SPECIAL COUNCIL MINUTES
CITY OF KITCHENER
A special meeting of City Council was held at 4:45 p.m. this date with all members present, except
Councillors G. Lorentz and M. Yantzi.
Notice of this special meeting had been previously given to all members of Council by the City Clerk
pursuant to Chapter 25 (Council Procedure) of the Municipal Code.
Moved by Councillor J. Ziegler
Seconded by Councillor C. Weylie
"That the Mayor and Clerk be authorized to execute an agreement dated September 9, 1996, with
Thomas McKay to continue salary and benefits until June 30, 1997, and further, to provide a
retirement package in the amount of $107,315.45 which includes sick leave gratuity, vacation pay
and early retirement allowance."
Councillor Jake Smola questioned whether the City should be making available information on retirement
incentive packages received by other senior administrators in recent years. Councillor J. Ziegler
suggested that the senior administrators referred to by Councillor Jake Smola were longer term
employees eligible for regular and special incentives, and suggested that the incentive package
negotiated with Mr. McKay differs in kind. Councillor Jake Smola requested an opinion on how disclosure
of the settlement package relates to the municipal access and privacy legislation. Mr. Sosnoski replied
that, under the legislation, financial information is by definition personal. He further advised that in a
recent discussion with the Provincial Policy Advisor it was indicated that given the current environment, it
is likely the Information and Privacy Commission would rule that the public's need to know the terms of
settlement involving early retirement packages for senior civil servants outweighs the right to privacy.
Councillor B. Vrbanovic inquired whether members of Council would receive a copy of the final
agreement, and Councillor J. Ziegler asked that copies be circulated.
The motion, moved by Councillor J. Ziegler, and seconded by Councillor C. Weylie, to authorize
execution of an agreement with Thomas McKay was voted on and Carried.

Seconded by Councillor John Smola
"That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and
proceedings of the Council and that the same be taken as read a first, second and third times, be
finally passed and numbered 96-132 by the Clerk."
Carried.
On motion, the meeting adjourned.
