HomeMy WebLinkAboutAdjustment - 2004-06-08 FN COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JUNE 8, 2004 MEMBERS PRESENT: Mr. P. Britton, Ms. D. Angel and Mr. B. Isaac. OFFICIALS PRESENT: Mr. B. Sloan, Planner and Ms. D. Gilchrist, Secretary-Treasurer. Mr. P. Britton, Chair, called this meeting to order at 10:00 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 630 (Fence) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Tuesday, June 29, 2003, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. Martin Contra: None Public Submissions: None The Committee was advised that the applicant requests legalization of an existing 1.82 m (6 ft.) high wooden fence, and permission to replace a 0.91 m (3 ft.) high chain link fence with a 1.82 m (6 ft.) high wood and wrought iron fence, to be located 0.06 m (2.5 inches) from the lot line along Franklin Street rather than 4.5 m (14.76 ft.). The Committee noted the comments of the Development & Technical Services Department, dated, May 31, 2004, recommending approval of this application, as amended, to provide a 1.5 m setback from the front lot line, and that any fence constructed in the sideyard abutting Dalewood Drive not exceed 0.91 m in height. Mr. Martin advised that the applicants have agreed to amend their application in accordance with the staff comments. Moved by Ms. D. Angel Seconded by Mr. B. Isaac That the application of Craig and Heather Lee requesting permission to locate a 1.82 m (6 ft.) high fence, rather than the permitted 0.91 m (3 ft.) high fence, in the front yard between the house and the lot line along Franklin Street, to within 1.5 (5 ft.) of the lot line along Franklin Street, rather than 4.5 m (14.76 ft.) from Franklin Street, on Lot 2, Registered Plan 1217, 182 Dalewood Drive, Kitchener, Ontario, BE APPROVED, subject to the following conditions: COMMITTEE OF ADJUSTMENT 2 JUNE 8, 2004 Submission No.: FN 2004-001 (Cont'd) 1. That no part of the fence shall be closer than 1.5 m (5 ft.) to Franklin Street. 2. That any fence which may be constructed in the sideyard abutting Dalewood Drive shall not exceed 0.91 m (3 ft.) in height. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Municipal Code Chapter 630 (Fence) is being maintained on the subject property.
