Reid - Chair Councillors J. Gazzola, B. Ioannidis and P. Singh, Ms. K. Huxted and Ms. S. Hossack and Messrs. P. Ciuciura, S. Miladinovic, S. Thomson, S. Burrows, S. Hamoen and S. Strohack. Staff: L. DSD-18-107 - HERITAGE PERMIT APPLICATIONS HPA-2018-V-018, HPA-2018-V-019, - HPA-2018-V-020 - 242, 254, 262 QUEEN STREET SOUTH - PROPOSED DEMOLITION The Committee considered Development Services Department report DSD-18-107, dated August 20, 2018, recommending approval of Heritage Permit Application HPA-2018-V-018 for the property municipally addressed as 242 Queen Street South; and, recommending refusal of Heritage Permit Applications HPA-2018-V-019 for the property municipally addressed as 254 Queen Street South and HPA-2018-V-020 for the property municipally addressed as 262 Queen Street South. Mr. L. Bensason presented the Report and responded to questions from the Committee. Mr. D. Currie, Mr. P. Chauvin, MHBC Planning, and Mr. S. Litt, Vive Development Corp. were in attendance in support of the HPA to demolish the properties municipally addressed as 242, 254, and 262 Queen Street South. Mr. Currie stated, in his opinion, there is a different set of policies within the Queen Street corridor that does not prohibit demolition. He further advised transition has been occurring within the Queen Street corridor that encourages higher density developments. He further advised although the properties are located within the Victoria Park Area Heritage Conservation District (VPAHCD), the policies related to heritage conservation are not being applied consistently to all three properties. Mr. P. Chauvin advised following the Heritage Kitchener meeting on August 14, 2018, possible changes to the building design were considered. He noted the only means to achieve a mid-market housing option that is more affordable to address market demand is by demolishing all three properties. Mr. Litt responded to questions from the Committee with respect to an off-site parking reduction in order to conserve 254 and 262 Queen Street South. Councillor P. Singh entered the meeting at this time. Mr. S. Burrows declared a pecuniary interest with respect to Heritage Permit Applications HPA- 2018-V-018, HPA-2018-V-019, and HPA-2018-V-020 as he owns property in close proximity to the subject property and accordingly, did not vote. It was noted any recommendation arising from this matter would be considered at Council on September 24, 2018. On motion by Councillor J. Gazzola - it was resolved: That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2018-V-018 to permit the demolition of the building located on the property municipally addressed as 242 Queen Street South be approved, as outlined in Development Services Department report DSD-18-107, subject to the following condition: a. That the owner obtain heritage approval under the Ontario Heritage Act and a Building Permit under the Building Code for a replacement building, prior to the issuance of a demolition permit. That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA- 2018-V-019 to permit the demolition of building located on the property municipally addressed as254 Queen Street South be refused, as outlined in Development Services Department report DSD-18-107. HERITAGE KITCHENER MINUTES SEPTEMBER 4, 2018 - 31 - CITY OF KITCHENER 1. DSD-18-107 - HERITAGE PERMIT APPLICATIONS HPA-2018-V-018, HPA-2018-V-019, - HPA-2018-V-020 - 242, 254, 262 QUEEN STREET SOUTH - PROPOSED DEMOLITION That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA- 2018-V-020 to permit the demolition of the building located on the property municipally addressed as 262 Queen Street South be refused, as outlined in Development Services report DSD-18- 2. DSD-18-076 - HERITAGE PERMIT APPLICATION HPA-2018-V-024 - 1380 DOON VILLAGE ROAD - PROPOSED PARTIAL DEMOLITIONS, BUILDING ADDITION AND ALTERATIONS The Committee considered Development Services Department report DSD-18-076, dated August 22, 2018, recommending approval of Heritage Permit Application HPA-2018-V-024 for the property municipally addressed as 1380 Doon Village Road to permit demolition of the breezeway and attached garage, construction of an addition, and alterations to the existing single detached dwelling. Ms. M. Drake presented the report, noting in response to the Heritage Kitchener Committee comments at the August 14, 2018 meeting, the applicant submitted final elevation drawings on August 20, 2018 showing the reduced height of the entry feature and one set of stairs on the front elevation. In response to questions, Ms. Drake advised the applicant would require approval from the Grand River Conservation Authority (GRCA), and have commenced that process. The following motion was voted on and Carried Unanimously. It was noted any recommendation arising from this matter would be forwarded to Council for their consideration on September 24, 2018. On motion by K. Huxted - it was resolved: That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2018-V-024 be approved to permit the demolition of the breezeway and attached garage, the construction of an addition and alterations to the existing single detached dwelling at the property municipally addressed as 1380 Doon Village Road, as outlined in Development Services Department report DSD-18-076, and in accordance with the plans and supplementary