HomeMy WebLinkAboutCouncil Minutes - 1998-04-06 SCOUNCIL\1998-04-06-SPE APRIL 6, 1998 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:50 p.m. this date and Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council was in receipt of a report from L. MacDonald, Assistant City Solicitor, dated April 2, 1998 explaining a request for a correction of the March 2, 1998 Council resolution pertaining to the re-naming of Waterford Road, and consideration of a by-law for two readings this date. This is due to an incorrect reference to Waterford Street, rather than Waterford Road, and re-enacting of the by-law is required at this time. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That the reference to Waterford 'Street' in the resolution and by-law corresponding to Item No. 10 A (By-laws - 1st reading) of the March 30, 1998 Council agenda be changed to read Waterford 'Road', and that a by-law to rename Waterford Road as Tillsley Drive be given first and second readings this date and stand referred to the May 4, 1998 Council meeting for third reading." Carried. Moved by Councillor C. Weylie Seconded by Councillor M. Yantzi "That pursuant to Section 25.4.4 of Chapter 25 (Council Procedure) of the Municipal Code, an item relating to review of the City's Job Evaluation System be added to the special Council agenda for consideration this date." Carried with the unanimous consent of the whole Council. Councillor B. Vrbanovic disclosed a pecuniary interest and abstained from all voting and discussion concerning the review of the Job Evaluation System as his wife is employed by the City's Information Services Division. Council then considered a recommendation arising out of the Finance and Administration Committee meeting of this date in regard to a review of the City's Job Evaluation System. Moved by Councillor Jake Smola Seconded by Councillor J. Ziegler "That a sub-committee comprised of Mayor C. Zehr, Councillors Jake Smola, K. Taylor-Harrison, T. Galloway and J. Ziegler, be struck to review and table a report on the draft terms of reference for the review of the City's Job Evaluation System, and to suggest a process for review of the terms with the consultant, MacCrimmon & Associates, Ottawa, at a special meeting of Council to be held on April 14, 1998 at 4 p.m." Carried. Councillor B. Vrbanovic previously disclosed a pecuniary interest and abstained from all voting and discussion concerning the review of the Job Evaluation System as his wife is employed by the City's Information Services Division. Council was advised of an additional personal matter for consideration at the in-camera meeting of this date. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That an in-camera meeting of City Council be held immediately following this special meeting to consider two personal matters, a land acquisition matter and two matters subject to solicitor-client privilege." Carried. APRIL 6, 1998 SPECIAL COUNCIL M/NUTES - 186- CITY OF KITCHENER The meeting then recessed at 12:55 p.m. to allow Council to consider its in-camera agenda and reconvened at 1:45 p.m., chaired by Mayor C. Zehr and with the following members present: Councillors T. Galloway, M. Yantzi, J. Ziegler, G. Lorentz, J. Haalboom, C. Weylie and Jake Smola. Moved by Councillor J. Ziegler Seconded by Councillor Jake Smola "That the City accepts the offer of Todor Vasilije and Stana Vasilije, set out in the April 2, 1998 letter of their solicitor, Russell N. Lawson, to settle in full all of their expropriation claims relating to 32-34 Joseph Street for the additional sum of $5,800 plus interest in the sum of $3,600." Carried. Moved by Councillor J. Ziegler Seconded by Councillor Jake Smola "That the City extend the expiry date from March 29, 1998 to April 24, 1998 in the Option Agreement dated September 30, 1997 with lan Cook Construction Limited, to purchase Parts 4, 5 and 6 Reference Plan 58R-10893, for the sum of $322,310; and further, That such Option Agreement may be further extended for an additional six months, by notice in writing to the City and payment of the sum of $16,115.50 to be received no later than April 24, 1998." Carried. Moved by Councillor Jake Smola Seconded by Councillor J. Ziegler "That leave be given the Mover and Seconder to introduce a by-law for first and second readings to rename Waterford Road as Tillsley Drive." Carried. Moved by Councillor J. Ziegler Seconded by Councillor Jake Smola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 98-39 by the Clerk." Carried. On motion the meeting adjourned at 1:50 p.m. MAYOR CLERK
