HomeMy WebLinkAboutAdjustment - 2004-06-08 SG COMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD JUNE 8, 2004 MEMBERS PRESENT: Mr. P. Britton, Ms. D. Angel and Mr. B. Isaac. OFFICIALS PRESENT: Mr. B. Sloan, Planner, Ms. D. Gilchrist, Secretary-Treasurer. Mr. P. Britton, Chair, called this meeting to order at 10:05 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to Chapter 680 (Signs) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Tuesday, June 29, 2004, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS Submission No.: Applicant: Property Location: Leqal Description: SG 2004-007 Wend Corp. 685 Fisher-Hallman Road Part Lot 47, German Company Tract Appearances: In Support: Ms. S. Levant Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to locate a new pylon sign 0.152 m (0.49 ft.) from the curb line rather than 0.6 m (2 ft.) and 0.1 m (0.33 ft.) from the lot line along Fischer-Hallman Road rather than 0.4 m (1.31 ft.). The Committee considered the report of the Development and Technical Services Department, dated May 31,2004, recommending approval of this application. The Committee noted the comments of the Region of Waterloo Transportation Planner, dated June 1,2004, in which he advised that they have no concerns with this application. Ms. Levant advised the Committee that the proposed sign is the corporate standard and displays the corporate image. The owner has obtained site plan approval for this development. As the signs are located on the site plan, which has been approved, he was under the impression that the signs and their locations were also approved. The sign in question will be located entirely on private property. The distance between the outer edge of the sign and the sidewalk will be 1.53 m. There will be a distance of approximately 0.152 m between the edge of the sign and the curb at the drive-thru, and there is a drop in grade of approximately 4 ft. between the landscaped area where the sign will be located and area where cars will drive-thru. Angel That the application of Wend Corp. requesting permission to locate a pylon sign 0.1 m (0.33 ft.) from the lot line along Fischer-Hallman Road rather than the required 0.4 m (1.31 ft.), and to have a setback of 0.152 m (0.49 ft.) from an area intended for vehicular traffic rather than the required 0.6 m (2 ft.) for a sign with a clearance of 3.429 m (11.25 ft.) rather than the required 4.3 m (14.1 ft.), on Part Lot 47, German Company Tract, 685 Fisher-Hallman Road, Kitchener, Ontario, BE APPROVED, subject to the following conditions: That the sign and location as approved in this application shall apply to the sign generally as shown on the plans submitted with this application. That the outer edge of the pylon sign shall be no closer than 1.53 m (5.01 ft.) to the sidewalk. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. The general intent and purpose of the City of Kitchener Municipal Code Chapter 680 (Signs) is being maintained on the subject property. Von Teichman Contra: None Public Submissions: None The Committee was advised that the applicant requests permission to erect 2 vinyl banner signs, one on the Queen Street elevation and one on the King Street elevation rather than wood banner signs. The Committee noted the comments of the Region of Waterloo Transportation Planner, dated June 1,2004, in which they advised they have no concerns with this application. The Committee considered the report of the Development and Technical Services Department, dated June 1, 2004, recommending approval of this application, subject to an encroachment agreement, the signs not to exceed 1.52 m in width and 6 m in length, be two-sided, and be placed in the same location as the existing wood banner signs. The colours of the new vinyl signs shall be substantially the same colours a the existing banner signs. The method of attaching the vinyl signs to the building facades shall not be invasive to the historic masonry, and the banner signs shall be capable of being removed in the future without causing permanent damage to the historic building fabric. Isaac That the application of Wolf Von Teichman requesting permission to erect 2 vinyl banner signs, one on the Queen Street elevation and one on the King Street elevation, rather than wood banner signs, on Part Lot 1, Plan 381, 1 King Street West, Kitchener, Ontario, BE APPROVED, subject to the following conditions: 1. That the owner shall enter into an encroachment agreement with the City of Kitchener for the proposed banner signs, if required. 2. That the signs not exceed 1.52 m in width and 6 m in length, shall be two-sided, and shall be placed in the same location as the existing wood banner signs. 3.
