HomeMy WebLinkAboutPublic Works - 2000-08-21PWTC\2000-08-21 PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES AUGUST 21, 2000 CITY OF KITCHENER The Public Works and Transportation Committee met this date, Chaired by Councillor John Smola, commencing at 8:35 a.m., with the following members present: Councillors C. Weylie, G. Lorentz, Jake Smola and B. Vrbanovic. Councillor K. Taylor-Harrison was in attendance for part of the meeting. Officials Present: Ms. P. Houston, Ms. C. Ladd, Ms. J. Billett and Messrs. J. Gazzola, E. Kovacs, S. Gyorffy, G. Melanson, K. Carmichael, K. Mayer, R. Schirm and J. Witmer. LEG-00-039 - EXEMPTION TO CHAPTER 660 (PLUMBING AND DRAINAGE) OF THE MUNICIPAL CODE - GLASGOW STREET The Committee was in receipt of the above Legal staff report from Ms. A. Menon, dated August 16, 2000, requesting an exemption from the mandatory connection requirements of Chapter 660 of the Municipal Code with respect to residences on Glasgow Street. Councillor C. Weylie advised that she wished to have this matter deferred to allow for an opportunity for staff to meet with the residents of Glasgow Street, on Tuesday, August 22®, at 7:00 p.m. in her home. Following this meeting, she suggested that the matter could be referred back to Council on Monday, August 28, 2000. The Committee concurred with Councillor Weylie's request. On motion by Councillor C. Weylie - it was resolved: "That the following recommendation contained in staff report LEG-00-039 be deferred and referred to the Auqust 28, 2000 Council meeting for consideration: 'That the owners of residences on Glasgow Street receive an exemption from the mandatory connection requirements of the City of Kitchener's Municipal Code, Chapter 660 (Plumbing and Drainage), provided that sewer surcharge shall be applied to the properties beginning on the first day of January, 2001, and provided that each owner enter into an agreement satisfactory to the City Solicitor to inform the City once the connection to their property is completed.'" In addition, the following staff were directed to attend a meeting to discuss the requested exemption from Chapter 660 of the Municipal Code with Councillor C. Weylie and residents of Glasgow Street on Tuesday, August 22, 2000, commencing at 7:00 p.m. in the residence of Councillor C. Weylie, namely: Messrs. J. Gazzola, E. Kovacs, S. Gyorffy, J. Witmer and Ms. A. Menon. 2. PW-00-028 - ON-STREET PARKING - HEARTH CRESCENT The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 15, 2000, requesting that the existing 3 hour on-street parking limit on Hearth Crescent remain in effect. Councillor K. Taylor-Harrison entered the meeting at this time. Councillor Jake Smola requested an update on the progress of the fence installation in the area of Hearth Crescent and Mr. Gyorffy advised that the wood portion of the fence has been completely constructed; however, the wrought iron portion of the fencing is yet to be installed. Councillor Jake Smola advised that he had been contacted by a property owner who is questioning why the fence ends where it does rather than continuing along the remaining homes. Mr. S. Gyorffy advised that the reason the fence ends where it does is because there is already a 4 foot chin link fence in place along the rear of the remaining properties. PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES AUGUST 21, 2000 - 55 - CITY OF KITCHENER 2. PW-00-028 - ON-STREET PARKING - HEARTH CRESCENT (CONT'D) On motion by Councillor G. Lorentz - it was resolved: "That the current three (3) hour on-street parking limit on Hearth Crescent remain in effect." 3. PW-00-030 - ON-STREET PARKING - AUTUMN RIDGE TRAIL The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated July 24, 2000, requesting a parking prohibition on the south side of Autumn Ridge Trail. On motion by Councillor C. Weylie - it was resolved: "That parking be prohibited on the south side of Autumn Ridge Trail from Windrush Trail to a point 142 metres east of Windrush Trail, from 10:00 a.m. to 8:00 p.m., from September 2000 to January 31,2001; and further, That the Uniform Traffic By-law be amended accordingly." 4. PW-00-031 - LOWER DOON TRAFFIC REVIEW The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 15, 2000, requesting permission to engage the services of a private consulting firm to conduct a review of traffic in Lower Doon. On motion by Councillor B. Vrbanovic- it was resolved: "That Council engage the services of a private consulting firm to conduct a review of traffic in Lower Doon and develop recommendations to address access through traffic and speeding issues; and further, That Council approve an unbudgeted expenditure of $30,000. to conduct the traffic review." 5. PW-00-032 - ROTARY CENTRE PARKING LOT DEVELOPMENT The Committee was in receipt of the above Public Works staff report from Mr. J. McBride, dated August 15, 2000, requesting that agreements be entered into with the Waterloo Region District School Board and Grand River Hospital with respect to the operation of public parking facilities on King Street West, together with proposed hourly rates and monthly rates. Councillor C. Weylie pointed out that Councillor T. Galloway had expressed concerns with respect to this recommendation and requested the matter be deferred to the Council meeting to be held on Monday, August 28, 2000. On motion by Councillor C. Weylie - it was resolved: "That the following recommendation contained in staff report PW-00-032 be deferred and referred to the Auqust 28, 2000 Council meeting for consideration: 'That Council enter into an agreement with the Waterloo Region District School Board to operate public parking at 828 King Street West; and, That Council enter into an agreement with the Grand River Hospital to operate public parking at 850 King Street West; and, PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES AUGUST 21, 2000 - 56 - CITY OF KITCHENER PW-00-032 - ROTARY CENTRE PARKING LOT DEVELOPMENT (CONT'D) That the hourly rate for these locations be established at $2.00 per hour with a $5.00 daily maximum, 24 hours per day, 7 days per week, and a monthly rate of $50.00 per month and that By-law 88-169 be amended accordingly; and further, That the Mayor and Clerk be authorized to execute a Management Agreement satisfactory to the City Solicitor with both the Waterloo