Saunderson, Committee Administrator Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor J. Gazzola to discuss Consent items 1, 2 and 7, which was voted on and Carried. Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor P. Singh to discuss Consent item 5, which was voted on and Carried. 1. CSD-18-069 - NOISE EXEMPTION - TACOFEST - THEMUSEUM - 10 KING STREET WEST - JUNE 22, 2018 The Committee considered Community Services Department report CSD-18-069, dated March 13, 2018 recommending approval of a noise exemption for TacoFest at THEMUSEUM, 10 King Street West, being held on June 22, 2018 from 6:00 p.m. to 10:30 p.m. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Community Support Connections for TacoFest at THEMUSEUM, 10 King Street West, being held on June 22, 2018 from 6:00 p.m. to 10:30 p.m., as outlined in Community Services Department report CSD-18-069. 2. CSD-18-087 - NOISE EXEMPTION - BINGEMANS OKTOBERFEST - 425 BINGEMANS CENTRE DRIVE - OCTOBER 5-13, 2018 The Committee considered Community Services Department report CSD-18-087, dated April 16, 2018 recommending approval of a noise exemption for Bingemans for their Oktoberfest event, being held at 425 Bingemans Centre Drive, between October 5 and 13, 2018. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Bingemans for their Oktoberfest event being held at 425 Bingemans Centre Drive, between October 5 and October 13, 2018, as outlined in the letter provided by Mark Bingeman, dated April 6, 2018, and attached to Community Services Department report CSD-18-087 3. DSD-18-005 - ON-STREET PARKING REGULATIONS - ARDELT PLACE The Committee considered Development Services Department report DSD-18-005, dated May 11, 2018 recommending approval of a parking prohibition on both sides of Ardelt Place. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 28, 2018 - 22 - CITY OF KITCHENER 3. DSD-18-005 - ON-STREET PARKING REGULATIONS - On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit parking on both sides of Ardelt Place from a point approximately 324 metres north of Ardelt Avenue to a point 44 metres north thereof, as outlined in Development Services Department report DSD-18- 4. CSD-18-020 - KIWANIS CLUB OF CAMERON HEIGHTS AGREEMENT TO OPERATE CONCESSION IN KIWANIS PARK The Committee considered Community Services Department report CSD-18-020, dated May 7, 2018 recommending the authorization to execute an agreement with the Kiwanis Club of Cameron Heights to operate the Food Concession in Kiwanis Park. Ms. D. Keelan was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That the Mayor and Clerk be authorized to execute an agreement, subject to the satisfaction of the City Solicitor, and as outlined in Community Services Department report CSD-18-020, with the Kiwanis Club of Cameron Heights to operate the Food Concession in Kiwanis Park. 5. CSD-18-068 - NOISE EXEMPTION - K-W OKTOBERFEST INC. - VARIOUS LOCATIONS - OCTOBER 5-13, 2018 The Committee considered Community Services Department report CSD-18-068, dated March 13, 2018 recommending approval of noise exemptions for K-W Oktoberfest, being held at various locations between October 5 and 13, 2018. Ms. G. MacNeil agreed to follow up prior to the Council meeting regarding Oktoberfest events at Lot 42 and events previously hosted at the Stampede Corral by the Transylvania Club and whether additional noise exemptions would be required. On motion by Councillor Y. Fernandes - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to K-W Oktoberfest Inc. for a series of events being held at various clubs between October 5 and October 13, 2018, as outlined in the letter from K-W Oktoberfest Inc., dated February 22, 2018, and attached to Community Services Department report CSD-18-068 6. CSD-18-091 - NOISE EXEMPTION - HOLY TRINITY SERBIAN CHURCH - 700 FISCHER HALLMAN ROAD - JULY 28-29, 2018 The Committee considered Community Services Department report CSD-18-091, dated April 26, 2018 recommending approval of a noise exemption for the Holy Trinity Serbian Church for their annual Food Festival and Bull Roast being held at 700 Fischer Hallman Road on July 28 and 29, 2018 from 11:00 a.m. to 11:00 p.m. In response to concerns, Ms. G. MacNeil agreed to follow up with the event organizers regarding debris from the festival to ensure it is contained and disposed of promptly following the event. On motion by Councillor Y. Fernandes - it was resolved: COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 28, 2018 - 23 - CITY OF KITCHENER 6. CSD-18-091 - NOISE EXEMPTION - HOLY TRINITY SERBIAN CHURCH - 700 FISCHER HALLMAN ROAD - JULY 28- That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Holy Trinity Serbian Church for their annual Food Festival and Bull Roast being held at 700 Fischer Hallman Road on July 28 and July 29, 2018, between the hours of 11:00 a.m. and 11:00 p.m., as outlined in Community Services Department report CSD-18- 7. DSD-18-010 - 5-YEAR STORMWATER MANAGEMENT REPORT CARD & RESULTS OF 2017 STORMWATER MANAGEMENT MONITORING PROGRAM The Committee considered Development Services Department report DSD-18-010, dated May 8, 2018 recommending endorsement of the 5-year Stormwater Management Report Card and 2017 Stormwater Management Monitoring Program. Mr. N. Gollan was in attendance and responded to questions from the Committee. On motion by Councillor Y. Fernandes - it was resolved: That the 5-Year Stormwater Management Report Card and 2017 Stormwater Management Monitoring Program Technical Memorandum be endorsed, as outlined in Development Services Department report DSD-18- 8. PRESENTATION - REGION OF WATERLOO TRANSPORTATION MASTER PLAN UPDATE Councillor K. Galloway-Sealock advised there is an additional item to be added to the agenda this date, noting the Region of Waterloo was in attendance to provide an update on their Transportation Master Plan. She advised a motion to waive notice was required to be approved by 2/3 of the whole of Council. On motion by Councillor P. Singh - it was resolved: 25 (Procedure) the notice requirements be waived to add Region of Waterloo Transportation Master Plan Update Carried with the required 2/3 of the whole of Council. 