HomeMy WebLinkAboutCouncil Minutes - 1995-10-16 SCOU NCIL\1995-10-16-SPE OCTOBER 16, 1995 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:25 p.m. this date and chaired by Mayor Richard D. Christy with all members present except Councillor M. Yantzi. Notice of the special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 of the Municipal Code. An enquiry was made at the previous Finance and Administration Committee meeting as to adding another item to the Special Council Meeting agenda of this date. Mr. R.W. Pritchard pointed out that Chapter 25 (Council Procedure) of the City's Municipal Code stipulates that unanimous consent of the whole Council is required before any item can be added to the agenda, and in this regard it was noted that Councillor M. Yantzi was not in attendance. However, Mr. Pritchard advised that for items of an urgent or extra-ordinary nature, notice of an additional item can be waived with the consent of two-thirds of the Council. Moved by Councillor J. Ziegler Seconded by Councillor M. Wagner "That pursuant to section 25.4.4(f) of the City's Municipal Code, the recommendation of the Finance and Administration Committee to construct a sidewalk along Marlborough Avenue in the Fall of this year to address a safety issue be dealt with at the special Council meeting this date." Carried, with the required two-thirds majority. Councillor John Smola asked that he be recorded as opposed to the recommendation relative to Marlborough Avenue, as in his view this could lead to similar requests from other areas of the City. Moved by Councillor M. Wagner Seconded by Councillor K. Redman "That in light of the demonstrated safety concerns arising from the fact that the needed sidewalk is adjacent to a school, the City, without prejudice or precedent and at its own expense, construct a sidewalk along the south side of Marlborough Avenue from the parking lot of J.F. Carmichael Public School through to Belmont Avenue, and further, That in light of the need to install the sidewalk as soon as possible, the City proceed with construction in the Fall of 1995, and that no action be taken relative to an application under Section 8 of the Local Improvement Act." Carried. Mayor R. Christy put Council on notice that he intends to extend an invitation to Lord Kitchener, the President of the Eighth Army Veterans Reunion to visit Kitchener in conjunction with a planned visit to London, Ontario. Moved by Councillor J. Ziegler Seconded by Councillor M. Wagner "That an in-camera meeting of City Council be held immediately following this special meeting to consider a proposed land acquisition." Carried. On motion, the meeting adjourned. MAYOR CLERK
