HomeMy WebLinkAboutPublic Works - 1995-05-29PWTC\1995-05-29 PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES MAY 29, 1995 CITY OF KITCHENER The Public Works and Transportation Committee met this date under the Chairmanship of Councillor John Smola, with all members present. Councillor K. Redman, Councillor G. Lorentz and J. Ziegler were in attendance for part of the meeting. Others Present: Councillor T. Galloway, Councillor M. Yantzi, Ms. V. Gibaut and Messrs. J. McBride, D. Snow, E. Kovacs, T. McKay, J. Shivas, S. Gyorffy, T. McCabe, J. Gazzola, T. Clancy and L.F. Parkhouse. This meeting of the Public Works and Transportation Committee commenced at 9:05 a.m. 1.Breithaupt Street Reconstruction The Committee was advised that the total reconstruction of Breithaupt Street, from King Street to Waterloo Street, has now gone out to tender with the Iow bid received being in the amount of $641,299.79. This amount exceeds the approved budget by nearly $205,000.00. Mr. E. Kovacs referred to his report and suggested that the following factors may have contributed to the increase in price: -soil investigations which have indicated that de-watering will be necessary; -numerous underground services to the Perstorp Plant which have created complications not taken into account as part of the pre-engineering investigations; -temporary warehousing facilities for Perstorp during the construction period; -only 2 bidders which may be a reflection of the large amount of heavy construction which is taking place at this time. It was suggested to the Committee that this project be deferred to 1996 in the hope that a better price would be obtained at that time. Councillor John Smola indicated that he had no objection to the recommendation as presented but suggested that all affected area residents should be advised of the delay and the reasons for it. On motion by Councillor C. Weylie - it was resolved: "That the reconstruction of Breithaupt Street, from King Street to Waterloo Street, be deferred to 1996 and additional funds to undertake this project be appropriated through the capital budget process for 1996." 2.Sanitary Servicing Scheme - Pioneer Tower West This item, which deals with the Sanitary Servicing Scheme for the Pioneer Tower West Community and the associated Environmental Assessment Study, was originally considered by the Public Works and Transportation Committee on May 15, 1995. At that time, the following resolution was adopted: "That approval of the preferred sanitary servicing scheme for the Pioneer Tower West Community be deferred and referred to the public meeting which will be held as part of the planning process for this area." When this resolution was considered by City Council, it was agreed that the matter would be referred back to the Public Works and Transportation Committee for further consideration. Mr. Paul Britton appeared before the Committee indicating his support for the staff recommendation as contained in a report dated May 10, 1995. In this regard, Mr. Britton pointed out that the Environmental Assessment Study does not deal with densities for the Pioneer Tower West Community but rather deals with how this area will be serviced. The Environmental Assessment Study will not predetermine planning issues. PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES MAY 29, 1995 - 73 - CITY OF KITCHENER 2.Sanitary Servicinq Scheme - Pioneer Tower West (Cont'd) Mr. Britton also advised the Committee that there are other processes which must be undertaken, however, these cannot proceed until the recommendation contained in the staff report has been adopted. Mr. Britton pointed out that easements for the forcemain could take 7 to 8 months to finalize, however, this work cannot proceed without the approval of the staff recommendation. Councillors K. Redman and G. Lorentz entered the meeting at this time. The Committee was advised that hydrography issues have been raised, however, these will be considered as part of the subdivision process. In this regard, Mr. Britton advised the Committee that, hopefully, all property owners will participate in any hydrographic study. When questioned by Councillor M. Wagner, Mr. Britton suggested that the general concern was that the Environmental Assessment Study would predetermine the densities for this area. It was suggested that this is clearly not the case. The recommendation, as presented at this time, deals strictly with the servicing of the area and not the planning issues. When questioned by the Committee, Mr. T. McCabe advised that originally it was his recommen-dation that the Environmental Assessment Study be referred to the public meeting which would be held to consider the planning issues. When making that recommendation, Mr. McCabe advised that he was not aware of the necessity to undertake land exchanges and obtain easements for the forcemain. Mr. McCabe indicated his support for the staff recommendation at this time. Councillor J. Ziegler entered the meeting at this time. Councillor T. Galloway noted that the Official Plan allows for the development of the lands in the Pioneer Tower Area and that the area can be serviced with municipal services. The area residents are concerned that any activities may have an adverse effect on their existing wells and interruptions have occurred at various times in the past. It was the view of Councillor Galloway that both the deep and shallow aquifers must be considered to ensure that there continues to be an adequate supply of quality well water in this area. Following further discussion and on motion by Councillor C. Weylie - it was resolved: "That Council approve the preferred Sanitary Servicing Scheme for the Pioneer Tower West Community, as presented at the public open house on April 25, 1995, and further, That the Schedule 'B' Class Environmental Assessment Study Report for the project be filed with the City Clerk for the mandatory 30 day public review period." 