information submitted with the application and subject to the following conditions: a. That a sample of all proposed building materials and colours be submitted for approval by Heritage Planning staff prior to the issuance of a building permit; and, b. That the front porch design details be submitted for approval by Heritage Planning staff prior to the issuance of a building permit; and further, c. That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit. 3. DSD-18-106 - HERITAGE PERMIT APPLICATIONS HPA-2018-V-028 & HPA-2018-V-029 - 1094 DOON VILLAGE ROAD - DEMOLITION AND NEW BUILDING CONSTRUCTION The Committee considered Development Services Department report DSD-18-106, dated August 20, 2018, recommending approval to permit demolition of the existing single detached dwelling and accessory structures and permission to construct a single detached dwelling on the property municipally addressed as 1094 Doon Village Road, located within the Upper Doon Heritage Conservation District (UDHCD). Mr. L. Bensason presented the report, noting permit applications for demolition and new construction were previously made in 2014 and 2015, which were not supported by the Heritage Kitchener Committee. HERITAGE KITCHENER MINUTES SEPTEMBER 4, 2018 - 32 - CITY OF KITCHENER 3. DSD-18-106 - HERITAGE PERMIT APPLICATIONS HPA-2018-V-028 & HPA-2018-V-029 - 1094 DOON VILLAGE ROAD - Mr. P. Florica, Klondike Homes, addressed the Committee in support of the application and advised he was available to answer any questions. Ms. K. Tilt, Mr. E. Schnurr, Mr. M. Bowden, Ms. K. Huxted and Councillor Y. Fernandes addressed the Committee in opposition to the proposed HPA. They expressed the following concerns: the proposed height and square footage do not meet the criteria outlined in UDHCD By- law 88-17; the proposed new single detached dwelling is not compatible with the overall streetscape and characteristics of the existing neighbourhood; and, the proposal is not consistent with the policies outlined within the UDHCD, and could adversely impact the integrity of the Plan. They requested the Committee decline the application for new construction. Ms. K. Huxted provided a PowerPoint presentation, which contained images and square footage of neighbouring homes of 1094 Doon Village Road, noting the average of these homes is 1784 square feet. She also provided images of the heritage stock on Doon Village Road and the square footage of those homes, noting the average is 2011 square feet. She referred to pages within the Upper Doon Heritage Conservation Plan, noting it states new buildings should be complementary to the height and size of surrounding historic buildings in the neighbourhood. Ms. J. Haalboom addressed the Committee in opposition to the proposed demolition and new construction. st 1 Heritage Conservation District - cluded images of neighbouring historic homes. She noted the property municipally addressed as 1094 Doon Village Road is not proportionate in height or size to the other properties in the District. She requested staff research the history of the subject property to see if there is any significance before approving demolition. It was noted any recommendation arising from this matter will be forwarded to Council for their consideration on September 24, 2018. On motion by Councillor B. Ioannidis - it was resolved: That pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2018-V-028 be approved to permit the demolition of the existing single detached dwelling and accessory structures located on the property municipally addressed as 1094 Doon Village Road, as outlined in Development Services Department report DSD-18-106, and in accordance with the supporting information submitted with the application and subject to the following condition: a. That the owner provide heritage planning staff the opportunity to enter the property to photograph and document the existing buildings before the issuance of a demolition permit. Carried. On motion by Councillor B. Ioannidis - it was resolved: Ontario Heritage Act, Heritage Permit Application HPA-2018-V-029 be approved to permit the construction of new single detached dwelling on the property municipally addressed as 1094 Doon Village Road, as outlined in Development Services Department report DSD-18-106, and in accordance with the supporting information submitted with the application and subject to the following conditions: HERITAGE KITCHENER MINUTES SEPTEMBER 4, 2018 - 33 - CITY OF KITCHENER 3. DSD-18-106 - HERITAGE PERMIT APPLICATIONS HPA-2018-V-028 & HPA-2018-V-029 - 1094 DOON VILLAGE ROAD - DEMOLITION AND a. That a landscape plan and building site plan be reviewed and heritage clearance be provided by heritage planning staff prior to the issuance of the Heritage Permit; and, b. That the final Building Permit drawings be reviewed and heritage clearance be provided by heritage planning staff prior to issuance of a Building Permit. LOST. 4. DSD-18-105 - HERITAGE PERMIT APPLICATION HPA-2018-IV-026 - 1754 OLD MILL ROAD, HOMER WATSON HOUSE & GALLERY - MASONRY REPAIRS The Committee considered Development Services Department report DSD-18-105, dated August 21, 2018 recommending approval to permit the repair of the clay brick veneer, stone window sill, chimneys and rubble foundation on the property municipally addressed as 1754 Old Mill