SUBJECT:Noise Exemption MTO Highway 7/Highway 85 Interchange

RECOMMENDATION:
That the Ministry of Transportation, Ontario (MTO) and its contractors be exempt from the
provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work during the geotechnical and pavement investigation drilling for the
preliminary detail design for the new Highway 7/85 Interchange in the City of Kitchener.
The request for the noise by-law exemption is between the hours of 7:00 p.m. and 7:00
a.m. for the period of January 7 to May 3, 3019.
BACKGROUND:
This report is a continuation of INS-16-002 Noise Exemption Victoria St Bridge Utility
Relocation report as well as INS-16-027 Noise Exemption Victoria Street Bridge Widening and
Replacement and Shirley Avenue Widening and Extension (MTO). The Ministry of
Transportation has retained WSP (formerly MMM Group) to complete the detail design related
to the introduction of the New Highway 7 between Kitchener and Guelph.The new Highway 7
will be a four lane controlled access highway that will connect Highway 85 in Kitchener to
Highway 6 (Hanlon Parkway) in Guelph. The previous exemptions listed were related to work
which was undertaken in sequence in advance of the new construction of the new Highway 7.
REPORT:
The work to be completed will include;the drilling of 32 boreholes on Highway 85 between Krug
Street and Guelph Street along with Frederick Street between Highway 85 and Ann Street. The
boreholes will all be drilled within the MTOhighway 85and/orthe Metrolinx/Go Transit rights of
way to collect soil samples and perform testing for retaining walls and the foundations for the
new proposed overpass bridges for the new Highway 7 project. Each borehole will be completed
within in 1 to 3 nights depending on the depth. No yard site is required and equipment will be
removed from the site each day.

Night work is required due to the restricted lane closure times allowed by MTOon Highway 85.
Night drilling may also be required on Frederick Street due to the major road impact. All work
will require lane closures and must be scheduled in advance to accommodate traffic volume.
The drilling is expected to be completed within 4 months.Drilling is planned to be completed
from January 7 to May 3, 2019 between the hours of 8:00 p.m. to 6:00 a.m. Sunday night to
Friday morning.
Noise generated by the drilling process are mostly diesel engines powering the trucks and drill
rig. The drill rig creates the most noise and will run constant during all working hours which
produces noise similar to that of a running transport truck. The most disruptive noise is created
by the instrument used to collect soil samplesand will be completed in 15-30 minute intervals
throughout the duration of drilling.This tool uses a weight to drivesteel rods into the boreholes
Unfortunately there are no feasible options for reducing the level of noise created during the
drilling as the processes and tools available do not allow for lowering noise levels.

WSP is working on behalf of the Ontario Ministry of Transportation (MTO) to provide preliminary
and detail design services related to the introduction of New Highway 7 between Kitchener and
Guelph. New Highway 7 will be a four-lane controlled access freeway that will connect Highway
85 (Kitchener-WaterlooExpressway)inKitchenerto Highway6 (HanlonParkway)inGuelph
(GWP 408-88-00).Thurber EngineeringLtd.(Thurber)hasbeenretainedby WSP to complete
the geotechnical and pavement investigations for this project. Drilling on freeways such as Hwy
85 is only feasible and permissible overnight due to the restricted lane closure times allowed by
the MTO.Night drilling may also be required on Frederick St. due to the major impact roadwork
wouldotherwisehave ontheheavytraffic.Allworkwillrequirelaneclosuresandthereforeis
required to be scheduled to accommodate traffic patterns.
1.SCOPE OF WORK
The work to be completed includes drilling boreholes on Highway 85 between Krug St. and
GuelphSt.,andFrederickSt.betweenHighway85 andAnn St.Thelocationsoftheproposed
boreholes are shown on the Figures included in Appendix A. Boreholes will be drilled to collect
soil samples and perform in-situ testing if required. The boreholes to be drilled arefor retaining
walls and the foundations forproposed new overpass bridges for the New Highway 7 project.All
of the boreholes to be drilled are either within the MTO right-of-way or the Metrolinx/Go Transit
right-of-way.Eachboreholewilltake1 to 3 nights tocompletedependingon therequiredborehole
depth.Theequipmentusedto drilltheboreholeswillberemoved from siteeachday.A
material/equipment yard is not required onsite.
2.SUMMARYOF NOISE AND NOISE MITIGATION
Noise caused by proposed borehole drilling will be mostly caused by the diesel engines powering
the trucks and drill rig. Of these machines, the drill rig will be the loudest and will run during all
working hours. The drill rig engine noise however is similar tothe noise producedby a running
transport truck (70-90 dB); the noise is constant.

The loudest noise which will be madewill be caused by the instrument used to collect soil
samples. This tool uses a weight to hammer steelrodsinto the borehole and produces a loud

similar equipmentnear the drill rig. Soil sampling requires the use of this instrument and will be
done in approximately 15-30 minute intervals throughout the duration of drilling.

3.SCHEDULE OF WORK

4.NOTIFICATION TO LOCAL ADDRESSES
In an attempt to inform the public of the expected work, letters will be distributed to the addresses
anticipated to be effected by the noise caused by overnight work. Letters will outline the work to
be completed and approximate scheduling. The letter will be madeavailable to a representative
with the City of Kitchener for review prior to distribution.

