SPECIAL COUNCIL MINUTES
CITY OF KITCHENER
A special meeting of City Council was held at 12:05 p.m. this date and Chaired by Mayor C. Zehr with all
members present.
Notice of this special meeting had previously been given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor M. Yantzi
Seconded by Councillor K. Taylor-Harrison
"That the Mayor and Clerk be authorized to execute, from time to time, on behalf of the City of
Kitchener, the following:
(1)
Standard Bundled Transportation Agreements and Standard, Temporary Transportation
Contract Assignments - Partial, with Union Gas Ltd., and Standard Agency Agreements
with the City's agents, as required by, and to deal with, Union Gas Ltd.;
(2)
Standard Bundled Transportation Agreements with the City of Kitchener's individual
customers (and that the City require Standard Agency Agreements between its individual
customers and their agents); and,
(3)
Standard Conversion Authorization/Direction and consent agreements, with Union Gas Ltd.
and the City's individual customers, all standard agreements referred to above as attached
to the report of the City's Director of Utilities dated August 7, 1998; and further,
That minor changes may be made to the standard agreements referred to above to accommodate
specific contractual needs of the City of Kitchener or its individual customers, at the discretion of
the Director of Utilities and subject to the approval of the City Solicitor."

"That the Cedar Hills Neighbourhood Association be granted permission to operate a barbecue on
August 15, 1998, at Sand Hills Park, Kitchener, provided the necessary license, health and fire
approval are obtained, and that a reduced fee of $10.00 be applicable."

provisions of Chapter 450 (Noise) of the Municipal Code for the purpose of conducting programs

"That an in-camera meeting of City Council be held immediately following recess of this special
meeting to consider a land acquisition matter, a labour relations matter, and five matters subject to
solicitor-client privilege; and further,
That an in-camera meeting of City Council be held on Monday, August 17, 1998 at 6:15 p.m. to
consider a matter subject to solicitor-client privilege."
Councillor T. Galloway questioned the appropriateness of considering the solicitor-client privilege item
relative to duplexing in a closed meeting, as to date this has been a public process. He further noted that
he had requested that this item be listed on the Planning and Economic Development Committee agenda
for public consideration this date. Ms. L. MacDonald replied that an in-camera meeting was requested in
order to legal advice, noting that some of the options could impact other matters. She asked that Council
agree to hear the legal advice before further public discussion of the duplexing issue.
The previous motion by Councillor J. Ziegler, seconded by Councillor G. Lorentz to authorize an in-
camera meeting was voted on and Carried.
The meeting then recessed at 12:10 p.m. and reconvened at 4:55 p.m. with all members present.
A motion was put forward to deal with a recommendation arising from in-camera discussion this date of a
proposed land acquisition involving the Huron Natural Area.

"That consideration of the staff recommendation involving the purchase of 16 acres of upland
forest in the Huron Natural Area be deferred and referred to the August 17, 1998, Committee of
the Whole Agenda pending receipt of a staff report on the funding arrangements."

Seconded by Councillor Jake Smola
"That, pursuant to Section 25.4.4 (e) of Chapter 25 (Council Procedure) of the Municipal Code,
three readings of an Interim Control By-law and a related motion respecting Adult Entertainment
Theatres be added to the special Council agenda of this date."
Carried, Unanimously with all members of Council present.

Seconded by Councillor J. Ziegler
"That a review or study be undertaken by the City's Department of Business and Planning
Services in respect of land use planning policies in the City of Kitchener relating to theatres
established for the purpose of exhibiting film, as defined in the Theatres Act, R.S.O. 1990, Chapter
T.6 and the regulations thereunder, and as approved by the Ontario Film Review Board in the
category of 'Restricted Adult Sex Film'."

"That a personal matter and a second matter subject to solicitor-client privilege be added to the in-
camera agenda for the meeting of August 17, 1998, and the start time for that meeting be
changed from 6:15 p.m. to 5:30 p.m."
Carried.
Councillor G. Lorentz requested an in-camera update, if possible on September 14, 1998, from the
Solicitor representing the City in the Ralgreen lawsuit.

"That leave be given the Mover and Seconder to introduce the following by-laws and that the same
be taken as read a first, second and third times, be finally passed and numbered serially by the
Clerk:
(a) Being an Interim Control By-law respecting theatres exhibiting adult sex films
(By-law No. 98-100)
(b) To confirm all actions and proceedings of the Council
(By-law No. 98-101 )."
Carried.
On motion the meeting adjourned at 5:05 p.m.