3. DOPWR 95-17 - Market Square Garaqe Repairs Mr. J. McBride appeared before the Committee and reminded them of a report which was presented in March of 1995 which outlined various repair options for the Market Square Parking Garage. Any action was deferred at that time so that the future of the Farmers' Market could be considered by the Downtown Task Force. Direction has now been given that this matter be considered at this meeting of the Public Works and Transportation Committee. Mr. McBride then reviewed the repairs which should be undertaken to the parking garage regardless of whether or not any action is taken in regard to Levels 4B, 5B and 6B. These works include repairs to the Upper Market Level and the entrance and exit ramps to the garage, repairs to the helix and various repairs to the lower levels of the parking garage. Mr. McBride then provided the Committee with the options which can be considered regarding the Upper Levels of the Market Parking Garage. The first level would see the repair of the upper 3 levels at a cost of approximately $717,000.00. The second option would be to completely replace Levels 4B, 5B and 6B at a cost of approximately 1.2 million dollars. It was noted by Mr. McBride that it is this option which is supported by staff. This option would provide a solution to 3. The third option would see Levels 4B, 5B and 6B removed in 5 years but not replaced. This option would have a cost of approximately $547,000.00. Option 4 would be the same as Option 3, except that the 3 levels would be removed immediately. The final option presented to the Committee was the demolition and reconstruction of the entire garage facility at a cost of approximately 9.2 million dollars. The Committee was advised that in order to arrive at recommendations it was necessary to make certain assumptions. These assumptions are as follows: -the Farmers' Market would remain in its present location; -the Market Square Shopping Centre and surrounding offices would remain; -that there would be minimal disruption to this portion of the Downtown area; -that Duke Street between Frederick Street and Scott Street would remain as a one-way street. When questioned by the Committee, Mr. McBride advised that there are certain safety and aesthetic improvements which should take place in the very near future. These improvements include stairwell improvements, painting and an emergency communication system. These improvements would have a cost of approximately $115,000.00 and would, hopefully, be undertaken during 1995. Councillor J. Ziegler suggested that, in his opinion, there are other options which have not been considered. One option would be to demolish the entire structure, including the Farmers' Market, with no reconstruction or discuss with Cambridge Leaseholds the possibility of them taking over the operation of the parking garage. In the view of Councillor Ziegler, the track record of the Market Garage is such that additional monies should not be spent to upgrade any part of it. Councillor Ziegler expressed concern that, if the upper levels are repaired and/or replaced, it is possible that the lower levels may deteroriate creating a new set of problems. Councillor G. Lorentz advised that it is his recollection that it would cost approximately $350,000.00 to demolish the entire structure and not rebuild it. Councillor Lorentz suggested, however, that consideration must be given to the future of all partners involved in Market Square and if the major tenants are not going to remain at this location then it would seem foolish to repair the existing parking structure. Councillor K. Redman suggested that any discussions with Cambridge Leaseholds should make it clear that the City would prefer if they and their tenants would remain in this location. Councillor Redman was of the view that the Market Parking Garage must continue to operate and, accordingly, any repairs required to spruce it up and keep it safe must be undertaken. Councillor B. Vrbanovic concurred with these comments. His Worship Mayor R. Christy advised that ongoing discussions are being held with Cambridge Leaseholds and it is apparent that they are watching to determine what action the City is going take to upgrade the parking structure. The decision taken by the City will likely have an affect on the future plans of Cambridge Leaseholds. Mayor Christy suggested to the Committee that this parking garage is a major factor in the continued long term operation of Eaton's and the rest of the shopping centre. Mr. T. McKay advised the Committee that this matter has been discussed by Management Committee on several occasions and it must be assumed that Market Square and the Office 3. DOPWR 95-17 - Market Square Garaqe Repairs (Cont'd) Tower at 22 Frederick Street are going to continue to exist for a number of years. This being the case, the parking garage will be required. It was further noted that the parking garage and the Farmers' PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES MAY 29, 1995 - 75 - CITY OF KITCHENER Market are integrated structures and, while there have been discussions about moving the Market, there would appear to be little justification to develop a freestanding facility to operate as a Market, 8 hours per week. The Committee was reminded that what they have in front of them now is the first in a number of steps which would have to be taken before any major work was undertaken. A final decision to replace the upper 3 floors of the parking garage would not be made until after the matter has been discussed during the Capital Budget process and the tenders have, in fact, been called and a contract awarded. Councillor J. Ziegler suggested that facilities, such as the King Centre, be considered for a new Market location. It was the view of Councillor Ziegler that it may be more cost efficient to buy an existing facility than repair the existing parking garage. Councillor Ziegler did suggest, however, that he would support interim repairs so that part of the Market Garage presently being utilized can be used in a safe manner. Councillor G. Lorentz was of the opinion that there were too many unknowns at this time to make a final decision regarding the Market Garage. He did, however, express the opinion that it was unlikely that the east end of the core would completely collapse if this garage were removed. Councillor Lorentz indicated that he would like information indicating how long the major tenant intends to stay at Market Square and a final decision made indicating what will be done with the Farmers' Market. Councillor Jake Smola questioned how much has been spent on the Market