Bunn,Manager, Council and Committee Services/Deputy City Clerk 1.DSD-19-203-HERITAGE PERMIT APPLICATION HPA-2019-V-015 -54 THERESA STREET -REPLACEMENT OF AN EXISTING 1-STOREY ADDITION WITH A 2-STOREY ADDITION The Committee considered DevelopmentServices Department report DSD-19-203, dated August 20, 2019recommendingapproval of Heritage Permit Application (HPA) HPA-2019-V- 015 to permitthe replacement of a 1-storey addition with a 2-storey addition at the property municipally addressed as 54 Theresa Street, located within the Victoria Park Area Heritage Conservation District (VPAHCD).Ms. V. Grohnpresented the report, noting staff are recommending approval of the subject HPA. Ms. N. Temple, applicant, was in attendance in support of the HPA and the staff recommendation. In response to questions, it was noted the proposed cladding material would be vinyl, not wood. In response to questions, Mr. Bensason advised staff would encourage a cladding material, not brick, to be the preferred material in order to distinguish between the original heritage building andnew additions. The following motion was voted on and CarriedUnanimously. On motion byCouncillor D. Chapman- it was resolved: “Thatpursuant to Section 42 of the Ontario Heritage Act, Heritage Permit Application HPA- 2019-V-015, as outlined in Development Services Department report DSD-19-203,be approved to permit the replacement of a one storey addition with a two storey addition at the property municipally addressed as 54 Theresa Street in accordance with the supporting information submitted with the application and subject to the following condition: i.That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit.” 2.DSD-19-204-HERITAGE PERMIT APPLICATION HPA-2019-IV-017 -920 ORR COURT -CONSTRUCTION OF A SWIMMING POOL AND FENCE The Committee considered DevelopmentServices Department report DSD-19-204, dated August 20, 2019recommending approval of Heritage Permit Application (HPA) HPA-2019-IV- 017 to permit the construction of a swimming pool and fence at the rear of the property municipally addressedas 920 Orr Court, also known asthe Robert Orr Farmstead.Ms. V. Grohn presented the report, noting staff are recommending approval of the subject HPA as outlined in the report. In response to questions, Ms. V. Grohnadvised the fence would be visible from Orr Court and thepoolwould not include a diving board. Ms. Grohn agreed to circulate drawings of where the garage will be placed relativeto the fence. The following motion was voted on and CarriedUnanimously. HERITAGE KITCHENER MINUTES SEPTEMBER 3, 2019-26-CITY OF KITCHENER 2.DSD-19-204-HERITAGE PERMIT APPLICATION HPA-2019-IV-017 -920 ORR COURT -CONSTRUCTION OF A SWIMMING POOL AND FENCE (CONT’D) On motion by P. Ciuciura- it was resolved: “Thatpursuant to Section 33 of the Ontario Heritage Act, Heritage Permit Application HPA- 2019-IV-017, as outlined in Development Services Department report DSD-19-204,be approved to permit the construction of a swimming pool and fence on the property municipally addressed as 920 Orr Court, in accordance with the plans and supplementary information submitted with the application, and subject to the following conditions: i.That the final building permit drawings be reviewed and heritage clearance provided by Heritage Planning staff prior to the issuance of a building permit; and further, ii.That a licensed consultant archaeologist be retained to monitor excavation works as it relates to the installation of a swimming pool to the satisfaction of the Ministry of Tourism, Culture and Sport.” 3.HERITAGE EVALUATION & PROPOSED CHANGES -RELOCATIONOF ONEROOF YOUTH SERVICES TO 35 SHELDON AVE. N. -PROPOSED ALTERATIONS TO PROPERTY The Committee consideredan internal memo entitled “Relocation of oneROOF Youth Services to 35 Sheldon Avenue North -Proposed Alterations to Property”dated August 19,2019, regarding a proposal to alter the property at 35 Sheldon Avenue North, which is identified on the Heritage Kitchener Inventory of Historic Buildings. Mr. L. Bensason provided opening remarks, stating in 2016, a Cultural Heritage Evaluation Report (CHER) regarding 35 Sheldon Avenue North was prepared by Owen Scott of CHC Limited. It was noted, the report was prepared in anticipation of receiving a redevelopment application for the subject property; such application never materialized. Mr. Bensason advised oneROOF would like to address Heritage Kitchener and present the findings of the CHER and the anticipated phases of development. Mr. S. Strohack joined the meeting at this