HomeMy WebLinkAboutCOR-19-012 - Residential Lease Request - 20 David Street REPORT TO: Committee of the Whole DATE OF MEETING: January 31st, 2019 SUBMITTED BY: Tanya Kalbfleisch Mazurka, Associate City Solicitor 519-741- 2200 ext. 7060 PREPARED BY: Tanya Kalbfleisch Mazurka, Associate City Solicitor 519-741- 2200 ext. 7060 WARD (S) INVOLVED: Ward 9 DATE OF REPORT: January 30th, 2019 REPORT NO.: COR-19-012 SUBJECT: Residential Lease Request 20 David Street ___________________________________________________________________________ RECOMMENDATION: That the Director of Facilities Management be authorized to execute a Standard Form of Lease for a residential tenancy, satisfactory to the City Solicitor, for a tenant of the property municipally known as 20 David Street to begin on March 1, 2019; and Further, that the Director of Facilities Management be authorized to execute any Standard Form Leases for City owned residential properties, satisfactory to the City Solicitor BACKGROUND: The City owns several residential properties in Kitchener that were acquired a number of years ago. These residential properties are leased out to suitable tenants for market value rent. As of April 2018, the government of Ontario has mandated that all new residential tenancies must have a lease using the Standard Form of Lease. REPORT: The proposed tenant has been selected and wishes to occupy the property located at 20 David Street starting from March 1, 2019. The proposed rent has been set at $1695 per month and all utilities are to be paid by the tenant. The property does not come equipped with appliances of any kind so the tenant must supply their own. The mandatory Standard Form of Lease shall be used for this tenancy and there will be additional terms applicable to the tenancy, specifically forbidding the property to be used for any income generating activities, illegal purposes, daycare for children, smoking including cannabis in or within 9 metres of the property and the storing of unlicensed vehicles, RVs or boats on the property. *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994 for assistance. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation outlined in this report supports the achievement of the C vision through the delivery of core service. FINANCIAL IMPLICATIONS: The proposed rent is fair market value rent for the property and the tenant will be responsible for any utility costs incurred by their occupation of the space.
