JANUARY 14, 2019
CITY OF KITCHENER
A special meeting of City Council was held at 1:00 p.m. this date, chaired by Mayor B. Vrbanovic with
all members present.
Notice of this meeting had been previously given to all members of Council by the City Clerk pursuant
to Chapter 25 (Council Procedure) of the Municipal Code.

"That an in -camera meeting of City Council be held immediately following this special meeting to
consider a labour relations matter and a matter subject to solicitor -client privilege."

DSD -19-026 - Bill 66 RESTORING ONTARIO'S COMPETITIVENESS ACT, 2018
Mr. Sam Nabi, Hold the Line, was in attendance to speak in opposition to the Open -for -Business
provisions of Section 10 of Bill 66 Restoring Ontario's Competitiveness Act, 2018, regarding the
Open -for -Business provisions.
A recorded vote was requested.
Moved by Councillor K. Gal loway-Sealock
Seconded by Councillor P. Singh
"That Report DSD -19-026, be submitted as City of Kitchener Staff comments to the Ministry of
Municipal Affairs and Housing to Bill 66, Restoring Ontario's Competitiveness Act, 2018; and
further,
That a copy of Report DSD -19-026 be sent to the Association of Municipalities of Ontario, the
Premier, the Ministry of Municipal Affairs, and Waterloo Region Members of Provincial
Parliament."
Carried Unanimously on a Recorded Vote.
Council considered Mayor B. Vrbanovic's Notice of Motion expressing the City's concern to the
provincial government with respect to the planned changes in the proposed Bill 66.
An amendment was brought forward by Councillor S. Marsh, seconded by Councillor D.
Chapman to amend the motion add the following clause:
"Be it further resolved that if Bill 66 is adopted as written, the City of Kitchener will not
pass "open -for -business" planning by-laws if they compromise the principles of protecting
the Countryside line and/or meaningful public consultation."
Councillor S. Davey introduced a motion of defer the amendment, seconded by Councillor P.
Singh to the time when the Ontario Legislature enacts Bill 66 and the legislation receives royal
assent.
A recorded vote was requested.
In Favour: Mayor B. Vrbanovic and Councillors P.
Singh, B. loannidis, S. Davey, D. Schnider, and K.
Gal loway-Sealock.
Contra: Councillors J. Gazzola, D. Chapman, S.
Marsh, and C. Michaud.

"BE IT RESOLVED THAT Kitchener City Council express concern to the provincial government
with respect to planned changes in the proposed Bill 66, in its present form, that may allow for
an "open for business" planning bylaw; and,
BE IT FURTHER RESOLVED THAT the Government of Ontario be requested to reconsider the
proposed changes to the Planning Act included in Bill 66, in its present form, which speak to the
creation of the open -for -business bylaw; and,
BE IT FURTHER RESOLVED THAT as input into that re -consideration, the City of Kitchener
reaffirms its support for the principles of the Countryside Line and the Protected Countryside
designation to appropriately manage growth through comprehensive planning review, analysis
and community consultation; and,
BE IT FURTHER RESOLVED, that the City of Kitchener reaffirms its support for meaningful
public consultation on all land use planning — decision making matters, and , the continuing
support to appropriately manage growth that achieves the protection of source water, farmland,
and sensitive natural areas; and,
FINALLY, BE IT RESOLVED that a copy of this motion be sent to the Association of
Municipalities of Ontario, the Premier, the Minister of Municipal Affairs, and all MPP's in Waterloo
Region."

The meeting then recessed at 2:45 p.m. and reconvened at 4:30 p.m. chaired by Mayor B. Vrbanovic
with all members present.
3. DSD -19-006 — RETAIL CANNABIS STORES IN KITCHENER
The Committee considered Development Services Department report DSD -19-006, dated January 11,
2019, regarding retail cannabis stores in the City of Kitchener. Mr. J. Readman presented the report
and responded to questions from the Committee.
Chief B. Larkin addressed Council in support of the legalization of recreational cannabis and staff's
recommendation outlined in report DSD -19-006. He advised the legalization of recreational cannabis
will combat organized crime and ensures young people are protected from illicit drug use. He noted the
safe supply of cannabis is one of the key reasons why the Associations of Police are supportive of the
federal regulation, stating retail cannabis is subject to strong quality control measures and oversight by
the AGCO, police service, and municipal By-law Enforcement. He further advised the retail
consumption of cannabis will allow police services to dedicate limited resources elsewhere.
Mr. D. Schenk addressed Council in support of the staff recommendation outlined in report DSD -19-
006, noting he believes educating the public on cannabis use should be a priority.
Mr. M. Steinman addressed Council in support of the staff recommendation outlined in report DSD -19-
006.
In response to questions regarding greater enforcement in City parks, Ms. G. MacNeil advised if this
was Council's direction, she would have to examine current staffing resources and determine how many
Officers would be required.
Mr. J. Readman noted the City of Kitchener has been allocated a first installment of $122,743. He
further stated he would likely have more information on the second installment from the Province after
the opt -in deadline of January 22, 2019.

"That the City of Kitchener opt -in to allow retail cannabis stores; and,
That the Municipal Retail Cannabis Store Policy Statement as outlined in Appendix "A" as
attached to report DSD -19-006 be adopted; and further,
That the Manager of Site Development and Customer Service or designate be delegated
authority to provide written submissions to the registrar under the Cannabis Licence Act, 2018,
regarding the issuance of proposed retail cannabis store licences within the City of Kitchener in
accordance with the commenting criteria as outlined in the City of Kitchener's Municipal Retail
Cannabis Store Policy Statement."
Carried Unanimously on a recorded vote.
The meeting then recessed at 5:36 p.m. and reconvened at 6:38 p.m. chaired by Mayor B. Vrbanovic
with all members present.
4. OPERATING AND CAPITAL BUDGET - DIRECTION

Seconded by Councillor P. Singh
"That the report of the special Finance and Corporate Services Committee meeting regarding
the 2019 Operating and Capital Budgets be adopted."

WAIVE NOTICE OF MOTION
Moved by Councillor S. Davey
Seconded by Councillor K. Galloway-Sealock
"That pursuant to Section 25.4.4 (f) of Chapter 25 (Procedure) of the Municipal Code, the
requirement for Notice of Motion be waived to add the following matter to the Special Council
agenda this date with respect to the date of the January, 2019 Council meeting."
