<br /> <br />APPENDIX <br /> <br />BY-LAW NUMBER 88-100 OF THE CORPORATION OF <br />THE CITY OF KITCHENER <br />(Being a by-law to adopt a Municipal Code) <br /> <br />The Council of The Corporation of the City of Kitchener, pursuant to Section 105 of the <br />Municipal Act, R.S.O. 1980, Chapter 302 and Section 27(g) of the Interpretation Act, <br />R.S.O. 1980, Chapter 219, enacts as follows: <br />LAST <br />1. The By-laws of The Corporation of the City of Kitchener listed in Schedule ‘A’ <br />attached hereto, hereinafter called the “Concordance,” are hereby approved and <br />consolidated into chapters of a comprehensive by-law attached hereto as <br />Schedule ‘B’, which shall hereafter be known as “The City of Kitchener Municipal <br />Code” and is hereinafter called the “Municipal Code.” <br /> <br />2. The Municipal Code is a consolidation and continuation of the provisions of the <br />original by-laws listed in the Concordance and the provisions of the Municipal Code <br />which correspond to the provisions of an original by-law shall be deemed to have <br />come into force on the date that the original by-law came into force. <br /> <br />3. Any condition precedent or subsequent or the approval of any authority external to <br />the Council required by law before an original by-law came into force shall, where <br />such condition was satisfied or approval obtained in respect of the original by-law, <br />be deemed to have been satisfied or obtained in respect of the corresponding <br />provision in the Municipal Code in all respects as though the condition had been <br />satisfied or the approval obtained in respect of that provision in the Municipal Code. <br /> <br />4. The Council may direct at any time that a by-law passed under its jurisdiction be <br />made a part of the Municipal Code, in which event it shall be added to the <br />Concordance and shall be arranged and numbered so as to fit within the scheme <br />of the Municipal Code, notwithstanding that the by-law in its original form was not <br />so arranged and numbered. <br /> <br />5. (a) An amendment to a chapter of the Municipal Code may be made directly to the <br />Municipal Code and shall be deemed to be an amendment to the corresponding <br />by-law listed in the Concordance, or <br /> (b) An amendment may be made to a by-law listed in the Concordance, in which event <br />it shall be added to the corresponding chapter of the Municipal Code and shall be <br />arranged and numbered so as to fit within the scheme thereof, notwithstanding <br />that the amendment in its original form was not so arranged and numbered. <br /> <br />6. Each Section (upper case “S”) of the Municipal Code, found in the left margin of <br />each page thereof, consists of three numerical elements to identify, in order, the <br />chapter, article and section (lower case “s”) in which a provision of the Municipal <br />Code is found, and the citation of all numerical elements of a Section shall <br />KITCHENER 1000.1 MAY 2022 <br /> <br />
