SUBJECT:Patio Agreements fronting ION Tracks

RECOMMENDATION:

BACKGROUND:
Through Council Policy I-1205, the City permits the use of City owned sidewalks in Downtown
Kitchener for outdoor patios, provided the patio operators enter into an encroachment agreement with
the City. This includes the approval of a patio plan/layout that meets various design requirements as
specified in the policy.
However, the Region of Waterloo has ownership over certain roads within the City. The City would like
to be allowed to coordinate the licensing of patios for businesses located along the Light Rail Transit
(LRT) ION tracks within the City.
REPORT:
The Region of Waterloo currently does not have a process for permitting outdoor patios on Regional
roads. However, the Region is willing to delegate responsibility to lower tier municipalities, provided
each municipality enters into an agreement which will specify the terms by which the patios would
operate. The City currently has one business interested in having a patio on Duke Street that would
front the ION tracks. The City anticipates there may be more patios on Regional Roads in the future,
along Duke Street, Victoria Street, Charles Street and potential Frederick/Benton Street.
Regional staff, in consultation with lower-tier municipal staff and the contractors/operators of the ION
system, are finalizing the specific provisions of the agreement. Given the additional safety concerns of

locating a patio near the ION tracks, the Regional requirements will likely be more restrictive than the

Policy I-1205, for Council consideration, by adding any additional requirements for patios on Regional
Roads (specifically along the ION tracks).

COMMUNITY ENGAGEMENT:
As part of the Shape DTK 2020 consultation the public indicated that outdoor patios are a key
ingredient to a lively and dynamic downtown and are identified as a key deliverable of Priority #1
