sunday evening, as outlined in Community Services Department
report CSD-17-104. This exemption is subject to the following conditions, which, if
not complied with, will render the noise exemption null and void:
a) There shall be no offensive language, in the opinion of City staff, generated
from this music festival, audible in any adjacent residential neighbourhood.
b) The event organizers will ensure that there is an on-site contact person
accessible to correspond with City staff at all times during the event.

c) The event organizers agree to respond accordingly to requests from City staff,
during the event, in order to address community concerns that may arise with
regard to the impact of noise heard within adjacent residential areas.
d) The maximum decibel level (dBA) audible from a residential area shall not
exceed 55 dBA.
e) The event organizer will be responsible for the cost of a paid-duty Noise
Officer, to be assigned specifically to this event which shall be paid in full prior
