Galloway-Sealock Chair Mayor B. Vrbanovic and Councillors S. Davey, F. Etherington, Y. Fernandes, J. Gazzola, B. Ioannidis, Z. Janecki, S. Marsh, D. Schnider and P. Singh. Staff: D. McCrimmon-Jones, Transportation Planning Project Manager D. Saunderson, Committee Administrator Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor Z. Janecki to discuss Consent item 2 listed on the agenda, which was voted on and LOST. Councillor S. Marsh entered the meeting at this time. 1. CSD-18-098 - NOISE EXEMPTION K-W OKTOBERFEST INC. CONCORDIA CLUB TH - K-W OKTOBERFEST 50 ANNIVERSARY CONCERT - SEPTEMBER 22, 2018 The Committee considered Community Services Department report CSD-18-098, dated August th 24, 2018 recommending approval of a noise exemption to K-W Oktoberfest Inc. for their 50 Anniversary concert being held at the Concordia Club on September 22, 2018 between the hours of 6:00 p.m. and 1:00 a.m. It was noted any recommendation arising from this matter would be considered at a special Council meeting later this date. On motion by Councillor S. Davey - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be th granted to K-W Oktoberfest Inc. for their 50 Anniversary concert being held on Saturday, September 22, 2018, between the hours of 6:00 p.m. and 1:00 a.m. at the Concordia Club, as outlined in the letter from K-W Oktoberfest Inc., dated August 22, 2018, and attached to Community Services Department report CSD-18-098 2. CSD-18-099 - NOISE EXEMPTION BINGEMANS 425 BINGEMAN CENTRE DRIVE - FLAVOURS OF OUR WORLD FESTIVAL - OCTOBER 12 14, 2018 The Committee considered Community Services Department report CSD-18-099, dated August 24, 2018 recommending approval of a noise exemption to Bingemans for their Flavours of Our World festival being held at 425 Bingeman Centre Drive on October 12, 2018 from 6:00 p.m. to 11:00 p.m., October 13, 2018 from 3:00 p.m. to 11:00 p.m., and October 14, 2018 from 3:00 p.m. to 9:00 p.m. On motion by Councillor S. Davey - it was resolved: That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Bingemans for their Flavours of Our World festival being held on October 12, 2018 from 6:00 p.m. to 11:00 p.m., October 13, 2018 from 3:00 p.m. to 11:00 p.m. and October 14, 2018 from 3:00 p.m. to 9:00 p.m., as outlined in Community Services Department report CSD-18-099; and further, That the exemption to Chapter 450 (Noise) is subject to the following conditions, which, if not complied with, will render the noise exemption null and void: COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES SEPTEMBER 10, 2018 - 40 - CITY OF KITCHENER 2. CSD-18-099 - NOISE EXEMPTION BINGEMANS 425 BINGEMAN CENTRE DRIVE - FLAVOURS OF OUR WORLD FESTIVAL - OCTOBER 12 14, 2018 a) There shall be no offensive language, in the opinion of City staff, generated from the music events, audible in any adjacent residential neighbourhood. The event organizers will ensure that there is an on-site contact person accessible to correspond with City staff at all times during the event(s); b) The event organizer will be responsible for the cost of a pay-duty Noise Officer, to be assigned specifically to these event(s); c) The event organizers agree to respond accordingly to requests from City staff, during the event(s), in order to address community concerns that may arise with regard to the impact of noise heard within adjacent residential areas; and d) The maximum decibel level (dba) audible from a residential area shall not exceed 55 dba. 3. DSD-18-077 - KITCHENER GROWTH MANAGEMENT STRATEGY 2018 ANNUAL MONITORING REPORT The Committee considered Development Services Department report DSD-18-077, dated August 27, 2018 regarding receipt of the 2018 Kitchener Growth Management Strategy (KGMS) and providing the Monitoring Report to the Region of Waterloo. On motion by Councillor S. Davey - it was resolved: That the Kitchener Growth Management Strategy 2018 Annual Monitoring Report be received and submitted to the Regional Municipality of Waterloo in fulfillment of Clause 22.1 of the Administrative Agreement between the City of Kitchener and the Region regarding delegated approval authority, as outlined in Development Services Department report DSD-18-077. 