MINUTES OF THE REGULAR MEETING HELD MAY 11~ 2004
MEMBERS PRESENT: Messrs. P. Britton, D. Cybalski and Z. Janecki.
OFFICIALS PRESENT:
Mr. B. Sloan, Planner, Ms. R. Brent, Assistant Secretary-Treasurer and Ms.
D. Gilchrist, Secretary-Treasurer.
Mr. P. Britton, Chair, called this meeting to order at 10:00 a.m.
This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was
called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener
Municipal Code. The Committee will not make a decision on these applications but rather will make a
recommendation which will be forwarded to the Committee of the Whole and Council for final
decision.
The Chair explained that the Committee's decisions with respect to sign variances are
recommendations to City Council and not a final decision. He advised that the Committee's
recommendations will be forwarded to City Council on Monday, May 17, 2004, at 7:00 p.m., and the
applicants may register with the City Clerk to appear at the meeting if desired.

The Committee was advised that the applicant requests permission for a third party portable
sign on a property not permitted third party signs, for a temporary period of time.
The Committee noted the comments of the Region of Waterloo Transportation Planner, dated
May 3, 2004, in which they advised that they will not allow the placement of signs within the
Regional right-of-way. Consequently, they cannot approve the proposed placement of the
portable sign within the road allowance.
The Committee considered the report of the Development and Technical Services Department,
dated May 4, 2004, recommending approval of this application, subject to the sign being
relocated and setback a minimum of 0.4 m from the front lot line, located outside any driveway
visibility triangle, and not advertising any third party content except for the business known as
Camper's World.

Mr. Dahmer advised that the sign has been relocated to comply with the Region's requirement
that it not be located within the road allowance, and now complies with the City's 0.4 m
setback requirement. Mr. Dahmer also advised that his agreement with the property owner is
that the sign will be removed when the property is occupied or when the phone book is
reprinted with the proper address for his business, which ever comes first.

Seconded by Mr. P. Britton
That the application of McTaggert Water Systems requesting permission to locate a third party
portable sign on a property not permitted third party signs, for a temporary period of time, on
Part Lot 52, Plan 763 and Part Lot 1, Plan 764, 637 Victoria Street North, Kitchener, Ontario,
BE APPROVED subject to the following conditions:
That the sign shall be relocated and setback a minimum of 0.4 m (1.31 ft.) from the front
lot line, and located outside any driveway visibility triangle.
That the sign shall not advertise any third party content except for the business known
as Camper's World.
That the sign shall be removed either when this property is occupied or when the
Camper's World address is corrected in the new 3hone book, which ever happens first.
It is the opinion of this Committee that:
1. The variance approved in this application is minor in nature.
2. This application is desirable for the appropriate development of the property.
The general intent and purpose of the City of Kitchener Municipal Code Chapter 680
(Signs) is being maintained on the subject property.