Road. Mr. L. Bensason was in attendance to respond to questions from the Committee. It was noted if this application receives unanimous consent from the Committee, it will be processed under delegated authority following the Committee meeting, otherwise it will go to Council on September 24, 2018. The following motion was voted on and Carried Unanimously. On motion by Councillor P. Singh - it was resolved: That pursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA-2018-IV-026 be approved to permit the repair of the clay brick veneer, stone window sill, chimneys and rubble foundation on the property municipally addressed as 1754 Old Mill Road, in accordance with the plans and supplementary information submitted with the application and subject to the following conditions: a. That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to issuance of a building permit. b. That an approximate one foot square test panel in Type K and Type N mortar be prepared for review and approval by Heritage Planning staff prior to proceeding with the work. c. That an appropriate prepared for Heritage Planning staff review and approval. d. That a sample of the new brick veneer be provided to Heritage Planning staff 5. URBAN DESIGN MANUAL UPDATE The Committee considered an internal memo entitl- Project Update & Priorities for 2018-, regarding a project overview of the Urban Design Manual update. Ms. D. Edwards provided a PowerPoint presentation describing an Urban Design Manual and how it can be used, highlighting portions of the Urban Design Manual, and what can be expected from the update. She advised in September 2018 staff will be consulting with Committees of Council and Citizen Boards and from October 2018 to Spring 2019, staff will prepare the final draft of the Urban Design Manual. She further noted stakeholder and internal staff engagement will be conducted when the final draft is complete prior to bringing the Manual forward to Council HERITAGE KITCHENER MINUTES SEPTEMBER 4, 2018 - 34 - CITY OF KITCHENER 5. URBAN DESIGN MANUAL UPDATE in Fall, 2019. She advised Committee members can review the Urban Design Manual on the feedback to the Committee Chair or City staff by the end of September 2018. She further advised Committee members can attend Doors Open Waterloo Region being held at 44 Gaukel Street on September 15, 2018 to provide feedback on the Manual. 6. NOTICE OF INTENTION TO DEMOLISH - 200 FAIRWAY ROAD SOUTH (SEARS BUILDING) Mr. L. Bensason advised as there is no Heritage Kitchener Committee meeting in October, and given pending Planning approvals, it was forward to the meeting this date. Ms. J. Rodrigues advised to add the additional item to the agenda this date, the Committee would be required to waive notice to consider the Notice of Intention to Demolish for the property municipally addressed as 200 Fairway Road South. On motion by Councillor P. Singh - it was resolved: -law, Heritage Kitchener Committee agreed to dispense with the requirements to provide notice to bring forward the Notice of Intention to Demolish 200 Fairway Road South for consideration August 28, 2017 Council Carried by the required 2/3 of the Whole of the Committee. atements of from the Municipal Heritage Registrar and the Statement of Significance: Section 3 from the Heritage Impact Assessment (HIA) prepared by VG Architects dated June 4, 2018, regarding the property municipally addressed as 200 Fairway Road South, commonly referred to as the Sears Building. Mr. Bensason advised the subject property is listed on the Municipal Heritage Register and the City is in receipt of a Notice of Intention to Demolish. He provided the Committee with an the 60 days following a Notice of Intention to Demolish if they wish to prevent demolition. He stated the Heritage Impact Assessment (HIA) of Reference, noting the property owner is in the process of updating the HIA. He indicated if the Heritage Committee requires more information, the applicant is prepared to attend the November 6, 2018 Heritage Kitchener Committee meeting. He further advised staff have received applications for redevelopment for the subject property. Mr. Bensason stated if the Committee rendered a decision this date, the Notice of Intention to Demolish could be forwarded to Council for their consideration at the September 24, 2018 Council meeting. He provided an overview of consideration this date: a. Request additional information related to the Notice of Intention to Demolish; b. Receive the Notice of Intention to Demolish, allowing the notice period to run its course, at the end of which the Building Division may issue a demolition permit; or, c. Issue a Notice of Intention to Designate, at which point Council would have the authority to deny demolition. A motion was put forward by Councillor P. Singh to receive the Notice of Intention to Demolish, allowing the notice period to run its course. LOST. It was noted as the Committee was unable to render a decision on the Notice of Intention to Demolish this date, the applicant was requested to provide additional information for the HERITAGE KITCHENER MINUTES SEPTEMBER 4, 2018 - 35 - CITY OF KITCHENER 7. STATUS UPDATES - SUB-COMMITTEE UPDATES - OPEN FORUM/HERITAGE BEST PRACTICES - HERITAGE IMPACT ASSESSMENT FOLLOW-UPS Ms. Drake advised there were no status updates this date. 8.
