RECOMMENDATION:
That, pursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA-2019-
V-005 be approved to permit the alteration of an existing window opening to accommodate
installation of a new window, door and access to a rooftop terrace on the property municipally
addressed as 5 Michael Street, in accordance with the plans and supplementary information
submitted with the application and subject to the following condition:
1.That the final building permit drawings be reviewed and heritage clearance provided by
Heritage Planning staff prior to the issuance of a building permit.

BACKGROUND:
The subject property is located on the south side of Michael Street between Linden Avenue and Victoria
Street South, within the Victoria Park Area Heritage Conservation District (VPHCD), which is designated
under Part V of the Ontario Heritage Act. Built circa 1910, it is described in the 1995 VPHCD Study as, “\[a\]
buff brick factory building, near original in appearance and details, consisting of a 2½ and a 3½ storey
section, with rows of sash windows set in pilastered brick bays. The front entrance is modified with an awning
roof and the old wood sash windows have been partly replaced with new vinyl-clad. Formerly the C.A. Ahrens
Shoe Co. factory established in 1880, it is presently Cline Shirt Company.”
A 2009 report approved by Heritage Kitchener identified the subject property as a Group ‘A’ building, “of very
high cultural heritage value or interest.” The former factory building is recognized as a neighbourhood
landmark surrounded primarily by residential development.
In addition to the protection of aPart V designation, a Heritage Easement Agreement was granted in 2002
by the then owners to the City of Kitchener. It identifies the following Heritage Elements as being worthy of
conservation:
Exterior
all exterior elevations and additions (specificallyexcluding the loading dock area and cinder block
addition, but including original exterior located behind loading dock area and original exterior located
behind cinder block addition) including foundation;
yellow brick walls;
brick pilasters;
brick corbelling at roofline;
brick voussoirs;
all window and door openings (excluding third window opening from left on the first floor of Michael
Street elevation) including 6/6 double hung with 3 pane operating transoms, and 2/2 cellar windows;
concrete sills;
tie rods and anchors;
roof and roofline;
brick chimney (8-10 feet above roofline only);
Interior
exposed heavy timber (post and beam) construction with 4-way steel post caps and metal stirrups;
hardwood, parquet and terrazzo floors;
walk-in safe reading Charles A. Ahrens and Company – The Goldie & McCulloch Co. Limited – Galt);
dry sprinkler system alarm head dated 1922;
interior curved profile of the masonry sills and walls;
excluding basement.

In 2016, Heritage Permit Application HPA-2016-V-001 was approved to permit alterations associated
with the rehabilitation of the former factory building for office use. This work includedthe removal of the
top 2.4m of the existing chimney; masonry replacement, repair and repointing; repair or replacement of
all windows; lining the interior curved profile of the masonry sills and walls; re-cladding the loading dock
andcinder block additions with horizontal wood or cementitious siding; introducing new openings and
windows in the cinder block addition; and constructing a new entrance canopy from the parking lot. The
above described work has been completed.

The property owneris now proposing to construct a rooftop terrace on top of the cinder block addition,
and to access the terrace through a new door to be constructed within an existing window openingon
the rear (south facing) elevation of the 3½storey former factory building. Given the cinder block addition
is specifically excluded as a heritage attribute in the Heritage Easement Agreement, and the rooftop
terrace on the cinder block addition will not be seen from Michael Street, heritage approval for the rooftop
terrace is not required. However, the rear south facing elevation of 5 Michael Street is subject to heritage
review, andheritage approval is required to alter anexisting window opening in order to introduce a new
door to access the proposed rooftop terrace.
REPORT
HPA-2019-V-005 seeks Council approval to alter 5 Michael Street by enlarging an existing window
opening to facilitate installation of a new window and door that will provide access to a proposed rooftop
terrace.

The existing window opening to be altered is located on the second storeyof the rear south facing
elevationand is similar in dimension to other windows on the same elevation.The area to be altered is
not visible from the street but is located on a building elevation that is subject to the Heritage Easement
Agreement. The existing multi-pane window is not original and was installed as part of the approvals
granted in 2016. While the width of the existing opening is not proposed to change,the length (overall
height) of the existing opening will be enlarged to accommodate the installation of a new door. This will
require removal of approximately 4’ x 3’ 4” of brick immediately below and central to the existing window
opening.
The door to be installed is an aluminum clad wood door featuring full height tempered double glazing
insulated glass. New windows to be installed around the door will match the recently installed windows
in material and colour, and will feature simulated divided lites.

In reviewing the merits of the application, Heritage Planning staff note the following:
subject property is identified as a Group ‘A’ building in the VPHCD and is subject to a Heritage
Easement Agreement;
area where alteration is proposed is not visible from Michael Streetand will not detract from the
character of the Victoria Park Area Heritage Conservation District,the integrity of the streetscape
nor the character of the property;
only a small area of brick is proposed to be removed to increase the size of the window opening;
the replacement windows will match the existing newer windows in material and style, and the
new door will be similar in exterior finish and colour; and
the alteration is a minor intervention to the building and has been designed to be similar to and
complementary with the alterations approved in 2016.
In accordance with the Heritage Permit Application form, the approval of an application under the Ontario
Heritage Actshall not be a waiver of any of the provisions of any by-law of the City of Kitchener or legislation,
including, but not limited to, the requirements of the Ontario Building Code and Zoning By-law. In this regard,
staff confirm that a Building Permit is requiredfor this proposal, and that the building permit drawings must
match the approved heritage permit drawings.
ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN:
The recommendation of this report supports the achievement of the City’s strategic vision through the
delivery of core service.

