HomeMy WebLinkAboutCouncil Minutes - 1998-09-14 SCOUNCIL\1998-09-14-SPE SEPTEMBER 14, 1998 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:20 p.m. this date and Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That pursuant to Section 25.4.4(e) of Chapter 25 (Council Procedure) of the Municipal Code, the recommendation of the Finance and Administration Committee concerning a proposed End of Construction Parade and Celebration, be added to the special Council agenda for consideration this date." Carried unanimously by all members of Council. Moved by Councillor J. Ziegler Seconded by Councillor B. Vrbanovic "That subject to meeting all licensing requirements and obtaining the owner's permission, Robert Fries, the Chip Stop, be granted permission to relocate his chip wagon from the present 4308 King Street East location to the Moose Lodge at 655 Wabanaki Drive, and in this regard a temporary one year licence be granted and enforcement of the Zoning By-law waived for the one year period; and further, That the applicant is advised that should he receive permission to continue operation at the new location beyond the one year term, the owner of the subject lands will be required to submit an application to have said lands appropriately zoned, said application to be submitted at least two months prior to expiry of the one year term." Moved by Councillor G. Lorentz Seconded by Councillor C. Weylie "That the City of Kitchener has no objection to a Provincial lottery licence being issued to the K-W Oktoberfest for a Social Gaming Event Licence to permit gaming tables during Oktoberfest, October 9-17, 1998 at Bingeman Park, 1380 Victoria Street N, Kitchener." Carried. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Ziegler "That the I Dig Downtown Kitchener Committee be granted permission to locate food vendors on King Street between Frederick and Cedar, and to erect a beer tent to celebrate the end of Downtown construction on September 26, 1998, provided the necessary licence, including health and fire approvals, and building permit are obtained; and further, That the licence fee of $25 be applicable." Carried. Moved by Councillor G. Lorentz Seconded by Councillor K. Taylor-Harrison "That an in-camera meeting of City Council be held immediately following recess of this special meeting to consider a litigation matter and three matters subject to solicitor-client privilege." Carried. The meeting then recessed at 12:25 p.m. and reconvened at 3:35 p.m. with all members present. SEPTEMBER 14, 1998 SPECIAL COUNCIL MINUTES - 437 - CITY OF KITCHENER Moved by Councillor B. Vrbanovic Seconded by Councillor T. Galloway "That pursuant to Section 25.4.4(e) of Chapter 25 (Council Procedure) of the Municipal Code, a by-law to prohibit theatres from exhibiting adult sex films on selected lands in the municipality be added to the agenda for three readings this date." Carried unanimously by all members of Council. Moved by Councillor J. Ziegler Seconded by Councillor M. Yantzi "That the Mayor and Clerk be authorized to sign Minutes of Settlement in respect to all outstanding Ontario Municipal Board and Assessment Review Board appeals for 149 Strange Street, and upon execution, the City of Kitchener withdraw its appeal to the Ontario Municipal Board in respect of the Assessment Review Board decisions for 149 Strange Street." Carried. Mr. J. Shivas, City Solicitor, circulated a draft of the by-law to prohibit theatres from exhibiting adult sex films, and Council reviewed the boundaries outlined in the by-law. Moved by Councillor M. Yantzi Seconded by Councillor K. Taylor-Harrison "That the draft by-law to prohibit the location of theatres showing adult sex films on lands abutting certain highways be amended to reflect that the area to which the by-law applies is to also include the properties on both sides of those streets which form the boundaries of that area." Carried. Moved by Councillor M. Yantzi Seconded by Councillor K. Taylor-Harrison "That leave be given the Mover and Seconder to introduce the following by-laws for three readings this date: (a) Being a by-law to amend By-law No. 88-170 being a by-law to prohibit unauthorized parking of motor vehicles on private property (By-law No. 98-128) (b) Being a by-law to amend By-law No. 88-171 being a by-law to designate private roadways as fire routes and to prohibit parking thereon (By-law No. 98-129 (c) Being a by-law to amend By-law No. 88-172 being a by-law to authorize certain on-street and off- street parking of vehicles for use by physically handicapped persons, and the issuing of permits in respect thereof (By-law No. 98-130 ) (d) To confirm all actions and proceedings of the Council (By-law No. 98-131 ) SEPTEMBER 14, 1998 SPECIAL COUNCIL MINUTES - 438 - CITY OF KITCHENER (e) Being a by-law for prohibiting the location of abutting certain highways theatres showing adult sex films on lands (By-law No. 98-132) and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk.
