HomeMy WebLinkAboutCouncil Minutes - 1998-05-25 SCOUNCIL\1998-05-25-SPE MAY 25, 1998 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 11:55 a.m. this date and Chaired by Mayor C. Zehr with all members present except Councillor T. Galloway. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter, two land acquisition matters and a matter subject to solicitor-client privilege." Carried. Council then considered a recommendation arising from the Finance and Administration Committee meeting of this date concerning a refreshment stand request by the Victoria Park Neighbourhood Association. Moved by Councillor G. Lorentz Seconded by Councillor B. Vrbanovic "That the Friends of Victoria School Committee and the Victoria Park Neighbourhood Association be granted permission to operate a refreshment stand in Victoria Park on June 3, 1998, provided the necessary Special Event Licence is obtained." Carried. The meeting then recessed at 11:56 a.m. and reconvened at 1:35 p.m., Chaired by Mayor C. Zehr with the following members present: Councillors Jake Smola, John Smola, J. Ziegler, C. Weylie, J. Haalboom and G. Lorentz. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That the City purchase Lots 3, 4 & 5, being approximately 8.634 acres of land, at $75,000 per acre from the Huron Woods Development Corporation for a total purchase price of approximately $647,550 to close on June 30, 1999, conditional upon the Huron Woods Development Corporation registering the Subdivision Plan and servicing and completing Trillium Drive no later than December 31, 1998; and, That the Mayor and Clerk be authorized to sign an Agreement of Purchase satisfactory to the City Solicitor; and, That the Subdivision Agreement with the Huron Woods Development Corporation defer the pre- registration development charges for Plan of Subdivision 30T-88030, to the building permit stage in accordance with the Development Charges Act; and further, That with the exception of Lots 3, 4 & 5, if sold to the City, interest be accrued and charged on the outstanding development charges from the date of registration of the Subdivision Plan until payment is made, at prime plus 1%." Councillor Jake Smola advised that he would not support the motion, as in his opinion the price is too high given the current land value and should be $5,000 to $7,000 per acre less. Councillor J. Ziegler responded that the current price in the Huron Business Park is $75,000 per acre, and the City would like to keep the per acre price at this rate and, the municipality will incur servicing costs as a result of this agreement. There is also a need for additional industrial land in the City. Councillor Jake Smola replied that perhaps the City should not be in the land development business as private interests would not handle the situation the same way. Mayor C. Zehr offered the opinion that the proposal is an excellent deal for the City and allows for the completion of the final stage of the Trillium Drive extension and results in an immediate payback to the City in the form of increased assessment. MAY 25, 1998 SPECIAL COUNCIL M/NUTES - 322- CITY OF KITCHENER The motion by Councillor J. Ziegler, seconded by Councillor G. Lorentz, relative to a land purchase involving the Huron Woods Development Corporation was then voted on and Carried. Moved by Councillor C. Weylie Seconded by Councillor J. Haalboom "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council at its regular meeting held May 19, 1998, and special meetings held May 15 & 25, 1998 and that the same be taken as read a first, second and third times, be finally passed and numbered 98-63 by the Clerk." Carried. On motion the meeting adjourned at 1:40 p.m. MAYOR CLERK
