HomeMy WebLinkAboutCouncil Minutes - 1994-11-28COUNCIL\1994-11-28 NOVEMBER 28, 1994 COUNCIL MINUTES CITY OF KITCHENER The Council of the Corporation of the City of Kitchener met this date with all members present. On motion by Councillor J. Smola, the minutes of the regular meeting held on November 7, 1994, as mailed to the Mayor and Councillors, were accepted. A. COMMUNICATIONS REFERRED DIRECTLY TO FILE - (1) Letter from the Honourable Ed Philip, Minister of Municipal Affairs, responding to Kitchener City Council's resolution dated October 11, 1994 whereby municipal councils could be permitted to use binding referenda with respect to local government matters. (2) Letter from Mr. Pierre Gravelle, Q.C., Deputy Minister, Revenue Canada Customs, Excise and Taxation, responding to Kitchener City Council's resolution of August 22, 1994 with respect to the reform of the Goods and Services Tax. (3) Election Declarations and Results of November 14, 1994 Municipal Election from R.W. Pritchard, City Clerk and Municipal Returning Officer. Mayor D.V. Cardillo advised that there were persons in attendance regarding licensing matters that were listed on the Committee of the Whole agenda of this date and recommended that they be dealt with at this time. Councillor J. Smola pointed out that a memorandum was circulated this date from the Manager of Licensing concerning a further licensing application of the Kiwanis Kavaliers. Reference was made on the Committee of the Whole agenda to the "Lame Duck" status of City Council and that the only possible way for Council to deal with the Monte Carlo events request was if it could honestly decide that the matters fell within the meaning of the phrase "except in case of extreme emergency". Moved by Councillor G. Lorentz Seconded by Councillor M. Wagner That the following licensing matters are considered to be of extreme urgency for the parties involved and are dealt with as noted hereunder: "That the Elmsdale Community Baseball Association be granted permission to operate a refreshment stand and sell crafts at Trillium Public School on December 10, 1994, and be granted a nominal licence fee of $1.00, provided that the necessary Licence and Health approvals are obtained." -and- "That the City of Kitchener has no objection to a Provincial licence being issued to the K-W Minor Lacrosse to conduct a Monte Carlo event at the Howard Johnson's, 1333 Weber Street East, Kitchener on January 6-8, 1994, inclusive." - and - "That the City of Kitchener has no objection to a Provincial licence being issued to the K-W Minor Lacrosse to conduct a Monte Carlo event at the Edelweiss Tavern, 600 Doon Village Road, Kitchener on January 19-21, 1994, inclusive." -and- "That the City of Kitchener has no objection to a Provincial licence being issued to the Kiwanis Kavaliers Drum & Bugle Corps. to conduct a Monte Carlo event at the Edelweiss Tavern, 600 Doon Village Road, Kitchener on December 29-31, 1994, inclusive." Carried. Mr. Les Rudrum, Chair, House Painting Committee of the Kitchener Citizens Beautification Committee appeared as a delegation to present plaques of appreciation to corporate sponsors involved in Annual House Painting Project for Seniors. Mayor D.V. Cardillo assisted with the presentations to Mr. Jerry NOVEMBER 28, 1994 COUNCIL MINUTES CITY OF KITCHENER Essner accepting for Acorn Fire and Safety, Mrs. Terri Robinson accepting for Len Graham on behalf of Tim Horton's, Mr. Bruce Zehr accepting for ICI Paints and Mr. Bob Brockelbank accepting for Twin City Kentucky Fried Chicken. Along with recognition of these individuals, Mr. Rudrum also recognized the work of the Committee's Treasurer and thanked City Council for its support. Mayor D.V. Cardillo also recognized several City staff for their participation in the House Painting Projects. Mr. Sam Essner representing the C.N.I.B and Ms. Ricki Germann representing CAW Local 4304 appeared as a delegation to present Mayor D.V. Cardillo with a portrait of himself wearing his chain of office in front of the new City Hall. Ms. Germann noted that the painting had been donated by Vic Thompson and that in conjunction with the painting a very large appreciation card was being presented to Mayor Cardillo. Signatories of the card had made a $2 donation for the opportunity to sign the card and all proceeds of this fundraising were directed toward the CNIB. Mayor D.V. Cardillo thanked the delegation for their presentation. Mr. Mike Bitakakis, President of the Greek Orthodox Community of Saints Peter and Paul and Mr. Angelo Poulos, Youth President appeared as a delegation on behalf of the Greek Community to present a bust of Hermes to the City of Kitchener. Mr. Bitakakis noted that the bust was on display during the 1994 Greek Festival and that it was hoped the bust would provide a permanent and personal