HomeMy WebLinkAboutCouncil Minutes - 1996-01-22 SCOUNCIL\1996-01-22-SPE JAN UARY 22, 1996 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:35 p.m. this date and chaired by Acting Mayor Jake Smola with all members present except Mayor R. Christy. Notice of the special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 of the Municipal Code. Council was in receipt this date of a report from the Local Architectural Conservation Advisory Committee (LACAC) recommending designation of the property at 410 King Street West (Kaufman Footwear) on the basis of its historic and architectural significance. Council was also in receipt of a summary staff report including a variety of architectural drawings illustrating the proposed redevelopment of the site. Councillor M. Wagner provided background to the designation which he characterized as the most important ever in the City of Kitchener, and possibly the most important industrial designation in Ontario. Mr. L. Bensason outlined the historic and architectural significance of the property, noting that its Architect, Albert Kahn, has been characterized as one of the 20th Century's greatest industrial Architects. Mr. Bensason also referred to contributions made to the community and the local economy by the Kaufman Family. Mr. Paul Britton, MacNaughton Hermsen Britton Clarkson Planning, spoke on behalf of his clients, Kaufman Footwear, and in support of the designation. He advised that there is some urgency in bringing the proposal before Council this date to conclusion, as it will allow his clients to finalize plans for redevelopment of the property. He explained that from the planning perspective, the designation is intended to achieve a balance between heritage preservation and adaptive reuse. Mr. Roger Farwell, Architect, appeared on behalf of the Walter Fedy Partnership and provided additional information as to the building's architectural significance. He also outlined adaptive reuse scenarios and the need to manipulate the King Street facade and the rear of the building. He referred to a number of massing studies illustrating possible terrace development and circulated drawings referencing proposed additions. Mr. Farwell also advised that the Kaufman Footwear Company intends to concentrate its offices at this location. Mr. Tom Kaufman appeared on behalf of Kaufman Footwear and referred to the history of the Company in the Downtown. Mr. Kaufman also referred to the high level of co-operation between City staff and his Company's representatives, and in particular thanked Planning staff, the LACAC Sub-Committee, Mayor Richard D. Christy and Councillor M. Wagner. Moved by Councillor M. Wagner Seconded by Councillor T. Galloway "That, based on the merits of this specific designation and without prejudice to future designations in the City, pursuant to Section 29 of the Ontario Heritaqe Act, R.S.O. 1990, the Clerk be directed to publish a notice of intention to designate the property municipally known as 410 King Street West, Kitchener (Kaufman Footwear) as being of historic and architectural significance, and further, That the designation shall include the east, south and west elevations of the 1908, 1911,1920 and 1925 phases of the main building with the designation to include only the following features: the exposed concrete frame, window openings, cornice and dentil mouldings, primary leading roofline (to the height of the existing 1908 and 1911 building frame) and porticos, all applying to the 1908 and 1911 building phases; the exposed concrete frame, brick and concrete block infill panels (spandrels), concrete lintels and sills, glass and metal enclosed entranceway with closed transom, limestone Doric columns and architrave with frieze and inscription reading "Kaufman Rubber Co. Ltd.", window openings, cornice and dentil mouldings, roof and roofline, and interior features of the entrance foyer, save for the reception counter line of the northwest wall from floor to underside of the height of the existing wall opening,all applying to the 1920 building phase; and the exposed concrete frame, brick and concrete block infill panels (spandrels), concrete lintels and sills, window openings, cornice and dentil mouldings, roof and roofline, all applying to the 1925 building phase, and further, That, notwithstanding the proposed designation, sympathetic alterations, in keeping with the drawings submitted by The Walter Fedy Partnership, dated January 1996, to be appended to the reasons for designation, are permitted." JANUARY 22, 1996 SPECIAL COUNCIL MINUTES - 20- CITY OF KITCI:IENER Councillor M. Wagner referred to the designation as unique, and the first of its kind in the Province. He noted that the process and the outcome demonstrate progressive thinking, and though there are risks on both sides, there are also benefits. Councillor T. Galloway stressed the leadership role of Councillor Wagner in this initiative and acknowledged the collaborative spirit of LACAC throughout the process. Councillor G. Lorentz thanked Kaufman Footwear for their continued support of the Downtown. The previous motion by Councillor M. Wagner, seconded by Councillor T. Galloway to adopt the Local Architectural Conservation Advisory Committee report of this date was voted on and Carried. Moved by Councillor J. Ziegler Seconded by Councillor B. Vrbanovic "That Legal Department staff develop a report on the regulation of restricted animals, specifically dogs of the pit bull variety known to be vicious, and thus a potential threat to the general safety of the community, and in developing said report consider the remedies outlined in the written submission of Councillors B. Vrbanovic and Jake Smola, dated January 22, 1996." -and- "That the Minister of Municipal Affairs, the Honourable Al Leach, be requested to forthwith acknowledge the danger posed to communities by certain breeds of dangerous animals such as pit bulls, and in this regard amend Bill 26, Section M, which would have the effect of amending the Municipal Act so as to strengthen the existing provisions for the regulation of dangerous or restricted animals by providing for a specific section pertaining to the regulation and restriction of dangerous animals or breeds, and further, That in the event this cannot be accomplished, the Minister make this change as part of the comprehensive review of the Municipal Act scheduled for 1996, and further, That a copy of this resolution be sent to the Clerks of municipalities in the Region of Waterloo for consideration by their respective Councils, to local MPPs and to municipalities in Ontario with a population greater than 50,000." Wagner That leave be given the Mover and Seconder to introduce the following by-laws, namely: (a) Being a by-law to provide for an interim tax levy and to provide for the payment of interim taxes (By-law No. 96-8) (b) Being a by-law to provide for interest to be added to tax arrears (By-law No. 96-9) (c) Being a by-law to establish a penalty charge for non-payment of current taxes (By-law No. 96-10) (d) To confirm all actions and proceedings of the Council (By-law No. 96-11 ) and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk.
