Notice is hereby given that Mayor B. Vrbanovic has called a special meeting of City Council to be

SUBJECT: APPOINTMENT OF TRIBUNAL MEMBERS – CLASS D – ADULT
ENTERTAINMENT PARLOUR ATTENDANT LICENCE

RECOMMENDATION:
That a hearing by a Committee of Council under the authority of the Municipal
Act, 2001 and Chapter 502 of The City of Kitchener Municipal Code to allow a
Committee of Council to recommend to Council whether, with respect to a 2018
Class D – Adult Entertainment Parlour Licence, the applicant be granted the
licence, granted the licence with conditions, or denied the licence; and,
That Councillors John Gazzola, Mayor Berry Vrbanovic, and Scott Davey
(alternate) be appointed as members of the tribunal; and further,
That notice be given for the hearing, to be held at Kitchener City Hall on April 11
2018, following which a report will be submitted to Council for its consideration.
BACKGROUND:
An application was received for a business licence under Chapter 502 as an Adult
Entertainment Parlour Attendant at a licensed massage parlour. Upon reviewing the
application, the Manager noted that the application was incomplete as an unsatisfactory
report was submitted as part of the application process.
REPORT:
The applicant was advised of the denial on February 6, 2018, and has since requested
an appeal of the decision.

Staff is requesting the appointment of 2 councillors plus 1 alternate as the Tribunal. The
meeting will take place at City Hall in Council Chambers. In all likelihood, the hearing
will take place in the morning but members of the Tribunal should be scheduled to
attend for the entire work day. Notice of the location and time will be sent to the
appointed members of the Tribunal as well as to the applicant.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the city’s strategic
vision through the delivery of core service.
FINANCIAL IMPLICATIONS:
The 2018 fee for a Class D – Adult Entertainment Parlour Attendant is $117.00.
COMMUNITY ENGAGEMENT:
In accordance with the City’s Rules of Procedure for Licensing Committees, a Notice of
Hearing will be sent to the applicant at least 20 days in advance of the hearing.

SUBJECT:Authorization to Execute an Amendment to Agreement of
Purchase and Sale re portion Plains Road

RECOMMENDATION:
That the Mayor and Clerk be authorized to execute an amendment to the
Agreement of Purchase and Sale with Schlegel Urban Developments Corp.,
(formerly Becker Estates Inc.) for the purchase of a portion of Plains Road, to
facilitate pre-grading of Plains Road; said amendment to be to the satisfaction of
the City Solicitor.
BACKGROUND:
Back in 2009 the City committed to closing and conveying a portion of Plains Road to
facilitate what then known as the development of Becker’s Estate Subdivision. In the
latter part of 2017 the Developer built the temporary turning circle to facilitate the actual
closing of that portion of Plains Road. The City has subsequently passed a by-law to
close that portion of Plains Road, which will become effective upon registration of the
By-law.
REPORT:
The Subdivider would like to pre-grade that portion of Plains Road. In order to facilitate
the pre-grading the City would like to advance the conveyance of that portion of Plains
Road and required amendments to the Agreement of Purchase and Sale to accomplish
earlier conveyance. Staff fully support this approach.
