JANUARY 7, 2019
CITY OF KITCHENER
A special meeting of City Council was held at 4:30 p.m. this date, chaired by Mayor B. Vrbanovic with
all members present.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.

Council considered Councillor B. loannidis' Notice of Motion regarding permitting parking on the
boulevard as part of a one-year pilot project in Wards 1 to 4 and Wards 6 to 10.
Ms. G. MacNeil, Director of By-law Enforcement, provided a brief overview of boulevard parking
in Ward 5 since it was implemented in December, 2014, noting By-law Enforcement has received
no complaints to date. She further noted the Region of Waterloo has not expressed any concern
with boulevard parking on Regional roads, stating the City of Kitchener is the enforcement
agency for Regional roads in the City.

"WHEREAS on December 15, 2014 Council approved Clause 1 of Report CSD -14-108 that parking
on the boulevard (paved area of a driveway between the sidewalk and the curb/road edge) be
permitted in Ward 5 for December 1st to March 31st annually subject to the conditions outlined in
Report CSD -14-108; and,
WHEREAS on December 15, 2014 Council did not approve Clause 2 of Report CSD -14-108 that
parking on the boulevard (paved area of a driveway between the sidewalk and the curb/road edge)
be permitted from December 1st to March 31st as part of a one year pilot project in Wards 1-4 and
Wards 6-10; and,
WHEREAS on June 26, 2017 Council further approved a two-year pilot program to permit year-
round boulevard parking for the Wildflower Subdivision; and,
WHEREAS a number of residents continue to bring forward requests to permit boulevard parking
in Ward 7;
THEREFORE BE IT RESOLVED that parking on the boulevard (paved area of a driveway between
the sidewalk and the curb/road edge), be permitted from December 1st to March 31st as part of a
one year pilot project in Wards 1-4 and Wards 6-10 as outlined in Report CSD -14-108'."
Carried.
IN -CAMERA MEETING AUTHORIZATION
Mayor B. Vrbanovic advised of an additional item for in -camera discussion this date regarding
realty tax write offs passed prior to January 1, 2003, which is subject to solicitor -client privilege.
He advised a motion to waive notice was required to be approved by 2/3 of the whole of Council.
Moved by Councillor B. loannidis
Seconded by Councillor M. Johnston
"That in accordance with Section 25.7.14 of City of Kitchener Municipal Code Chapter 25
(Procedure) the notice requirements be waived to add a matter subject to solicitor -client privilege
being considered at the in -camera meeting being held this date."
Carried with the required 2/3 of the whole of Council.

"That an in -camera meeting of City Council be held immediately following this special meeting to
consider a labour relations matter and a matter subject to solicitor -client privilege."
Carried.
The meeting then recessed at 4:42 p.m. and reconvened at 5:23 p.m. chaired by Mayor B. Vrbanovic
with all members present.
4. LABOUR RELATIONS
Moved by Councillor B. loannidis
Seconded by Councillor C. Michaud
"That Council approve the terms and conditions contained in the Memorandum of Settlement
dated December 18, 2018 to establish the 2019-2021 Collective Agreement with CUPE 68
(Civic) and CUPE 68 (Mechanics); and,
That the Mayor and Clerk be authorized to execute documentation arising there from."
Carried Unanimously.
SOLICITOR -CLIENT PRIVILEGE

Seconded by Councillor J. Gazzola
"WHEREAS City Council passed the following resolution on May 11, 1998 under the authority
set out in section 441 of the Municipal Act, R.S.O. 1990, c. M.45 ("the Resolution"):
That upon confirmation from the Ministry of Environment (MOE) that all contamination,
both on-site at 152 Shanley Street and off site, has been cleaned up to their satisfaction,
the City of Kitchener, will write-off all outstanding realty taxes attributable to 152 Shanley
Street up to the date of the clearance documentation from the MOE provided that where
the registered owner is a corporation, the corporation is a valid corporation in good
standing with the Ministry of Consumer and Commercial Relations; and,
WHEREAS the work required to be completed in the above Resolution in order to secure the
write off was never completed prior to January 1, 2003; and,
WHEREAS in addition to the Resolution, the City also passed several other resolutions under
the authority of the Municipal Act, R.S.O. 1990, c. M.45 for various properties authorizing the
write off of realty taxes in exchange for certain works to be done on the property for which the
work was never completed prior to January 1, 2003, collectively referred to as the "realty tax
write offs"; and,
WHEREAS the Municipal Act, R.S.O. 1990, c. M.45 was repealed and replaced by the Municipal
Act, S.O. 2001, c.25, which came into force January 1, 2003, which rescinded the authority under
which the Resolution was passed and any realty tax write offs were permitted;
THEREFORE BE IT RESOLVED that any Council resolution, including the Resolution above,
pertaining to realty tax write offs passed prior to January 1, 2003 be rescinded."

"That leave be given the Mover and Seconder to introduce the following by-laws for three readings
and that the same be taken as read a first, second and third times, be finally passed and numbered
serially by the Clerk.
a. Being a by-law to provide for a 2019 Interim Tax Levy and for the payment of 2019 Interim
Taxes.
(By-law No. 2019-002)
b. Being a by-law to authorize the borrowing for current expenditures in 2019.
(By-law No. 2019-003)
c. To confirm all actions and proceedings of the Council.
