HomeMy WebLinkAboutCouncil Minutes - 1996-11-25 SCOUNCIL\1996-11-25-SPE NOVEMBER 25, 1996 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 11:35 a.m. this date, and Chaired by Mayor R. Christy, with the following members present: Councillors M. Wagner, M. Yantzi, John Smola, Jake Smola, B. Vrbanovic, J. Ziegler, T. Galloway and C. Weylie. Councillor K. Redman was in attendance for part of the meeting. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor J. Ziegler Seconded by Councillor T. Galloway "That Council grant the request of the Lions Club of Kitchener to operate a refreshment stand at their skating party in the Civic Square on November 29, 1996, for the reduced fee of $1:00, subject to obtaining a licence and the necessary Health approvals." Carried. Moved by Councillor J. Ziegler Seconded by Councillor T. Galloway "That Jester's Court and Charles Street Frys be granted permission to locate along King and Gaukel Streets on December 31, 1996 during the Festival of the Night celebration, provided that Health and Fire approvals are obtained; and further, That M & M Meat Shops be granted permission to locate a tent in Victoria Park on December 31, 1996 during the Festival of the Night celebration for a reduced fee of $1.00, provided the necessary licence and Health, Fire and Building approvals are obtained." Carried. Moved by Councillor J. Ziegler Seconded by Councillor T. Galloway "That the City of Kitchener grant the request of the Festival of Lights Committee for permission to have M & M Meats operate a refreshment stand on November 29, 1996; and further, That the Lions Club be granted permission to operate a refreshment stand during the seasonal lighting in Victoria Park." Carried. Moved by Councillor M. Wagner Seconded by Councillor J. Ziegler "That an in-camera meeting of City Council be held immediately following this special meeting to consider a land acquisition matter, a litigation matter, and seven matters involving solicitor-client privilege." Carried. Mr. J. Gazzola referred to the need for a Council and a staff appointee to the Regional Steering Committee investigating the feasibility of transferring responsibility for water and waste water. It was noted that the first meeting will take place this week and it was suggested that Councillor John Smola and Mr. John Gazzola represent the City of Kitchener, with Councillor J. Ziegler and Mr. E. Kovacs as alternates. Mayor R. Christy requested clarification as to the procedure for adding agenda items, and Mr. G. Sosnoski replied that Council's Procedural By-law indicates that unanimous consent of the whole Council is required to add an item to a special meeting agenda, or alternately, a two-thirds vote of the whole Council to waive the requirements of the Procedural By-law. It was noted that Councillor G. Lorentz was not in attendance this date. NOVEMBER 25, 1996 SPECIAL COUNCIL MINUTES -587- CITY OF KITCHENER Councillor T. Galloway questioned the necessity of a resolution this date to appoint Kitchener representatives and suggested that the recommendation to appoint be dealt with on December 2, 1996. It was generally agreed that a recommendation would be placed on the Committee of the Whole agenda of December 2, 1996 to appoint Councillor John Smola and Mr. John Gazzola as the City's representatives on the Regional Steering Committee for Sewer and Water, with Councillor J. Ziegler and Mr. E. Kovacs as alternates. Councillor B. Vrbanovic suggested that Council may wish to revisit its Procedural By-law at a future Finance and Administration Committee meeting, at which time a report would be available on how other municipalities handle the calling of special meetings, and the inclusion of additional items. Councillor J. Ziegler cautioned against a too flexible approach to adding additional items at the meeting, as some members of Council may not be aware that certain items in which they have an interest will be discussed. The special Council meeting recessed at 11:40 a.m., and Council resolved itself into caucus to consider its in-camera agenda. The special Council meeting reconvened at 12:45 p.m. with all members present except Councillor G. Lorentz. Moved by Councillor J. Ziegler Seconded by Councillor B. Vrbanovic "That on the basis of the testimony and evidence heard by the Council Committee on October 3 and 18, 1996, the 1996 business licence issued to Snezana Kovinic for the Anabella Massage Studio be suspended for a period of five (5) days from December 4 to 8, 1996, inclusive." Carried. Mayor R. Christy asked that Mr. George Chris provide the Clerk with the address from which his client is presently operating the Massage Studio. Moved by Councillor John Smola Seconded by Councillor Jake Smola "That the matter of declaring surplus and conveying certain City lands to Albert Raith Cement Contracting Limited, be placed on the Council agenda of December 2, 1996." Moved by Councillor John Smola Seconded by Councillor Jake Smola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council, and that the same be taken as read a first, second and third times, be finally passed and numbered 96-167 by the Clerk."