Parking Garage since it was opened. It was indicated that repairs have amounted to approximately 2.4 million dollars. It was further noted that the City spent approximately $4,000,000.00 on debenture and interest charges respecting this facility. Councillor Jake Smola pointed out that staff are of the opinion that the existing building is structurally sound providing that needed repairs are undertaken. He further pointed out that approximately 2.4 million dollars have already been spent on repairs and questioned whether more money should be spent on this facility. Councillor M. Wagner indicated support for a short term program which would see the work completed so that the parking garage can continue to operate as it is at the present time. Councillor Wagner indicated that he was not prepared to approve a long term commitment to the continuation of a parking garage in this location. Councillor T. Galloway suggested that the decision facing Council at this time is important, not only to Cambridge Leaseholds, but also to investors and potential investors in the Downtown. Many years ago the City undertook a commitment to provide parking in the Downtown area and the City may be viewed as reneging on this commitment if the existing facility were removed and not replaced. When questioned by the Committee, Mr. J. McBride advised that elevator improvements were approved as part of the 1995 budget process and these works will go ahead. In reply to questioning by Councillor K. Redman, Mr. D. Snow pointed out that major structural changes would be required to the existing garage to accommodate two-way traffic on Duke Street between Frederick Street and Scott Street. Mayor R. Christy suggested that deterioration and renewal are a fact of life and the public image of the City of Kitchener may be dependent on how Council finally decides to deal with the Market Parking Garage. Repairs are required and the actions taken by Council in this regard may have an affect on the long term plans of both Cambridge Leaseholds and Eaton's. If action is not taken the end result could be the loss of tax revenue from this location. Mayor Christy pointed 3. DOPWR 95-17 - Market Square Garaqe Repairs (Cont'd) out that he is not happy about the need to undertake major repairs to this facility but expressed the opinion that the City must do so to ensure that Market Square remains and tax revenues are not lost. PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES MAY 29, 1995 - 76 - CITY OF KITCHENER His Worship Mayor R. Christy indicated that he was prepared to introduce a motion supporting the recommendations as contained in the staff report. Councillor M. Wagner advised that he would support the motion of Mayor Christy as long as it does not imply that the Farmers' Market will remain in its present location in the future. Councillor J. Ziegler was of the opinion that the recommendation dealing with a repair strategy for Levels 4B, 5B and 6B should only be approved in principle and should contain a condition that Cambridge Leaseholds would be contacted to obtain from them a commitment regarding their long range plans for the Market Square Shopping Centre. In this regard, Mayor Christy pointed out that Cambridge Leaseholds looks after the best interests of the City by looking after themselves. The following motion was introduced by His Worship Mayor R. Christy - "That repair strategy D-2, which includes the removal and replacement of Levels 4B, 5B and 6B in the Market Square Garage as outlined in DOPWR 95-9 dated March 1, 1995, be adopted with the work to commence in the 1996 construction season, and further, That improvements previously approved as part of the budget process, as well as the completion of the painting of all decks, the improvements to the stairwells and the installation of emergency alarms, be completed in 1995, and further, That Morrison Hershfield be contracted to perform a cursory inspection of Levels 4B, 5B and 6B in the fall of this year to ensure their structural integrity over the upcoming winter, and further, That Cambridge Leaseholds be approached to provide input with respect to our proposed short term and long term repair strategy for the Market Square Garage." The members of the Committee agreed that Mayor Christy's motion would be voted on, on a clause by clause basis. Councillor J. Ziegler introduced an amendment to Clause 1 which would approve repair strategy D-2 in principle and add a condition regarding a commitment from Cambridge Leaseholds regarding their long range plans for the Shopping Plaza. The amendment, as introduced by Councillor Ziegler, was put to a vote and was defeated. It is noted that Councillor Ziegler's amendment was supported by Councillor Ziegler, Councillor Lorentz, Councillor Vrbanovic and Councillor Jake Smola. Following further discussion, the motion, as originally introduced by His Worship Mayor R. Christy, was put to a vote on a clause by clause basis. Clause #1 - Carried Opposed: Councillors Ziegler, Lorentz, Vrbanovic and Jake Smola. Clause #2 - Carried Clause #3 - Carried Clause #4 - Carried 4. Revised Traffic Control Siqnal Warrants This informational report was received by the Committee. 5. Part-Time Bus Drivers Councillor J. Ziegler advised that he has received a copy of a letter regarding the possible use of part- time bus drivers. Councillor Ziegler requested that this matter be discussed at the next meeting of the Public Works and Transportation Committee. 6. Bus Rodeo Councillor B. Vrbanovic was congratulated for winning the Councillor Challenge at the Bus Rodeo held on May 28th. It was noted that this is the fourth year in a row that a representative from Kitchener Council has won this event. PUBLIC WORKS & TRANSPORTATION COMMITTEE MINUTES MAY 29, 1995 - 77 - CITY OF KITCHENER 7.Lonq Term Strateq¥ - Kitchener Farmers' Market At the request of Councillor G. Lorentz, it was agreed that the report regarding a long term strategy for the Farmers' Market would be presented to a meeting of the Community Services Committee in September of this year. 8. Fleet Operation - Public Input Councillor G. Lorentz suggested to staff that when Fleet Operations are reviewed input should be received from the public sector. 9.Adjournment On motion, the meeting adjourned at 11:20 a.m. L.F.
