Marsh, Chair Mayor B. Vrbanovic, Councillors D. Chapman, S. Davey, K. Galloway-Sealock, B. Ioannidis, M. Johnston, C. Michaud, D. Schnider and P. Singh. Staff: D. Ross, Manager, Development Review K. Anderl, Senior Planner B. Bateman, Senior Planner J. Rodrigues, Committee Administrator Councillor S. Marsh advised this is a formal public meeting to consider applications under the Planning Act. If a person or public body that would otherwise have an ability to appeal a decision of the City of Kitchener to the Local Planning Appeal Tribunal, but the person or public body does not make oral submissions at the public meeting or make written submissions to the City of Kitchener before the By- law is passed, the person or public body is not entitled to appeal the decision. 1. DSD-19-005 - OFFICIAL PLAN AMENDMENT OPA/18/004/T/KA - ZONING BY-LAW AMENDMENT ZBA/18/005/T/KA - 146 TRAFALGAR AVENUE - BLAZE PROPERTIES INC. The Committee considered Development Services Department report DSD-19-005, dated January 22, 2019, recommending approval of Official Plan Amendment OPA/18/004/T/KA; Zoning By-law Amendment ZBA/18/005/T/KA; and, that applications for minor variances be permitted for the property municipally addressed as 146 Trafalgar Avenue. Ms. K. Anderl presented the report and responded to questions from the Committee. Mr. M. Dorfman, Planner Inc., agent on behalf of Blaze Properties Inc., addressed the Committee in support of the subject application and staff recommendation. He advised if the Official Plan and Zoning By-law Amendments were approved this date, Blaze Properties Inc. would apply for Site Plan approval. He outlined the features that will be included in the Plan, noting the subject application intends to increase affordable housing for seniors in the community. He further noted the property owner has addressed many of the concerns expressed by residents and City staff. On motion by Councillor D. Schnider it was resolved: That the Official Plan Amendment Application OPA/18/004/T/KA for Blaze Properties Inc. requesting a change to the Land Use Designation, be adopted, in the form shown in the Official Plan Amendment attached to Development Services Department report DSD-19- Schedules A and B thereto, and accordingly forwarded to the Region of Waterloo for approval; and, That Zoning By-law Amendment Application ZBA/18/005/T/KA for Blaze Properties Inc., be - DSD-19- That in accordance with the Planning Act Section 45 (1.3 & 1.4) that applications for minor variances shall be permitted for lands subject to Zoning By-law Amendment Application ZBA/18/005/T/KA. DSD-19-001 - DRAFT PLAN OF VACANT LAND CONDOMINIUM 30CDM-18205 - 155 WESTWOOD DRIVE - COOK HOMES LIMITED The Committee considered Development Services Department report DSD-19-001, dated January 15, 2019, recommending the approval of Draft Plan of Vacant Land Condominium Application 30CDM-18205 for the property municipally addressed as 155 Westwood Drive. Mr. B. Bateman presented the report and responded to questions from the Committee. He noted Mr. B. Cronkite, Mr. N. Lobley, and Mr. N. Gollan were also in attendance to answer questions from the Committee regarding off-site issues pertaining to transportation planning, engineering, or parks. be considered at the March 4, 2019 Council meeting. Ms. K. Barisdale, GSP Group Inc., agent on behalf of Cook Homes Limited, addressed the Committee in support of the subject application and staff recommendation. She provided a PowerPoint presentation, highlighting the purpose of the subject development, the features of the Draft Plan of Condominium, and provided key milestones and dates related to the approval of the application and the neighbourhood meetings. She advised that Mr. Cook, Cook Homes Limited, was in attendance to answer questions from the Committee. In response to questions, Mr. Cook advised he would willing to work with the City to contribute funding to assist in upgrades to the park adjacent to the subject development. Mr. R. Suffling addressed the Committee in opposition to the subject application and staff recommendation, noting his concerns are with regards to adequate parking spaces, road safety, and the worsening of drainage and flooding as a result of the proposed development. He requested staff address the storm water issues on Westwood Drive during the construction of the proposed development and encouraged staff to work with neighbouring residents on the road safety concerns. Ms. C. Vnoucek addressed the Committee in opposition to the subject application and staff recommendation. She provided a PowerPoint presentation to express her concerns with the loss of shared amenities in the neighbourhood that would result from the proposed development, including the parking lot, baseball diamond, playground, basketball hoops and open space. Mr. A. Sharif addressed the Committee to express his concerns with the traffic impact on Westwood Drive and the safety of residents walking to the park. Councillor M. Johnston advised she is bringing forward a Notice of Motion to the March 4, 2019 Council meeting for consideration regarding traffic calming measures on Westwood Drive. On motion by Councillor S. Davey it was resolved: That the City of Kitchener, pursuant to Section 51(31) of the Planning Act R.S.O. 1990, Chapter P 13, as amended, and delegation by-law 2002-64, grant draft approval to Plan of Condominium Application 30CDM-18205 in the City of Kitchener, for Cook Homes Limited, subject to the conditions attached to report DSD-19- 3.
