HomeMy WebLinkAboutCouncil Minutes - 1998-11-16 SCOU N CI L\1998-11-16-SPE SPECIAL COUNCIL MINUTES NOVEMBER 16, 1998 CITY OF KITCHENER A special meeting of City Council was held at 3:40 p.m. this date and chaired by Mayor C. Zehr with the following members present: Councillors K. Taylor-Harrison, M. Yantzi, John Smola, Jake Smola, B. Vrbanovic, J. Haalboom, J. Ziegler, G. Lorentz and C. Weylie. Councillor T. Galloway was in attendance for part of the meeting. Notice of this special meeting had previously been given to all members of Council by the Deputy City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. The purpose of the meeting was to consider 1999 appointments to the Standing and Special Committees of City Council, Boards and Commissions. Attached hereto and forming part of these minutes are the appointments as approved for 1999, and with the exception of those specifically noted in the minutes, all positions were filled by acclamation. Councillor B. Vrbanovic disclosed a pecuniary interest and abstained from all voting and discussion concerning appointments to the Job Evaluation Consultant Selection/Steering Committee as his wife is employed in the City's Information Services Division. Mayor Carl Zehr advised that the Social Planning Council has requested that Council appoint a representative to its Board of Directors, an appointment which had recently been discontinued. He also advised that he would like to see a Council representative appointed to the Mayor's Advisory Council on Youth. Councillor C. Weylie brought forward clause #1 of the Planning and Economic Development Committee report of this date to Council as it relates directly to appointments involving the Business and Industry Advisory and the Adaptive Re-Use Committees. Moved by Councillor C. Weylie Seconded by Councillor J. Ziegler "That Council defer any appointments to both the 1999 Business and Industry Advisory Committee (BIAC) and Adaptive Re-use Committee (ARC) pending consideration of one new Business Advisory Committee with a new Terms of Reference and membership which merges components of both committee mandates with a report on this matter to be submitted to the Planning and Economic Development Committee for its December 7, 1998 meeting; and further, That all individuals who submitted applications for appointment in 1999 to these Committees be advised of this deferral." Carried. Moved by Councillor C. Weylie Seconded by Councillor K. Taylor-Harrison "That the 1998 appointments to the Kitchener Downtown Advisory Committee be extended, subject to finalization of revised terms of reference early in 1999." Carried. Councillor T. Galloway entered the meeting at this time. Councillor B. Vrbanovic advised that he had spoken with Ms. Isabella Stefanescu who had indicated she submitted applications for the Arts & Culture Advisory Committee and the Public Art Committee, neither of which were received by the Deputy City Clerk. Mr. L.F. Parkhouse advised that the normal practice is for the Public Arts Committee to determine which of its members will sit on the Arts & Culture Advisory Committee. Mr. L.F. Parkhouse advised that, in regard to the appointment of a Veterinarian to the Dog Designation Appeal Committee and to the best of his knowledge, Ms. Joyce Palubiski is not eligible, as she is not a Veterinarian. NOVEMBER 16, 1998 SPECIAL COUNCIL MINUTES -516- CITY OF KITCHENER Concerning applications submitted for membership on Heritage Kitchener, Mr. L.F. Parkhouse reminded Council that from the documentation available, he was unable to confirm that Bruce Krafchek, Al Majauskas and Brian Scott meet the eligibility requirements. It was noted that Mr. Scott is also a part-time City employee, and Councillor J. Haalboom enquired as to the appropriateness of staff participation on Advisory Committees which meet during business hours. Councillor G. Lorentz advised he would only have concerns where full-time employees are involved. Mr. J. Gazzola advised that Human Resources staff are reviewing the entire issue of employee involvement on Council committees, but at this time, the City has no policy in this regard. Councillor B. Vrbanovic indicated his concern that in many cases staff are also taxpayers, and should not be prohibited from participating on these Committees, adding that it is presumed the employee will make up for the time spent at meetings. Councillor T. Galloway indicated that though he generally agrees with the comments of Councillor Vrbanovic, situations do arise where staff involvement at the Committee level is unwise, particularly if they are directly involved as staff in areas under consideration and where their vote could influence the outcome. It was generally agreed that Brian Scott and Al Majauskas would be appointed to Heritage Kitchener, subject to clarification that they meet the eligibility requirements. Councillor M. Yantzi asked that in the event Mr. Scott is unable to serve on Heritage Kitchener, that he be considered as a Heritage Conservation District representative. Councillor B. Vrbanovic asked that future consideration be given to placing a half page newspaper ad for appointments outlining each of the Committees and their mandates. He suggested that such an advertisement could be placed in the Summer of each year in order to give potential applicants sufficient time to consider whether to make an application or to investigate further. Moved by Councillor M. Yantzi Seconded by Councillor K. Taylor-Harrison "That Councillor Jake Smola be appointed to the Parks & Recreation Advisory Committee as an additional Council representative." Carried. Appointments to the Parks & Recreation Advisory Committee were considered with the following individuals nominated: Anthony Bender Sandra Dale Kerry Kirby Lori Koebel David McKay Terry Mercury Rick Weinstein The approved voting procedure was then utilized which resulted in Anthony Bender, Lori Koebel and Rick Weinstein being appointed to the Parks & Recreation Advisory Committee. Councillor J. Haalboom expressed concern that Keith Masterman and Glenn Ward did not submit applications for reappointment to the Public Art Committee, but have been active members in the past. Mr. L.F. Parkhouse advised that if they had forgotten to file applications, additional members can be added by Council at a later date. It was agreed that the Chair of the Public Art Committee contact the two individuals and advise of the appointments made this date and the possibility of future, additional appointments. A discussion took place concerning the mandate of the Twin Cities Committee. Councillor B. Vrbanovic suggested extending the current appointments for a further two to three months, during which time the two Chief Administrative Officers would evaluate and make recommendations on the future of the Committee. Councillor Vrbanovic noted that many of the past items for discussion had been generated at the staff rather than the Council level. Mayor C. Zehr referred to a meeting scheduled for December 3, 1998 to pursue further issues of co-operation involving Kitchener and Waterloo. Galloway suggested appointing the current Committee for a further year, during which time it will be charged with reviewing and making recommendations on its mandate. He advised that he is not optimistic as to the effectiveness of the Committee, but stressed that any decision regarding its future should be made jointly with the City of Waterloo. Moved by Councillor B. Vrbanovic Seconded by Councillor Jake Smola "That the existing members of the Twin Cities Committee be reappointed for the year 1999, with the two Chief Administrative Officers and the Council representatives from each of the respective municipalities evaluating and making recommendations concerning the future of the Committee." A further motion by Councillor B. Vrbanovic to amend the original motion so as to extend the current appointments only to February of 1999 was not considered due to the lack of a seconder. The original motion by Councillor B. Vrbanovic, seconded by Councillor Jake Smola, was then voted on and Carried. Appointments to the Centre In The Square Inc. - Board of Directors were considered with the following individuals nominated: Ted Bleaney William Poole Karin Voisin Patricia Wagner The approved voting procedure was then utilized which resulted in Ted Bleaney, Karin Voisin and William Poole being appointed as Kitchener's representatives on the Centre In The Square Inc. - Board of Directors. It was noted that the Continuous Improvement Steering Committee has not met during the past year, and Mayor C. Zehr suggested that there should be an evaluation of the need for this Committee. It was generally agreed that Mr. J. Gazzola would undertake an evaluation in this regard, and that no appointments would be made at this time. Councillor Jake Smola enquired as to the current status of the Kitchener Awards Positive Suggestions (KAPS) Program, and Mr. J. Gazzola advised that the part-time staff person responsible was eliminated from the complement in order to save money and that at present there is no administration for the Program. He noted that Ms. P. Houston is currently evaluating the situation. Concerning appointments to the Kitchener Housing Inc. - Board of Directors, Mr. L.F. Parkhouse advised that the organization is currently in the process of restructuring and a recommendation will be submitted to Council at a later date. It was agreed to discontinue a Council appointment to the Philharmonic Choir of Kitchener-Waterloo, and Mr. L.F. Parkhouse was asked to correspond with the organization in this regard. Council considered appointments to the Project Lift Inc. - Board of Directors, and in regard to Mr. Ken A. Koebel, were reminded of the Council policy which indicates that no lay appointee is to serve more than a maximum of six consecutive years on any special Committee, Board or Commission. "That notwithstanding the provisions of clause (a) of Council Policy No. 1-60 (Appointment of Lay Members - Length of Service), we hereby confirm the appointment of Ken A. Koebel to the Board of Directors of Project Lift Inc." Carried Unanimously. It was generally agreed that in future, Mr. J. Gazzola, Chief Administrative Officer, would be responsible for making all staff appointments to the GIS Committee - Regional Multi Participant and the School Open Space Technical Advisory Committee. Mr. Gazzola was also asked to follow up on NOVEMBER 16, 1998 SPECIAL COUNCIL MINUTES -518- CITY OF KITCHENER questions raised by Councillor Jake Smola as to the mandate of the latter, especially as it relates to the sale of vacant school sites. Mayor C. Zehr referred to correspondence he had received from the Social Planning Council asking that Kitchener resume appointments to the Social Planning Council's Board of Directors, and Councillor Jake Smola agreed to represent Council. Moved by Councillor J. Ziegler Seconded by Councillor M. Yantzi "That Councillor Jake Smola be appointed as the Council representative on the Board of Directors for the Social Planning Council in 1999." Carried. Moved by Councillor B. Vrbanovic Seconded by Councillor M. Yantzi "That Councillor Jake Smola be appointed as the Council representative on the Citizen Advisory Committee - Safety-Kleen Inc." Carried.