SUBJECT:Disaster Mitigation and Adaptation Fund Application

RECOMMENDATION:
That Council
Fund application and commits to providing relevant municipal funding; and
Further that theChief Administrative Officer or a General Manager is hereby
authorized to executethe Disaster Mitigation and Adaptation Fund (DMAF)
application, aDMAF Transfer Payment Agreement with Infrastructure Canada,
and any other DMAF related documentation; said agreement and other related
documentation tobe tothe satisfaction of the City Solicitor.
BACKGROUND:
The Government of Canada launched the Disaster Mitigation and Adaptation Fund
(DMAF), a national merit-based program that will invest $2billion to support large-scale
infrastructure projects to help communities better manage the risks of disasters triggered
by natural hazards, particularly as they relate to increased risks posed by climate change.
Applicants must identify projects worth a minimum of $20M and the funding window to
complete the project works is from the year 2019 to 2028.
The City of Kitchener completed the Integrated Stormwater Management Master Plan
(ISWM-MP) including Council endorsement in November 2016. The ISWM-MP objectives
are in alignment with the DMAF programobjectives.

In the springof 2018 Infrastructure Canada announced that eligible candidates could
submit expressions of interest to the DMAF programto determine eligibility to complete
the full application process. A collaborative process led by the Stormwater Utility andthe
Corporate Sustainability Officer identified suitable areas where there was a rational nexus
between municipal objectives and federal objectives through the DMAF program.
An Expression of Interest was submitted by staff on July 31, 2018 and notification was
received from Infrastructure Canada in October 2018 which included an invitation to
submit thefull application for further consideration.
Climate changeand the anticipated impacts from climate change, specifically related to
flooding risks, were contemplated in the development of the ISWM-MPas well as being
identified as one of the most significant climate related risks for the City through the
development of the Corporate Climate Action Plan.Through a variety of strategies the
ISWM-MP Implementation Plan established a long term plan that adapts to changes
along with their impact on infrastructurethat have already taken place and creates
resilience to anticipated changes in the future by applying climate change criteria into the
design of new futureinfrastructureas well as renewal and replacement programs.If this
application is successful, these programs will be accelerated and unfunded flood
mitigation projects beyond the 10 year capital budgettimeframe maybe brought forward
to be addressed sooner than currently anticipated.
Through continued strong partnerships with REEP and the GRCA, the submission of this
significantthreats to our community in a comprehensive and collaborative manner.

FINANCIAL IMPLICATIONS:
The total value of the 2019 2028 project being advanced to the final application stage
is approximately $125M. The framework for the DMAF program prescribes a funding
formula for successful municipal projects to be fully funded basedon a 40% federal /60%
municipal cost sharing arrangement.The municipal share of this funding application is
primarilyfunded throughthe existing stormwater utility capital forecastand the stormwater
portion of the full road reconstruction projects.
As no announcementwill be maderegarding successful DMAF applicantsuntil spring
2019at the earliest, there are no implications to the 2019 budget process. If successful,
it would allow the City to advance work planned as part of the ISWM-MP, and any
resulting changes to the capital forecast would be made as part of the 2020 budget
process.

COMMUNITY ENGAGEMENT:
Extensive consultation, collaboration and information sharing took place during the
development of the ISWM-MP and Implementation Plandevelopment.

SUBJECT:Dalewood Drive Sanitary Sewer Repair

RECOMMENDATION:
Thatstaff be directed to proceed with the immediate repair of a segment of Sanitary
Sewer on Dalewood Drive to address ongoing sewage backup issues, with funding
for the repair to be allocated from the Sanitary Sewer Maintenance Account.
BACKGROUND:
City of Kitchener Operations has been maintaining an area of problematic sanitary sewer
on Dalewood Drivethrough the implementation of a regular,targeted flushing program.
City staff have responded to several instances of sewage backups/basement flooding.
The replacement of approximately 225 metres of this sanitary sewer will reduce or
eliminate the need for extensive flushing, and more importantly, will significantly reduce
the chances of sewage backing up into private service connections, thereby reducing the
cback-ups.
REPORT:
City of Kitchener Operations has been maintaining an area of sanitary sewer on
Dalewood Drive. This sanitary pipe was originally constructed in approximately 1965.A
shallow sanitary outlet to the street has resulted in an original installation of sub-standard
slopes in some areas. This coupled with localizedpipe settlement has resulted in poor
sewage flows in some sections of the sewerwhich significantly affec

drain properly. Therefore,deposits accumulate and require regular and frequent flushing
to prevent blockages in the main line and up into residential service connections. The
current flushing cycle is every 2 months.City staffhave responded to 7instances of
sewage backups/basement floodingin the last 10 years, the most recent backup being
onMarch 5, 2018. The replacement of approximately 225 metres of this sanitary sewer
(see Figure 1) will reduce or eliminate the need forextensive flushing, and more
importantly, will significantly reduce the chances of sewage backing up into private
service connections, thereby reducing major inconvenience to homeowners and
potential liability for damages as a result of such instances.Design activities have
commenced to allow for the repair tobe completed early in 2019.

it becomes a candidate for this program.

FINANCIAL IMPLICATIONS:
Under normal circumstances, this work would be identified as a project in the 2019 budget
which is scheduled to be approved by council late January 2019, however this timing
would not allow construction to commence untillater in 2019, resulting in ongoing
maintenance costs and increased risk to homeowners. Given the relative urgency of the
work staff are recommending that funding be allocated in advance of the 2019 capital
budget.
The cost of the sanitary sewer repair,including design work, geotechnical investigations
and staff time,is estimated to be $538,994. This is apre-designestimate and has a
contingency of 20% built into the estimate. The repair will be funded fromthe Sanitary
SewerMaintenanceaccount which is forecast to have a budget remaining of$680,286at
the end of 2018before funding this work.The watermain replacement will befunded from
an existinguncommitted budget item.