time. Mr. Owen Scott, CHC Limited, and Mr. John MacDonald, John MacDonald Architect Inc., were in attendance to present the CHER findings to the Committee and to speak to the proposed development of 35 Sheldon Avenue North. Mr. MacDonaldhighlighted the proposed changes during this phaseof the redevelopment, noting the exterior changes are limited to replacement of the doors of the garages with walls; interior changes are limited to removing kitchen cabinetry, some doors and trim, and front doorcase; and, landscape changes including a portion of the westerly driveway hedge, and widening of the driveway. In response to questions, Mr. Bensason advised the site plan for this application will not appear before Council for approval, and would be approved through delegated authority. He advised the property is not currently on the City’s Heritage Registrar, but would warrant inclusion. He further indicatedstaff are in support of the application based on the information provided, and willingness of the landowner to conduct heritage studiesand conservation plans as requested by the City. In response to questions,Mr. MacDonald explained no heritage evaluation has been completed on43 Sheldon Avenue and there were no registered easement on title for use of the driveway. In response to questions, Mr. Bensason advised the citydoes not know the long-term development plans for 43 Sheldon Avenue, despite having many shared attributes, such as shared driveway and water/wastewater services. He further notedthe owner of 35 Sheldon Avenue could approach the City to indicate their desire to proceed with a heritage designation, however there is no knowledge of the owner of 43 Sheldon Avenue’sintentions of volunteering HERITAGE KITCHENER MINUTES SEPTEMBER 3, 2019-27-CITY OF KITCHENER 3.HERITAGE EVALUATION & PROPOSED CHANGES -RELOCATION OF ONEROOF YOUTH SERVICES TO 35 SHELDON AVE. N. -PROPOSED ALTERATIONS TO PROPERTY(CONT’D) for a designation.He noted if there was a desire to designate either properties, a report would beprepared for Heritage Kitchener; an appeal period would apply;and,Council would be required to pass a by-law. It was suggested the process could take between 60 and 90 days for a property to be designated. Members of the Committee did not provide any specific comments on the plan at this stage, as presented. 4.ANTICIPATED HERITAGE PERMIT APPLICATION –UPDATE -8 DEVON STREET The Committee considered an internal memo entitled “8 Devon Street -Anticipated Alteration Application Discussion”dated August 19, 2019,regarding updated plans and proposal to alter the dwelling located at 8 Devon Street, which is located in the Victoria Park Area Heritage Conservation District (VPAHCD). Mr. L. Bensason provided opening remarks, statingthe applicant has developeda phased approach to developthe subject property. Mr. D. Jackson, property owner, was in attendance to share with the Committee the planned phased approach. He indicated an application for grade changes to the front of the property would be prepared in order to increase accessibility for accessing the dwellingandgarage. It was noted the first phase would not include any height increase or cladding changes, but would include landscape changes and relocation of the garage and driveway to allow for better vehicle access and storage. It was noted a formal presentation would be prepared for the Committee’s consideration at the October Heritage Kitchener meeting. In response to questions, Mr. Bensason advised if the applicant tested synthetic materials in a conspicuous space at therear of the house, a site visit by staff (and potentially a member of Heritage Kitchener)would occur, and wouldbe evaluated based on how the materialweathered during various seasons over an appropriate amount of time. Members of the Committee raised concerns with the synthetic materialspotentially being used, including the use of eco-shaped brick products. 5.STATUS UPDATES -HERITAGE BEST PRACTICES UPDATE AND 2019 PRIORITIES -HERITAGE IMPACT ASSESSMENT FOLLOW-UPS There were no status updates provided by staff. The Committee had a robust discussion surrounding staff’s delegated authority, and requested a list be circulated that identifies all the delegated authorities staff have been granted as it applies to heritage properties. The Committee also requested staff include a column on the Heritage Permit Application tracking sheet that outlines the nature of the proposed changes for each of the applications listed. 6.ADJOURNMENT On motion, this meeting adjourned at 5:50p.m. J.
