HomeMy WebLinkAboutCouncil Minutes - 1998-12-18 SCOU NCIL\1998-12-18-SPE SPECIAL COUNCIL MINUTES DECEMBER 18, 1998 CITY OF KITCHENER A special meeting of City Council was held at 12:00 noon this date and Chaired by Mayor C. Zehr with all members present except Councillor T. Galloway. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered a recommendation arising from the Finance and Administration Committee meeting of December 16, 1998 relative to the 1999 Project Lift fare. Moved by Councillor John Smola Seconded by Councillor J. Ziegler "That pre-budget approval be granted for a 1999 Project Lift fare of $2 per ride, a decrease from the 1998 fare of $2.35, with the new fare to take effect on January 1, 1999." Carried. Mayor C. Zehr spoke to a matter concerning designation of Trussler Road as a regional road and the impact this would have on its status as a scenic road. Ms. C. Ladd advised that if Trussler Road reverts to regional road status this could have a major impact on the City's wish to preserve it as a heritage road. She suggested that the options are to appeal the Region of Waterloo's Official Plan Amendment, or alternatively, for staff to discuss with the Region the possibility of recognizing, under the Regional Plan, the value of the road as a scenic resource. Council agreed to the latter option involving discussion with Regional staff and Ms. Ladd advised that this will take place early in January of 1999, with a subsequent report to the Planning and Economic Development later that month. Councillor J. Haalboom asked for verification that the road will be protected as a scenic road and Ms. C. Ladd answered that it would. Council then considered a property standards matter involving the American Hotel block. Council, at its meeting of December 14, 1998 gave first and second readings to four by-laws authorizing the municipality to carry out various work at the owner's expense. Mr. W. Pearce gave an overview of the proposed work and the drainage, electrical and structural problems which will be addressed and circulated Business and Planning Services Department report No. 98/149 in this regard. He commented that through a number of minor repairs have been completed, the co-operation of all of the owners toward a proper, long-term solution has not occurred and as a result the building continues to deteriorate. Mr. Pearce advised that the City hopes to tender the project in the Spring of 1999. Mayor C. Zehr drew Council's attention to correspondence from Mr. D.P. Cassino, Belanger, Cassino, Coulston and Gallagher - Barristers & Solicitors, London, dated December 17, 1998 which was previously circulated to members of Council. Mr. Cassino represents 902807 Ontario Limited, the owners of 8-10 King Street East. His correspondence refers to drainage problems which involve the roof areas of three other owners, none of whom have responded to attempts to co-ordinate these repairs. Councillor Jake Smola enquired whether further structural repairs would be needed in addition to those being proposed, and Mr. W. Pearce replied that it is likely no major work will be required for the next 15 to 20 years. Councillor J. Haalboom enquired why the entire roof is in need of repair, suggesting that some spot repairs have already been completed. Mr. Pearce responded that the owner of a portion of the property known municipally as 1 Queen Street North, replaced roofing on two sections in 1992 and the contract reflects that the old roof was to have been removed. Investigation of portions of the roof show that this was not done and the new roofing was simply laid over the older material. Moved by Councillor M. Yantzi Seconded by Councillor B. Vrbanovic "That the by-laws listed on the agenda for third reading, namely: (a) Being a by-law to authorize the carrying out of the provisions of Chapter 665 of the City of DECEMBER 18, 1998 SPECIAL COUNCIL MINUTES - 600 - CITY OF KITCHENER Kitchener Municipal Code with respect to the property municipally known as 1 Queen Street N, Kitchener (By-law No. 98-210) (b) Being a by-law to authorize the carrying out of the provisions of Chapter 665 of the City of Kitchener Municipal Code with respect to the property municipally known as 4 King Street E, Kitchener (By-law No. 98-211 ) (c) Being a by-law to authorize the carrying out of the provisions of Chapter 665 of the City of Kitchener Municipal Code with respect to the property municipally known as 8-10 King Street E, Kitchener (By-law No. 98-212) (d) Being a by-law to authorize the carrying out of the provisions of Chapter 665 of the City of Kitchener Municipal Code with respect to the property municipally known as 1 6 King Street E, Kitchener (By-law No. 98-213) be taken as read a third time, be finally passed and numbered serially by the Clerk." Carried. Moved by Councillor B. Vrbanovic Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 98-214 by the Clerk." Carried. Councillor Jake Smola advised that the project team dealing with the Regional Airport expansion will meet early in the new year, but a meeting date has not been specified. He further noted that a request has been received for the striking of a Citizens Advisory Committee to provide input on various airport issues.
