NOISE BY-LAW EXEMPTION
ROAD AND WATERMAIN RE-CONSTRUCTION

The Committee considered Development and Technical Services Department report DTS-04-042,
dated March 22, 2004, dealing with a Noise By-law exemption for road and watermain re-
construction.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That the Regional Municipality of Waterloo, the City of Kitchener and its contractor(s) be
exempt from the provisions of Chapter 450 Noise of the City of Kitchener Municipal Code
Article 6 Construction Work during the reconstruction projects listed as City of Kitchener
Contract Nos. T04-008 and T03-034. The request for the exemption is between the hours
of 7:00 p.m. to 11:00 p.m. for the period from March 17, 2004 to September 30, 2004."

AUTUMN HILL CRESCENT
NO STOPPING
FOREST - ROCKWAY WARD
The Committee was in receipt of Development and Technical Services Department report DTS-
04-043, dated March 25, 2004, regarding the "No Stopping" regulation on the north side of
Autumn Hill Crescent.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That the "No Stopping Anytime 8:30am - 4:30pm Monday to Friday" regulation on the
north side of Autumn Hill Crescent between Westheights Drive to a point 125m west of
Westheights Drive be extended to a point 243m west of Westheights Drive; and further,
That the Uniform Traffic By-law be amended accordingly."

The Committee considered Development and Technical Services Department report DTS-04-030,
dated March 3, 2004, dealing with Zone Change Application ZC 03/06/S/SL for property located at
Strasburg and Bleams Roads.

Ms. D. Ross provided an overview of the zone change application, noting that the property is
currently zoned Service Station Zone (C-7) and the application proposes that the property be re-
zoned Residential (R-6). Ms. Ross advised that the applicant is proposing to develop the property
for residential use and has submitted a preliminary site plan. She added that originally the
applicant had proposed a 15 townhouse unit development but following comments received from
the public as a result of the statutory notice, staff worked with the applicant to amend the layout
and reduce the number of townhouse units to 13. Ms. Ross concluded her presentation, stating
that staff were recommending that the zone change application be approved in the form shown in
the proposed by-law attached to the staff report.
Mr. Bill Corbett, 218 The Country Way, attended representing many of the residents in the area of
the subject lands. Mr. Corbett advised that the area residents are objecting to the proposed re-
zoning, based mainly on the issue of incompatibility with the surrounding properties. He pointed
out that 81 residents signed the objection which equals approximately 92% of those within the 120
metre notice area. He explained that when many of the residents purchased their properties they
understood that the subject property would be used as a gas station and saw this as a buffer
between the intersection of Strasburg and Bleams Roads and the rear of their properties. The
proposed townhouse development does not offer this same buffer for the existing properties with
the reduced rear yard setbacks. Mr. Corbett also raised a concern with respect to traffic, advising
that with no parking being allowed on Strasburg or Bleams Roads, visitors to the townhouse
complex may park on The Country Way then walk through the existing walkway to the
development. Mr. Corbett concluded his presentation, stating that the area residents were not
opposed to commercial development on the subject property as long as it is compatible with the
existing residential neighbourhood, but they do oppose the 13 unit townhouse development. He
added that he would be willing to meet with the developer and staff to discuss what would be a
compatible development on the subject property.
Mr. Sam Head, Dryden Smith and Head Planning Consultants, attended representing the
applicant, stating that his client was in support of the staff recommendation. Mr. Head advised
that the proposed re-zoning conforms to the Municipal Plan; that parking requirements have been
met for the proposed development; and that City and Regional staff are in support with respect to
the overall plan and, in particular, the implications of the development on traffic in the area. Mr.
Head requested Council support for the zone change application.
In answer to a question from the Committee, Mr. Head advised that his client is willing to enter into
discussions with the area residents with respect to the site plan in an attempt to resolve any
outstanding issues. Councillor B. Vrbanovic advised that in his opinion the proposed plan
appears to be a proper use of the subject property but there are some outstanding issues that the
applicant, City staff and the area residents need to discuss in an attempt to resolve them.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That subject to further consultation with the area residents, Zone Change Application ZC
03/06/S/SL, for Savic Homes Limited, to change the zoning on the subject lands, on
Strasburg Road at Bleams Road, from Service Station Zone (C-7) to Residential Six Zone
(R-6) on lands legally described as Block "P", RP 1416, in the City of Kitchener, be
approved in the form shown in the attached "Proposed By-law", dated March 3, 2004,
without conditions."

The Committee considered Development and Technical Services Department report DTS-04-022,
dated March 1, 2004, dealing with a proposed Plan of Subdivision to be located on Lackner
Boulevard south of Victoria Street.

Ms. D. Ross provided a brief overview of the Plan of Subdivision 30T-02026, located on Lackner
Boulevard south of Victoria Street. Ms. Ross explained that the developer is proposing to
consolidate 3 multiple residential blocks with the blocks created in a previously approved plan of
subdivision and develop all the lands together. Ms. Ross advised that the proposed plan
conforms to the Municipal Plan designation and zoning.
Mr. Paul Britton, MacNaughton Hermsen Britton Clarkson, representing the applicant was in
attendance to answer any questions from the Committee. There were no questions and no other
delegations to speak on the application.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That the recommendation contained in Development and Technical Services Department
report DTS-04-022 regarding Plan of Subdivision 30T-02206 (Hallman Construction Ltd)
be adopted."
DTS-04-039
REPEAL OF COMMUNITY PLANS
CHICOPEE - GRAND RIVER WARD, FAIRVIEW - GATEWAY WARD,
SOUTH WARD AND FOREST - ROCKWAY WARD
The Committee was in receipt of Development and Technical Services Department report DTS-
04-039, dated March 9, 2004, regarding the repeal of the community plans for various wards.
Ms. K. Stork provided an overview of the staff report, noting that the purpose of a community plan
was to help guide development but that a plan does not have any legal status like that of a
Municipal Plan or Zoning By-law. Ms. Stork added that the 8 plans being proposed for repeal
have been in place for the past 30 years and in almost all cases the lands to which the plans
relate to have been developed; therefore, the purpose of the community plans have been met.
Ms. Laurie Schultz, 2098 Old Mill Road, attended representing the Lower Doon Neighbourhood
Association and advised that most of the area residents had only recently received notice of this
Committee meeting to deal with the repeal of a community plan. Ms. Schultz raised a concern
that repealing the Lower Doon Secondary Plan would be premature at this time, as not all large
vacant properties have been developed. She suggested that the community plan should not be
repealed and that it continue to help guide in development of the vacant properties. Ms. Schultz
concluded her presentation saying that in the past, secondary plans have had weight in guiding
development and although not having any legal status, there is a need to maintain the Lower
Doon Secondary Plan.
The Committee raised concerns with the possibility of repealing the Lower Doon plan prematurely
and requested that staff meet with the Neighbourhood Association to discuss the need to maintain
the plan.
On motion by Councillor B. Vrbanovic -
it was resolved:
"That the following recommendation contained in Development and Technical Services
Department report DTS-04-039, dated March 9, 2004, be deferred and referred to the
April 26, 2004 Development and Technical Services Committee meeting, to allow further
consultation with the Neighbourhood Association:
"That the following plans be repealed in their entireties:
· Block Plan 66
· Country Hills West Secondary Plan
· Forest Heights Community Concept Plan
· Forest Heights West Community Plan
· Grand River North Community Plan
