CITY OF KITCHENER
A special meeting of City Council was held at 1:36 p.m. this date, chaired by Mayor B. Vrbanovic with
all members present.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.
IN CAMERA MEETING AUTHORIZATION
Moved by Councillor Y. Fernandes
Seconded by Councillor K. Galloway-Sealock
"That an in -camera meeting of City Council be held this date to consider a land
acquisition/disposition matter, a litigation/potential litigation matter which is subject to solicitor -client
privilege, and a personal matter."
Carried.
The meeting then recessed at 3:40 p.m. and re -convened at 4:13 p.m., chaired by Mayor B. Vrbanovic
with all members present.
CSD -18-098 — NOISE EXEMPTION — KW-OKTOBERFEST INC. CONCORDIA CLUB K -W
OKTOBERFEST 50TH ANNIVERSARY CONCERT SEPTEMBER 22, 2018.
Council considered a recommendation arising from the Community and Infrastructure Services
Committee meeting held earlier this date.

"That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted
to K -W Oktoberfest Inc. for their 50th Anniversary concert being held on Saturday, September
22, 2018, between the hours of 6:00 p.m. and 1:00 a.m. at the Concordia Club, as outlined in
the letter from K -W Oktoberfest Inc., dated August 22, 2018, and attached to Community
Services Department report CSD -18-098."

FIN -18-028 — T18-111 REBUILD SALT CONVEYOR AND PREVENTATIVE MAINTENANCE
PROGRAM
Council considered Financial Services Department report FIN -18-028 (L. Stecho), dated August 28,
2018, regarding rebuilding a salt conveyor located at the Kitchener Operations Facility (KOF). Ms. D.
McGoldrick, General Manager, Infrastructure Services was in attendance and responded to questions
from Council.
Moved by Councillor J. Gazzola
Seconded by Councillor Z. Janecki
"That Tender T18-111 Rebuild Salt Conveyor and Preventive Maintenance Program, be
awarded to Donkers Millwrighting Services, St. George, Ontario, at their tendered price of
$139,190.59, including a five (5) year preventative maintenance program of $15,508., and
contingencies of $5,000., plus H.S.T. of $18,094.78, for a total of $157,285.37."
Carried.

4. DSD -18-124 — PEDESTRIAN CONNECTION BETWEEN FAIRWAY ROAD AND TRAYNOR
AVENUE
Council considered Development Services Department report DSD -18-124 (B. Cronkite), dated
September 5, 2018, regarding the acquisition of land to construct a walkway connection from Fairway
Road South and Traynor Avenue.
Mr. S. Kamminga addressed Council in support of the recommendation as outlined in DSD -18-124.
A motion was brought forward by Councillor J. Gazzola to approve the recommendation outlined in
Report DSD -18-124, including an amendment to Clause 1 and 2 of the recommendation that the
approval is subject to the upset limits as directed at an in -camera session held earlier this date, which
was seconded by Councillor Z. Janecki.

"That staff be directed to proceed with the acquisition of lands that are required to construct a
walkway connection from Fairway Road South to the LRT corridor, subject to the funding limits
as directed at the in -camera session earlier this date, as outlined in Development Services
Department report DSD -18-124; and,
That staff be directed to proceed with the acquisition of lands that are required to construct a
walkway connection from Traynor Avenue to the LRT corridor, subject to the funding limits as
directed at the in -camera session earlier this date; and,
That funding for the potential land acquisition costs be allocated from the Land Inventory
Reserve Fund (up to the existing balance) with any remaining costs being funded from the Tax
Capital Reserve Fund; and further,
That capital funding for the walkway construction be referred to the 2019 Capital Budget
process."
Carried unanimously on a recorded vote.
The meeting then recessed at 4:39 p.m. and re -convened at 8:37 p.m., chaired by Mayor B. Vrbanovic
with all members present.
5. DSD -18-079 — ZONING BY-LAW AMENDMENT — ZC17/003/F/AP - 1250, 1270 & 1314
FISCHER-HALLMAN ROAD - WAM FISCHER-HALLMAN GP INC. (ONE PROPERTIES)
Council considered a recommendation arising from the Planning and Strategic Initiatives Committee
meeting held earlier this date.
Moved by Councillor P. Singh
Seconded by Councillor S. Davey
"That Zoning By-law Amendment Application ZC17/003/F/AP for WAM Fischer -Hallman GP Inc.,
be approved, in the form shown in the "Proposed By-law" and "Map No. 1" attached to Report
DSD -18-079 as Appendix A; and,
That in accordance with Planning Act Section 45 (1.3 & 1.4) that applications for minor variances
shall be permitted for lands subject to Zoning By-law Amendment Application ZC17/003/F/AP;
and further,
That the Master Plan & Urban Design Report for 1250, 1270, and 1314 Fischer -Hallman Road,
attached to Report DSD -18-079 as Appendix B, be endorsed and provide the basis for future
site development."

6. BY-LAWS FOR THREE READINGS
Council agreed to the request of Ms. J. Rodrigues, Committee Administrator, to add a by-law for three
readings this date related to the zoning amendment for 1250, 1270, and 1314 Fischer Hallman Road.
Moved by Councillor P. Singh
Seconded by Councillor Y. Fernandes
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times,
be finally passed and numbered serially by the Clerk."
To confirm all actions and proceedings of the Council.

b. Being a by-law to amend By-law 85-1, as amended, known as the Zoning By-law for the
City of Kitchener — WAM Fischer Hallman GP Inc. — 1250, 1270, 1314 Fischer Hallman
