HomeMy WebLinkAboutCouncil Minutes - 1995-05-15 SCOUNCIL\1995-05-15-SPE MAY 15, 1995 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:30 p.m. this date and chaired by Mayor Richard D. Christy, with all members present except Councillor J. Ziegler. Notice of the special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 of the Municipal Code. Moved by Councillor G. Lorentz Seconded by Councillor M. Yantzi "That an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter relative to a licence applicant and two property acquisition matters." Carried. Council then recessed to allow in-camera discussion of the above items and reconvened at 1:05 p.m. Moved by Councillor Jake Smola Seconded by Councillor G. Lorentz That the Manager of Licensing be authorized to issue an Ice Cream Vendor Licence to David C. Pasher relative to the application dated May 5, 1995. Carried. Moved by Councillor John Smola Seconded by Councillor T. Galloway That the City of Kitchener abandon its request for the conveyance of Part 14, Reference Plan 58R- 9638 and the grant of right-of-way over Parts 18 and 21, Reference Plan 58R-9638 for the purpose of access to Part 14, as provided for in conditions 7 and 6, respectively of the decision of the Committee of Adjustment, dated January 31, 1995 with respect to Submission No.B 5/95, B 6/95 and B 7/95. Carried. Moved by Councillor John Smola Seconded by Councillor T. Galloway That the Mayor and Clerk be authorized to execute an offer along with the City of Waterloo to purchase approximately 4.2 miles of abandoned right-of-way (between Miles 13.0 and 15.8 of the Waterloo Subdivision including the Ottawa and Kent Street spurs) from CP Rail for the sum of $720,000, conditional upon an environmental audit to be conducted by Kitchener and Waterloo. Councillor G. Lorentz referred to lengthy negotiations necessary to obtain the subject lands for addition to the City's trail link system. Councillor M. Yantzi emphasized that acquiring these lands creates another positive link between the Cities of Kitchener and Waterloo and could develop into a major bicycle route. Councillor T. Galloway referred to the City's present comprehensive trail system, noting that it is the recreational resource most used by Kitchener citizens. He expressed confidence that the land is being added to the City's inventory at a reasonable cost and is a good investment. Mayor Richard D. Christy referred to the Rails for Trails initiative in the lower part of the Grand River Watershed and indicated that he would raise the issue of further trail development involving Kitchener at an upcoming meeting with the Grand River Conservation Authority. He noted that the land acquisition links two important urban facilities (Victoria Park and Waterloo Park) and indicated his hope for a partnership in developing the subject lands. Councillor M. Wagner pointed out that to date a great deal of integrative work has already been done through the Bicycle Master Plan and referred to people's willingness to use bicycles as transportation provided certain safety and security criteria are met. The previous motion by Councillor John Smola, seconded by Councillor T. Galloway, to acquire an abandoned railway right-of-way in conjunction with the City of Waterloo was voted on and Carried. Galloway That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 95-75 by the Clerk.
