Location Map: 920 Orr Court *** This information is available in accessible formats upon request. *** Please call 519-741-2345 or TTY 1-866-969-9994for assistance. 2 - 1 BACKGROUND: The Development Services Department is in receipt of Heritage Permit Application HPA-2019-IV-017 which is seeking permission to construct a swimming pooland fenceat the rear of the property municipally addressed as 920 Orr Court, also known as the RobertOrr Farmstead. REPORT: The subject property is located on the north side of Huron Road, east of Ludolph Street at the end of Orr Court. The property is designated under Part IV of the Ontario Heritage Act. The property contains a one- th and-a-half storey late 19century yellow brick farmhouse built in the Ontario Gothic architectural style. Front façade: 920 Orr Court Cultural Heritage Value or Interest In addition to referencing specific attributes on the exterior and interior of the farmhouse, Designating By- law 2016-024 identifies the following relevant landscape attribute of the property as being of cultural heritage value or interest: The vista of the front façade of the farmhouse as seen from Huron Road (from vantage points along a line beginning at the southeast corner of the subdivision lands at Huron Road and extending to a point just under 45m to the west). 2 - 2 Installation of a Swimming Pool The applicant proposes the installation of a (12.3 x 9.84m) swimming poolto be located directly offofthe rear deck behindthe dwelling. The applicant proposes a black wrought iron fence 6 feet (1.8 metres) in height to enclose the pool area, and a cedarhedgeapproximately 6 feet in heighton the north and west sides of the pool area to provide privacy from Orr Court. Proposed Pool Location Proposed Fence Design The mechanical equipment associated with the pool is proposed to be located within the garage that was approved in August 2019, or directly behind the dwelling on the west side and out of view from the front façade. There is a known archaeological site on this property. The proposed swimming pool may be within the limits of the archaeological site. Based on information and advice provided by the Ministry of Tourism, Culture and Sport, a condition requiring a licensed consultant archaeologist to oversee excavation works 2 - 3 related to the installation of a swimming pool has been included as part of Heritage Planning staff’s recommendation. The proposed new construction meets the following in Parks Canada’s The Standards and Guidelines for the Conservation of Historic Places in Canada: Conserve the heritage value and character-defining elements when creating any new additions to a historic place or any related new construction. Make the new work physically and visually compatible with, subordinate to, and distinguishable from the historic place. In reviewing the merits of the application, Heritage Planning staff note the following: The subject property is designated under Part IV of the Ontario Heritage Act; The proposal includes the constructionof a swimming pool at the rear of the dwelling with a surrounding wrought iron fence and cedar hedge; The proposal is in keeping with the relevant Parks Canada’s Standards and Guidelines for the Conservation of Historic Places in Canada; and The location of the proposed swimming pool and fence does not impact the identified exterior or interior attributes of the dwelling nor the vista of the front of the dwelling as seen from Huron Road. In accordance with the Heritage Permit Application form, the approval of an application under the Ontario Heritage Act shall not be a waiver of any of the provisions of any by-law of the City of Kitchener or legislation, including, but not limited to, the requirements of the Ontario Building Code and Zoning By- law. In this regard, staff confirm that a Building Permitis required to carry out this construction. ALIGNMENT WITH CITY OF KITCHENER STRATEGIC PLAN: The recommendation of this report supports the achievement of the city’s strategic vision through the delivery of core service.
