HomeMy WebLinkAboutCouncil Minutes - 2004-04-26 SSPECIAL COUNCIL MINUTES APRIL 26, 2004 CITY OF KITCHENER A special meeting of City Council was held at 5:01 p.m. this date, Chaired by Mayor C. Zehr and with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of Financial Services Department report FIN-03-020 (J. Evans), dated April 13, 2004, recommending that uncollectible utility accounts be written off. It was noted that this report was deferred at the April 19, 2004 meeting and referred to this special meeting of Council. Councillor G. Lorentz commented on the large number of accounts in arrears and requested that the matter be deferred in order to allow discussion in camera which may involve reference to personal information. It was agreed to defer this matter to later in the meeting. Council was in receipt of Corporate Services Department report CRPS-04-074 (L. MacDonald), dated April 22, 2004, recommending authorization to execute a Record of Site Condition documentation pertaining to lands in the area of the Shirley Avenue Extension. Moved by Councillor J. Smola Seconded by Councillor G. Lorentz "That the Mayor and Clerk be authorized to execute the Record of Site Condition documentation pertaining to Part of Lots 122 and 123, German Company Tract, being Parts 2 to 12 on Plan 58R-14324, (Shirley Avenue Extension) on behalf of The Corporation of the City of Kitchener, the owner of said lands; said documentation to be to the satisfaction of the City Solicitor." Carried. Council then considered a recommendation arising from the Finance and Corporate Services Committee meeting held this date with respect to Financial Services Department report FIN-04-018 regarding the natural gas rates to commence on May 1,2004. Moved by Councillor B. Vrbanovic Seconded by Councillor M. Galloway "That the supply component of the natural gas rates be decreased to 23.9 cents per cubic meter from 26.9 cents per cubic meter for system gas customers of the City of Kitchener effective May 1,2004; and, That the transportation component of the natural gas rates be increased to 4.613 cents per cubic meter for system gas customers of the City of Kitchener effective May 1, 2004 to reflect the interim rates charged by TransCanada Pipelines as previously approved by the National Energy Board; and, That the delivery components of the natural gas rates be changed as proposed in Appendix 'A' for all Kitchener delivery customers effective May 1, 2004 (or the actual rates and dated as approved for 2004 by the Ontario Energy Board for Union South if different); and further, That the Direct Purchase Administration fee charged to all Bundled Transportation Contract customers be changed as proposed in Appendix 'B', effective June 1, 2004." Carried. Mayor C. Zehr advised of two personal matters to be added to the in-camera meeting, one being the uncollectible utility account write offs mentioned earlier. Moved by Councillor M. Galloway Seconded by Councillor C. Weylie "That an in-camera meeting of City Council be held this date to consider a land acquisition / disposition matter, a labour relations matter, three personal matters and a matter subject to solicitor-client privilege." Carried. APRIL 26, 2004 SPECIAL COUNCIL MINUTES - 158 - CITY OF KITCHENER The meeting then recessed at 5:04 p.m. and re-convened at 9:11 p.m., Chaired by Mayor C. Zehr and with all members present. Council considered Financial Services Department report FIN-03-020 regarding the write off of uncollectible utility accounts which was deferred earlier in the meeting. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That Uncollectible Utility Accounts, amounting to $663,887.44, be written off against the Allowance for Doubtful Sundry Receivables and the Allowance for Doubtful Utility Receivables." Carried. Council considered a matter arising from the in-camera meeting of Council held this date regarding the 2003 - 2004 Collective Agreement with the Kitchener Professional Firefighters Association (KPFFA). Council was in receipt of Strategic Services Department report SSD-04-018 (L. Bansen), dated April 23, 2004, recommending approval of the terms and conditions with respect to the Collective Agreement with the KPFFA. Moved by Councillor J. Smola Seconded by Councillor G. Lorentz "That Council approve the terms and conditions contained in a Memorandum of Settlement dated April 23, 2004, in connection with the 2003-2004 Collective Agreement with the KPFFA; and further, That the Mayor and Clerk be authorized to execute any documentation arising therefrom." Carried. Moved by Councillor J. Smola Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2004-74 by the Clerk."