4. DSD-18-103 - ON-STREET PARKING REGULATIONS BREITHAUPT STREET The Committee considered Development Services Department report DSD-18-103, dated August 14, 2018 recommending approval of the reinstatement of on-street parking on the north side of Breithaupt Street from Waterloo Street to a point 50 metres east for a maximum period of two consecutive hours. On motion by Councillor S. Davey - it was resolved: That the Uniform Traffic By-law be amended to reinstate on-street parking on the north (even-numbered) side of Breithaupt Street from Waterloo Street to a point 50 metres east thereof for a maximum period of two (2) consecutive hours, as outlined in Development Services Department report DSD-18- 5. DSD-18-108 - WATERLOO REGION SMALL BUSINESS CENTRE - AGREEMENT WITH THE REGIONAL MUNICIPALITY OF WATERLOO The Committee considered Development Services Department report DSD-18-108, dated August 20, 2018 regarding an agreement with the Waterloo Region Small Business Centre and the Regional Municipality of Waterloo. On motion by Councillor S. Davey - it was resolved: COMMUNITY & INFRASTRUCTURE SERVICES COMMITTEE MINUTES SEPTEMBER 10, 2018 - 41 - CITY OF KITCHENER 5. DSD-18-108 - WATERLOO REGION SMALL BUSINESS CENTRE - AGREEMENT WITH THE REGIONAL MUNICIPALITY OF WATERLOO That the Mayor and Clerk be authorized to sign an agreement, subject to the satisfaction of the City Solicitor, with the Regional Municipality of Waterloo to obtain funding for the Waterloo Region Small Business Centre services and programs for an initial two-year period with the Region having an option to renew annually thereafter on mutually agreeable terms; and further, That the Executive Director, Economic Development, Development Services Department, City of Kitchener, be authorized to sign renewal agreements, subject to the satisfaction of the City Solicitor, with the Regional Municipality of Waterloo to continue obtaining funding for the Waterloo Region Small Business Centre, as outlined in Development Services Department report DSD-18-108. 6. DSD-18-074 - ON-STREET PARKING REGULATIONS ONEIDA PLACE The Committee considered Development Services Department report DSD-18-074, dated July 26, 2018 recommending approval of a parking prohibition on the north/east side of Oneida Place. Mr. A. McCrimmon-Jones was in attendance to respond to questions from the Committee. Councillors Y. Fernandes and F. Etherington entered the meeting at this time. Ms. C. Bonsi and Mr. B. Liborion addressed the Committee in opposition to the recommendation outlined in Report DSD-18-074. They expressed concerns with the proposed parking regulation change, noting it may increase safety issues on the street. Mayor B. Vrbanovic entered the meeting at this time. Mr. J. Minaker addressed the Committee in support of the recommendation as outlined in Report DSD-18-074. In response to questions, staff agreed to consult with Kitchener Minor Soccer regarding the potential use of the nearby church as an off-street parking option, in addition, to review the off- street parking lot owned by Chicopee Ski Club as a possible option to address the on-street parking issues identified on Oneida Place. On motion by Councillor Y. Fernandes - it was resolved: That the Uniform Traffic By-law be amended to prohibit parking on the north/east (even- numbered) side of Oneida Place from a point 58 metres north of Oneida Place to a point 34 metres north thereof, as outlined in Development Services Department report DSD- 18- Pursuant to Chapter 25 (Procedure) of the Municipal Code, a motion was brought forward by Councillor Y. Fernandes to discuss Consent item 3 listed on the agenda, which was voted on and Carried. 7. DSD-18-077 - KITCHENER GROWTH MANAGEMENT STRATEGY 2018 ANNUAL MONITORING REPORT The Committee considered further considered Report DSD-18-077, dated August 27, 2018 regarding receipt of the 2018 Kitchener Growth Management Strategy (KGMS). In response to questions, staff agreed to follow up on Development Charges and whether development is funding factored into the Kitchener Growth Management Plan. 8.