Region District School Board and the Grand River Hospital.'" PW-00-035 - PUBLIC WALKWAY CLOSURE - FISCHER-HALLMAN ROAD TO LARKSPUR CRESCENT The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 15, 2000, requesting that the public walkway linking Fischer-Hallman Road to Larkspur Crescent be permanently closed and the redundant land be apportioned equally to the existing 4 abutting property owners at no charge. Mr. K. Carmichael advised that staff had received Council approval in July 2000 to permanently close the public walkway based on the surplus land being sold to the abutting property owners. Mr. Carmichael advised that having spoken with the abutting property owners they have expressed little if no interest in purchasing these lands. He stated that after meeting with the CAO and staff of the Legal Department it was determined that the best course of action to address the constant problems that have been experienced within this walkway for a number of years would be to close the walkway and equally divide the land between the 4 property owners at no charge. Councillor G. Lorentz advised that he was in agreement with the staff recommendation, noting that this was an inherent problem created in error by the City's placement of the walkway where it is believed none should have been installed. Councillor Jake Smola inquired if the City has previously given land to property owners under such circumstances, noting his concern relative to precedent setting. Staff responded that under normal circumstances it is usually at the request of the property owner that walkways be closed with the surplus lands to be purchased and added to their properties. In this instance, it is the City who is trying to rectify an ongoing problematic situation by closing the walkway and is the one approaching property owners to buy the surplus lands. On this basis, it was felt that an exception could be made. On motion by Councillor G. Lorentz - it was resolved: "That the public walkway linking Fischer-Hallman Road to Larkspur Crescent, directly opposite Forest Heights Collegiate Institute, be permanently closed; and, That the redundant public walkway land be apportioned equally to the existing four (4) abutting property owners at no charge to the owners; and further, That funds in the amount of $18,135. be approved in order to cover the costs for the permanent closure of the public walkway, along with the required reference plans, surveys, advertising, etc., required for the legal closure of the public walkway." PW-00-036 - CONESTOGA EXPRESSWAY NOISE BARRIERS The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 14, 2000, requesting that construction of noise barriers on the Conestoga Expressway not be funded by the City and that the Province be requested to review their retrofit program to provide funding for construction of barriers on a priority basis. PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES AUGUST 21, 2000 - 57 - CITY OF KITCHENER PW-00-036 - CONESTOGA EXPRESSWAY NOISE BARRIERS (CONT'D) Councillor G. Lorentz requested clarification with respect to noise barriers in the area of Fischer- Hallman Road and Mr. S. Gyorffy advised that the Ministry has indicated that further details are required with respect to issues such as approval dates, berming and dates of construction and will be looking further into this matter. On motion by Councillor B. Vrbanovic - it was resolved: "That Council not fund the construction of noise barriers on the Conestoga Expressway; and, That the Province of Ontario be requested to review their retrofit program and provide funding for the construction of barriers on a priority basis, based on current policy and the greatest need as determined by Ministry of Transportation studies." PW-00-040- CONSOLIDATION OF UNIFORM TRAFFIC AND PARKING BY-LAW The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 15, 2000, in which it is requested that Council adopt a consolidated Traffic and Parking By-Law dated August 2, 2000 to replace existing By-Law No. 94-101. On motion by Councillor K. Taylor-Harrison - it was resolved: "That Council adopt the Consolidated Traffic and Parking By-Law dated August 2, 2000 replacing City of Kitchener Traffic and Parking By-Law 94-101; and further, That the Consolidated Traffic and Parking By-Law have an implementation date of November 1, 2000." PW-00-041 - SCHOOL PEDESTRIAN SAFETY - MODIFICATIONS FOR THE 2000-2001 SCHOOL YEAR The Committee was in receipt of the above Public Works staff report from Mr. J. McBride dated August 8, 2000, requesting establishment of an Adult Crossing Guard facility at the intersection of Erinbrook Drive and Rittenhouse Road and relocation of facilities currently located at Erinbrook Drive and the Community Trail and Marlborough Avenue at North Avenue. In addition, minor changes in duty times were requested for various Adult Crossing Guard locations. On motion by Councillor B. Vrbanovic- it was resolved: "That an Adult Crossing Guard facility be established at the intersection of Erinbrook Drive and Rittenhouse Road (northern most intersection), and that the Operating Budget be adjusted to reflect an over-expenditure of $2,800.; and, That the Adult Crossing Guard facility presently located on Erinbrook Drive at the Community Trail be relocated to the intersection of The Country Way and Erinbrook Drive; and, That the Adult Crossing Guard facility at Marlborough Avenue at North Avenue be discontinued effective immediately and relocated to Highland Road West at Eagen Drive, and that the Operating Budget be adjusted to reflect an over-expenditure of $1,200.; and, That minor changes in Duty Times be implemented for the following Adult Crossing Guard locations: PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES AUGUST 21, 2000 - 58 - CITY OF KITCHENER 9. PW-00-041 - SCHOOL PEDESTRIAN SAFETY - MODIFICATIONS FOR THE 2000-2001 SCHOOL YEAR (CONT'D) 10. 11. · Forestwood Drive at McGarry Drive · McGarry Drive at Westheights Drive · Driftwood Drive at Westheights Drive · Homer Watson Boulevard at Pioneer Drive; and further, That School Route Maps be distributed to all elementary school aged children." INFORMATION ITEM The Committee was in receipt of information staff report PW-00-039 dated August 15, 2000 from Mr. J. McBride, entitled "City Hall Parking Garage Murals".
