SPECIAL COUNCIL MINUTES
JULY 29, 1993
The Council of the Corporation of the City of Kitchener met this date in special session with all members
present, except Alderman J. Ziegler and Alderman M. Wagner.
Notice of this special meeting had been given by the City Clerk in accordance with Chapter 25 of the
Municipal Code.
Alderman B. Stortz advised Council that the Central Frederick Neighbourhood Association wishes to have
a community picnic in Weber Park on August 15, 1993. It is intended to serve alcohol at this function
and, accordingly, the approval of City Council is required.

"That the City of Kitchener has no objection to the Central Frederick Neighbourhood Association
serving alcoholic beverages in conjunction with their community picnic to be held in Weber Park
on August 15, 1993."

Mr. T. McKay presented members of Council with a report outlining the actions taken which have led to
the negotiation of agreements with various employee groups under the Municipal Sector Social Contract.
A copy of the report, as presented by Mr. McKay, is attached hereto and forms part of these minutes.
Alderman C. Zehr requested an explanation of the $33,000.00 cost which the report suggests that the
City of Kitchener would absorb. In this regard, it was pointed out that the Province has agreed to defer 3
months from 1993 to 1996. The Province has also agreed that a further 3 months can be deferred from
1993 to 1996, however, interest costs must be paid. The $33,000.00 is the additional cost to the City to
provide for this additional 3 month deferral.
The members of Council were advised that all parties involved in the negotiation of the various
agreements tried to ensure that problems were resolved without necessitating the lay-off of a large
number of employees.
As part of his report, Mr. McKay pointed out that some negotiations are still ongoing and, accordingly, it
has been agreed that the details of all agreements will remain confidential until after all have been ratified
or the "fail safe" provisions go into effect. In this regard, it was suggested that the details of all
agreements be discussed in caucus.

"That this Council resolve itself into caucus to discuss in detail the negotiated agreements which
have been achieved with various employee groups under the Municipal Sector Social Contract."
Carried.
Following the conclusion of the caucus meeting the members of Council, again, met in open session.

"That this Council adopt the Memorandum of Understanding on the Social Contract Municipal
Sector Plan dated July 19, 1993."

"That an Early RetirementNoluntary Separation Program as outlined in the report on Social
Contract negotiations of the Chief Administrative Officer dated July 29, 1993, be approved."

development of a Separation Incentive Program where net savings can be gained from staff

the financing rather than having this financed by the Province."

employees."

"That Council provide authority to the Mayor and Clerk to ratify Social Contract Agreements with
CUPE Local 791 and 68, subject to them being signed off by the Chief Administrative Officer and
the Commissioner of Administrative Services and ratified by the respective memberships, and
further subject to these agreements being similar to the other agreements ratified on this date."

"That subject to all agreements being ratified by all appropriate parties they be forwarded to the
Province of Ontario by the City Clerk."

"That the Mayor and Members of Council be grouped with the non-bargaining unit employees for
the purposes of the Social Contract salary and benefit reductions."

"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a 1st, 2nd and 3rd times and
numbered 93-147 by the Clerk."