In 1997, the City of Kitchener established the Mike Wagner Heritage Awards to
pay tribute to property owners, businesses and individuals who have contributed
named after former City Councillor Mike Wagner who served on City Council
from 1989 to 1997, and who was a strong advocate for heritage, culture and the
arts. In 2017, the heritage awards were renamed The Mike & Pat Wagner
Heritage Awardsin recognition of the many contributions of Pat Wagner, who
was a long time member of Heritage Kitchener and a recipient of the Lieutenant
Ontario Heritage Award for Lifetime Achievement.
planning awards program in order to celebrate a broader range of categories
under one program event, known as KitchenerGreat Places Awards (KGPAs).
The biennial KGPAs
The KGPAs are scheduled to be celebrated in the Fall of 2019 (date to be
announced). Nominations are being accepted from March 26 through to April 26,
2019. Nominations may be received from the general public, including from
members of the Heritage Kitchener Committee.
Eligibility Requirements
The Mike & Pat Wagner Heritage Award are open to all individuals, businesses,
organizations and institutions that have conserved cultural heritage resourcesor
have demonstrated commitment to the conservation of cultural heritage
resources within the City of Kitchener. For the purpose of the award program,
cultural heritage resourcesare defined as:
properties designated under the Ontario Heritage Act;
properties listed as a non-designated property of cultural heritage value
or interest on the Municipal Heritage Register; or
properties identified on the Heritage Kitchener Inventory of Historic
Buildings.
Up to 4 heritage awards may be presented in a given award year, and
nominations may be received in one of three categories as follows:

Preservation / Restoration of Cultural Heritage Resources
Preservation projects involve protecting, maintaining and stabilizing the existing
form, material and integrityof a cultural heritage resource while protecting its
heritage attributes and values. Preservation projects generally relate to cultural
heritage resources that are intact and do not require extensive repair, extensive
replacement, alterations or additions.
Restoration projects involve revealing, recovering or representing the state of a
cultural heritage resource or of an individual heritage attribute as it appeared at
a particular period in its history, as accurately as possible, while protecting its
heritage value. Restoration projects are based on physical and documentary or
oral evidence.
Rehabilitation / Adaptive Reuse of Cultural Heritage Resources
Rehabilitation and Adaptive Reuse projects involve the sensitive adaptation of a
cultural heritage resource or of an individual heritage attribute for a continuing or
compatible contemporary use, while protecting its heritage value. This may be
achieved through repairs, replacements, alterations and/or additions.
Individual Contributions to the Field of Heritage Conservation
Awarded to individuals, businesses, organizations, institutions who have made
exceptional and/or long lasting contributions to the conservation of cultural
heritage resources.
Nominations for a Mike Wagner Heritage Award must demonstrate that:
The conservation project involves a cultural heritage resource;
The conservation project conserves the heritage attributes and values
associated with the cultural heritage resource;
The conservation project is located within the City of Kitchener;
The conservation project is complete;
The conservation project obtained all required approvals such as
Building Permits and Heritage Permits;
The conservation project has not received a previous Mike Wagner
Heritage Award for the same work;
The individual, business, organization or institution nominated has made
exceptional or long lasting contributions to the conservation of cultural
heritage resources within the City of Kitchener.

Eligible Mike & Pat Wagner Heritage Award nominees will also be eligible to be
nominated and receive an award under two other KGPA award categories:
given to a project that receives the most
number of votes from the community through a variety of polling options.
Projects for consideration will be short-listed to a group of up to 10
projects from those eligible in the Urban Design, Neighbourhood Design,
Urban Elements, Mike & Pat Wagner Heritage and Sustainable Kitchener
award categories that contribute to making Kitchener a great city.
Schmalz Award for Design Leadership:given to an exceptional project
more categories -urban design, heritage conservation, and sustainable
design. It represents the best overall project of the awards program.
Named
first City Hall and clock tower (which is now a landmark in Victoria Park)
along with numerous other buildings in the City. His father, W.H.
Schmalz, was mayor when the Town of Berlin became a City.
At the April 2, 2019 meeting of Heritage Kitchener, City staff will make a brief
presentation on the award program, highlighting some previous heritage award
winners. Mike & Pat Wagner Heritage Award nominations forms will be
distributed. Nominations may also be made online. Eligible nominations received
before the April 26, 2019 deadline will be reviewed and considered by Heritage
Kitchener at the June 4, 2019 committee meeting, at which time Heritage
Kitchener will be asked to make its recommendations on the Mike & Pat Wagner
Heritage Award winners to City Council.
