Re: Committee of Adjustment Meeting on November 13, 2018, City of Kitchener
Regional staff have reviewed the following Committee of Adjustment applications and
have following comments:
1. FN 2018-003 626 Blair Creek Drive No Concerns
2. SG 2018-013 396 Victoria Street North At this location the Regional Official
Plan designates Regional Road 55 (Victoria Street), Bruce Street to Westmount
Road, at 26.213 metres. Should a development application be submitted for this
property, an approximate 3 metre road widening would be required. As such, we
would not support having the sign located within the future road widening. We
request that the sign be relocated outside of the designated road allowance.
3. A 2018-116 359 Alice Avenue At this location, the subject property appears
to have the municipal sidewalk within their private property. Regional staff would
like to work with City staff and the property owner to have the portion of the lands
containing the sidewalk be put in Regional ownership. The Region can contribute
up to $1800.00 to be refunded back to the property owner to assist with the cost
for the reference plan.

5. A 2018-118 392 Fischer Hallman Road Any proposed changes/alterations to
the access on Regional Road 58 (Fischer-Hallman Road) will require a Regional
Road Access Permit ($100 Fee). Should the Committee of Adjustment approve
the minor variance, we respectfully request that a Regional Road Access Permit
be a condition of approval.

The Grand River Conservation Authority (GRCA) has no objection to the above-noted
minor variance application. Please see our detailed comments below.
BACKGROUND:
1. Resource Issues:
Information currently available at our office indicates that a small portion of the
subject property is within the flood fringe portion of the floodplain associated with
Schneider Creek and the allowance adjacent to the floodplain.
2. Legislative/Policy Requirements and Implications:
GRCA staff have reviewed the proposed development through the site plan approval
process and we are satisfied that the proposed development meets the City of
Kitchener and GRCA Two-Zone Floodplain policies. As such, we have no objection
to the proposed minor variance application.
We have previously undertaken a review of the proposed grading on the site and
very minor grading is proposed within the allowance of the floodplain. We will not

BACKGROUND:
1. Resource Issues:
Information currently available in this office indicates that the entire property is within the
floodplain (floodway) of Schneider Creek. A copy of our resource mapping is attached.
2. Legislative/Policy Requirements and Implications:
Due to the floodplain, the entire property is regulated by the GRCA under Ontario
Regulation 150/06 Development, Interference with Wetlands and Alterations to Shorelines
and Watercourses Regulation.
The above-noted property is located within a Two Zone Floodplain Policy Area. In
designated Two Zone Areas the floodplain contains two sections - the floodway and the
flood fringe. The floodway is the area of the floodplain required to pass the flows of greatest
depth and velocity. The flood fringe lies between the floodway and the edge of the
floodplain. Depths and velocities of flooding in the flood fringe are much less than those in
the floodway, allowing for limited development to occur. No new development is permitted
within the floodway. We note that the subject property is located within the floodway portion
of the floodplain.
It is our understanding that the purpose of this application is to request relief from the
number of parking spaces required. No new development is being proposed. As such, we
have no objection to the minor variance.
Please note that any future development proposed within GRCA regulated areas will require
prior written approval from the GRCA in the form of a permit pursuant to Ontario Regulation
150/06. If future development is proposed on the property, early consultation with GRCA is
recommended to discuss the proposed development and whether it would meet GRCA
policies.

GRCA staff have reviewed the proposed development through the site plan process and
GRCA Permit #740/18 has been approved for the proposed addition. The addition conforms
to the City of Kitchener and GRCA Two-Zone Floodplain policies. As such, we have no
objection to the approval of the minor variance application.
Due to the presence of the floodplain, this property is regulated by the GRCA under Ontario
Regulation 150/06 Development, Interference with Wetlands and Alterations to Shorelines
and Watercourses Regulation.
Any future development on the property will require prior written approval from the GRCA in
the form of a permit pursuant to Ontario Regulation 150/06. The permit process involves the
submission of a permit application to our office, the review of the application by Authority
staff and the subsequent approval/refusal of the permit application by the GRCA.

We wish to acknowledge receipt of the applicable plan review fee associated with our
review of SP18/087/V/LT. As such, a plan review fee for this application is not required.

GRCA COMMENT*:
The Grand River Conservation Authority (GRCA) has no objection to the above-noted consent
application. Please see our detailed comments below.
BACKGROUND:
1. Resource Issues:
Information currently available at this office indicates that a majority of the subject property
is within the flood fringe of a Two-Zone Floodplain associated with Shoemaker Creek. A
small portion of the property is also within the regulated allowance adjacent to the floodplain.
A copy of our resource mapping is attached.
2. Legislative/Policy Requirements and Implications:
This reach of floodplain is within a Two-Zone Floodplain Policy Area. In designated Two-
Zone Areas, the floodplain contains two sections - the floodway and the flood fringe. The
floodway is the area of the floodplain required to pass the flows of greatest depth and
velocity. No development is permitted within the floodway. The flood fringe lies between
the floodway and the edge of the floodplain. Depths and velocities of flooding in the flood
fringe are much less than those in the floodway, allowing for development to occur if certain
criteria are met. The subject property falls within the flood fringe.
Based on information available at this office, the severed and retained parcels are within the
flood fringe and both parcels would have safe access during times of flooding. As such, the
GRCA has no objection to the proposed consent application. Please note that any future
GRCA permit applications for the new dwellings will require additional plans and details to
demonstrate conformance with the GRCA and City of Kitchener Two-Zone Floodplain
policies.
Due to the presence of the floodplain, the subject property is regulated by the GRCA under
Ontario Regulation 150/06 Development, Interference with Wetlands and Alterations to
Shorelines and Watercourses Regulation.
Please be advised that any future development on the subject lands will require the prior
issuance of a permit pursuant to Ontario Regulation 150/06. The permit process involves

the submission of a permit application to this office, the review of the application by Authority
staff and the subsequent approval/refusal of the permit application by the GRCA.
3. Plan Review Fees:
This application is a minor consent application and the applicable plan review fee is
$400.00. With a copy of this correspondence, the applicant will be invoiced in the amount of
$400.00.