touch within the City Hall. Finally, he wished best wishes to outgoing Mayor D.V. Cardillo and extended wishes for success to Mayor-elect Richard Christy. Mayor D.V. Cardillo thanked the delegation for the Greek Community's gift to the City and commented that a suitable place to display the bust would be found in City Hall. Councillor C. Zehr referred to a Weber Street pedestrian traffic problem concerning students at Eastwood Collegiate that was recently discussed. For the record he stated that he wished to advise staff that one of the suggestions that had been made to address the problem was to install a caution light and asked that staff ensure that this was looked at. Councillor J. Ziegler advised that he had distributed a proposed schedule for the 1995 budget review meetings and requested that Councillors advise him within a few days of any concern they might have with the draft schedule. Moved by Councillor C. Weylie Seconded by Councillor M. Yantzi That leave be given the Mover and Seconder to introduce the following by-law, namely: (a) To confirm all actions and proceedings of the Council and that the same be taken as read a first time and stand referred to the Committee of the Whole. Carried. On motion, the Council resolved itself into the Committee of the Whole to consider its agenda and Mayor D.V. Cardillo appointed Councillor J. Smola as Chairman. On motion, the Council rose from the Committee of the Whole and Mayor D.V. Cardillo occupied the Chair. Moved by Councillor J. Smola Seconded by Councillor C. Zehr That the proceedings and the recorded pecuniary interests and conflicts taken in the meeting of the Committee of the Whole held this date, as attached hereto and forming part of these minutes are hereby adopted and confirmed. Carried. Moved by Councillor C. Weylie Seconded by Councillor M. Yantzi That the by-law listed on the agenda for third reading, namely: (a) To confirm all actions and proceedings of the Council NOVEMBER 28, 1994 COUNCIL MINUTES CITY OF KITCHENER (By-law No. 94-201) be taken as read a third time, be finally passed and numbered serially by the Clerk. Carried. Mayor D.V. Cardillo thanked those participating in the Council meeting this date and expressed appreciation to existing and former members of City Council and City staff he had worked with during his years on City Council. As one of his last official duties prior to expiration of his term of office on November 30, 1994, Mayor D.V. Cardillo presented Conestoga Wagons with engraved recognition to Councillor Bryan Stortz - 6 years of service, Councillor C. Zehr - 9 years of service, and Councillor G. Leadston - 16 years of service to the City. Councillor B. Stortz expressed appreciation to Ward residents for the opportunity that they had provided him with to represent them and thanked City staff for their assistance over the years. Councillor C. Zehr extended best wishes to Mayor Cardillo and thanked the citizens of the community for their support. In addition he sent an e-mail note to City staff to express a thank you for their support and assistance. He commented that the City faced many challenges as it moves toward better economic times and asked that the new Council remain focused that they were elected to serve the public good and suggested no one should take things for granted but rather everyone should get out and market the community. Councillor G. Leadston thanked Mayor D.V. Cardillo for his support, friendship and respect over the years and extended best wishes to City Council. He also thanked the staff in the Mayor's office for their assistance over 16 years as well as all of his supporters over seven elections. Finally, he recommended that each member of City Council be sure to become involved in country-wide associations to expand their horizons. Councillors M. Yantzi and G. Lorentz on behalf of the remaining members of Council expressed their appreciation for the close working relationship which they have enjoyed with the Mayor and three retiring Councillors over the years. On motion, the meeting adjourned. MAYOR CLERK COUNCIL MINUTES NOVEMBER 28, 1994 -555 - CITY OF KITCHENER COMMITTEE OF THE WHOLE A. BY-LAWS AS LISTED ON THE AGENDA - 2ND READING - It was resolved: "That the by-laws considered by this Committee be taken as read a second time and be recommended for enactment." B. REPORT OF THE CHIEF ADMINISTRATIVE OFFICER - 1 .Licenses This item was dealt with under delegations. 2. Provincial-Municipal Infrastructure Amendinq Aqreement It was resolved: "That the Mayor and Clerk be authorized to enter into a Provincial-Municipal Infrastructure Amending Agreement dated October 27, 1994, between Her Majesty The Queen, in right of the Province of Ontario, as represented by the Minister of Municipal Affairs and The Corporation of the City of Kitchener."
