Information for Tenderers INFORMATION TO TENDERERS – T19-041 Re: Sale of Land by Public Tender pursuant to the Municipal Act, 2001 PIN: 22326-0146; Lots 447 and 448 and Part Lot 446, Plan 376, being Part 1 on WDR150, City of Kitchener, Regional Municipality of Waterloo; 152 Shanley Street, Kitchener, Ontario A tender for the sale of land for tax arrears under the Municipal Act shall be submitted on a Tender to Purchase Form (Form 7 under the Municipal Tax Sales Rules , Ontario Regulation 181/03), a copy of which is available on the City’s website at www.kitchener.ca/TaxSale, labelled as “Tender Form”. In addition, a copy of the prescribed form of tender is available on the website of the Government of Ontario Central Forms Repository under the listing for the Ministry of Municipal Affairs. The Tender to Purchase Form shall be: 1) typewritten or legibly handwritten in ink; 2) accompanied by a deposit of at least 20 per cent of the tender amount, which deposit shall be made by way of money order or by way of bank draft or certified cheque by a bank or trust corporation; and, 3) submitted in a sealed envelope on the outside of which is indicated the words “Tax Sale for 152 Shanley Street, Kitchener” addressed to the Treasurer, The Corporation of the City of Kitchener, c/o Director of Procurement, 4th Floor, 200 King Street West, Kitchener, Ontario. All tenders shall be completed in accordance with the above-noted requirements. Failure to comply with these requirements will result in the submitted tender being rejected. The sealed envelope containing the completed Tender to Purchase Form shall be received until 3:00 p.m. local time on February 28, 2019 by the Treasurer of the Corporation of the City of th Kitchener c/o the Director of Procurement, 4 Floor, 200 King Street West, Kitchener, Ontario, N2G 4G7. Tenders will be opened in public by the Treasurer at 3:30 p.m. local time, February 28, 2019, in the Scott Room, 9th Floor, Kitchener City Hall, 200 King Street West, Kitchener, Ontario. The Treasurer shall evaluate all tenders in accordance with the provisions of the Municipal Act, 2001 and the Municipal Tax Sales Rules to determine whether there is a successful purchaser. Any condition placed on a tender will result in the tender being rejected. The successful purchaser will be required to pay the amount tendered plus accumulated taxes, HST if applicable and the relevant land transfer tax. Failure to complete the transaction by the successful purchaser will result in the forfeiture of their deposit. Please Note: The municipality makes no representations regarding the title to or any other matters relating to the land to be sold including the condition of the building and/or the land. The municipality does not warrant the title in any way. Certain interests may survive the tax sale. The municipality does not provide an opportunity for potential purchasers to view this property nor is it in a position to provide successful purchaser with a key or vacant possession. A tax deed does not impose an obligation on the municipality to provide vacant possession.
