HomeMy WebLinkAboutCouncil Minutes - 1997-06-23 SCOUNCIL\1997-06-23-SPE JUNE 23, 1997 SPECIAL COUNCIL MINUTES CITY OF KITCHENER A special meeting of City Council was held at 12:45 p.m.this date and Chaired by Mayor R. Christy with all members present except Councillor C. Weylie. Notice of this special meeting had previously been given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor J. Ziegler Seconded by Councillor M. Wagner "That the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the City Solicitor, with the owner of Montana Taps to permit the use of eleven feet, six inches (11' 6") more or less, of sidewalk directly in front of Montana Taps, located at 215-219 King Street West, for the operation of a sidewalk patio for the 1997 season." Carried. Moved by Councillor J. Ziegler Seconded by Councillor T. Galloway "That the Golden Triangle Rose and Garden Society be granted permission to hold a raffle lottery in Kitchener on June 28, 1997 at the Breithaupt Centre." Carried. Moved by Councillor M. Yantzi Seconded by Councillor G. Lorentz "That an in-camera meeting of City Council be held immediately following recess of this special meeting to consider two labour relations matters, a land acquisition matter, a potential litigation matter, three personal matters and two matters subject to solicitor-client privilege." Carried. Moved by Councillor M. Wagner Seconded by Councillor J. Ziegler "WHEREAS a seat on Kitchener City Council was recently declared vacant following the incumbent's election as a Member of Parliament; AND WHEREAS Sections 45 and 46 of the Municipal Act require that the vacancy be filled within 45 days of the vacancy occurring, except where the vacancy occurs less than 46 days before nomination day in the regular election; AND WHEREAS Council has until July 18, 1997 to fill the vacancy, and in view of the short period of time between that date and the November 10, 1997 municipal election; THEREFORE BE IT RESOLVED that the City of Kitchener hereby requests that the Province of Ontario grant an exemption from the requirement to fill the said vacancy prior to the November 10, 1997 election, and asks that the Minister of Municipal Affairs and Housing kindly respond to this request no later than July 7, 1997; AND FURTHER that a copy of this resolution be circulated to all local Members of the Provincial Parliament." Carried. Moved by Councillor M. Wagner 23, 1997 SPECIAL COUNCIL MINUTES - 329- CITY OF KITCHENER Seconded by Councillor M. Yantzi "That the Mayor contact, as soon as possible, the runner-up for the Centre Ward seat in the 1994 municipal election, and enquire as to whether she has an interest in filling the vacant Council seat for the remainder of the current term of office; and further, That in the interim, the City Clerk prepare a draft public notice advertising the current vacancy and inviting any interested members of the public to apply, outlining their qualifications and experience." Carried. Moved by Councillor J. Ziegler Seconded by Councillor M. Yantzi "That Council approve an additional expenditure of $355,000 for the King Street and Cedar Street Reconstruction as a pre-approved 1998 budget item to address a budget shortfall for the co- ordination of pedestrian lighting and streetscaping work in 1997 and 1998; and further, That Council also approve the proposed concept for decorative streetscaping, street lighting and location of a 'Downtown' entrance feature within the roadway on King Street at Madison Avenue, subject to approval of the design layout details by the Regional Municipality of Waterloo, and that $46,500 be pre-approved for expenditure from the existing 1998 Capital Budget provision for Downtown Improvements." Carried. The special Council meeting was then recessed at 12:50 p.m. and reconvened at 6:20 p.m. with all members present except Councillors M. Yantzi and C. Weylie. Moved by Councillor J. Ziegler Seconded by Councillor T. Galloway "That consideration of an appointment to fill the vacant Kitchener seat on the Region of Waterloo Council, be deferred and referred to a special meeting at 5 p.m. on June 24, 1997 in order to allow Councillor M. Yantzi to attend and vote." Motion Lost. Councillors B. Vrbanovic and Jake Smola, being the only members of Kitchener Council without a seat on Regional Council, were nominated to fill the Regional Council vacancy created by the resignation of Councillor K. Redman. Both candidates then elaborated on their qualifications and a vote was conducted in accordance with Council's established balloting procedure. Mr. G. Sosnoski then read the results of the vote and declared Councillor B. Vrbanovic as the successful candidate. Moved by Councillor T. Galloway Seconded by Councillor G. Lorentz "That Councillor B. Vrbanovic represent the City of Kitchener on the Council of the Regional Municipality of Waterloo, and fill the vacancy created by the resignation of Councillor K. Redman." Carried. Moved by Councillor G. Lorentz Seconded by Councillor John Smola JUNE ~3, 1997 SPECIAL COUNCIL MINUTES - 330- CITY OF KITCHENER "That the City accept, and the Mayor and Clerk be authorized to execute, the offer of Gerold and Manfred Boettcher, In Trust, dated April 28, 1997 as revised, to sell to the City 2.13 acres of land near Lakeside Park, being Lots 139, 140, 141, 154, 155, 198, 199, 200, 201,202, 203, 204, 205, 206, 207, 208 and 209, Plan 230 for the sum of $25,000." Carried. Moved by Councillor J. Ziegler Seconded by Councillor G. Lorentz "That subject to all municipal approval criteria being met, the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the City Solicitor, with the owner of Just Desserts to permit use of a portion of the sidewalk directly in front of Just Desserts, located at 273 King Street West, for the operation of a sidewalk patio for the 1997 season; and further, That should the owner fail to receive such required approvals, he be directed to the July 7, 1997 Council meeting." Carried. Moved by Councillor J. Ziegler Seconded by Councillor M. Wagner "That the remainder of the in-camera agenda of Council of this date be considered when the in- camera meeting reconvenes at 4:30 p.m. on Monday, July 7, 1997. Carried. Moved by Councillor G. Lorentz Seconded by Councillor John Smola "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 97-104 by the Clerk."