9. DSD-18-035 - 2019 SIDEWALK INFILL THROUGH RECONSTRUCTION Councillor P. Singh declared a pecuniary interest with respect to the proposed sidewalk infill on Mausser Avenue, as members of his family own property in the vicinity of the subject project. Accordingly, he did not participate in any discussion or voting regarding those matters. The Committee considered Development Services Department report DSD-18-035, dated May 10, 2018 recommending approval for sidewalk infill as per the Sidewalk Infill Policy for the Centreville Neighbourhood, Fairmount Road, and Mausser Avenue. Messrs. K. Carmichael, B. Cronkite and S. Allen were in attendance to respond to questions from the Committee. Mr. J. Scott, Ms. C. Scott, Ms. S. Elliot, Mr. S. Elliot, Mr. B. Marks, Ms. S. Holmes, Mr. R. Schiketanz and Ms. E. Garner were in attendance in opposition to the installation of sidewalks on Fairmount Road. Concerns were raised regarding: the survey responses outlined in the staff report; the priority rating of Fairmount Road; the loss of on-site parking; loss of trees and landscaping; and, decreasing property values. It was noted there are 24 properties located on Fairmount Road and 10 of those property owners are in attendance this date in opposition to the installation of the sidewalks. Several of the residents stated in their opinion the sidewalk is not required and they do not believe a compromise would be achieved by installing one sidewalk rather than both. Mayor B. Vrbanovic entered the meeting at this time. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 28, 2018 - 24 - CITY OF KITCHENER 9. DSD-18-035 - In response to questions, Mr. Allen advised staff had a preliminary design for the location of the sidewalk and staff would have an opportunity to demonstrate/paint the location of sidewalk on Fairmount Road prior to the Council meeting. He stated although concerns have been raised regarding loss of on-site parking, none of the properties would be reduced to one on- site parking space. He further advised in the initial review staff have identified eight trees that may be impacted due to the installation of the sidewalk. Councillor Marsh questioned whether preliminary design drawings for the reconstruction have been prepared. She stated she would like to meet with the residents prior to the next Council meeting to discuss and possibly identify solutions that were raised this date. Mr. Allen stated they would endeavour to have preliminary designs available. A motion was brought forward by Councillor S. Marsh to defer consideration of Fairmount Road to the June 11, 2018 Council meeting, to allow staff an opportunity to demonstrate/paint the proposed location of the sidewalks and approve the balance of the recommendation outlined in Report DSD-18-035. voted on and was Carried on a recorded vote, with Mayor B. Vrbanovic and Councillors B. Ioannidis, D. Schnider, P. Singh, S. Davey, S. Marsh, K. Galloway-Sealock, F. Etherington, Y. Fernandes and Z. Janecki voting in favour; and, Councillor J. Gazzola voting in opposition. Councillor S. Marsh left the meeting at this time. The sidewalk infill project for Mausser Avenue related to Councillor pecuniary interest was then voted on and was Carried on a recorded vote with Mayor B. Vrbanovic and Councillors B. Ioannidis, D. Schnider, F. Etherington, K. Galloway-Sealock, Z. Janecki, S. Davey and Y. Fernandes voting in favour; and, Councillor J. Gazzola voting in opposition. Councillor P. Singh did not participate in voting due to his declaration. Councillor S. Marsh was absent and accordingly did not vote. The sidewalk infill project for the Centreville Neighbourhood was then voted on and was Carried on a recorded vote with Mayor B. Vrbanovic and Councillors B. Ioannidis, D. Schnider, F. Etherington, K. Galloway-Sealock, P. Singh, Z. Janecki, S. Davey and Y. Fernandes voting in favour; and, Councillor J. Gazzola voting in opposition. Councillor S. Marsh was absent and accordingly did not vote. On motion by Councillor S. Marsh - it was resolved: That the following streets be approved for sidewalk infill as per the Sidewalk Infill Policy MUN-STR-2004 approved by Council June 1, 2015, as outlined in Development Services Department report DSD-18-035; Centreville Neighbourhood o Centreville Street o Guerin Avenue o Huber Street o Jansen Avenue o Walker Street Mausser Avenue; and further, That Fairmount Road recommended for sidewalk infill as per the Sidewalk Infill Policy MUN-STR-2004 approved by Council June 1, 2015, as outlined in Report DSD-18-035 be deferred to the June 11, 2018 Council meeting, to allow staff an opportunity to demonstrate/paint the proposed location of the sidewalks on Fairmount Road. COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES MAY 28, 2018 - 25 - CITY OF KITCHENER 10. PRESENTATION - REGION OF WATERLOO TRANSPORTATION MASTER PLAN UPDATE Mr. Geoffrey Keyworth, Region of Waterloo presented an update on the Region of Waterloo Transportation Master Plan, which considers high-level transportation needs to 2041. He provided an overview of the vision and goals, including three scenarios that have been considered by the Region of Waterloo to advance the Master Plan. Mr. Keyworth provided an overview of the various recommendations within the Master Plan, including: Active Transportation; Public Transit; Inter-regional connections and Goods Movement; Regional Roads; and, Mobility. He provided an overview of the proposed transportation improvements for the City of Kitchener prior to 2041. 11. ADJOURNMENT On motion, this meeting adjourned at 5:50 p.m. D.
