Lorentz, commencing at 2:02 p.m., with the following members present: Councillor T. Galloway, Councillor J. Haalboom, Councillor Jake Smola, Councillor John Smola, Councillor K. Taylor-Harrison, Councillor B. Vrbanovic, Councillor C. Weylie, Councillor M. Yantzi and Councillor J. Ziegler. Mayor C. Zehr entered the meeting shortly after its commencement. Others present: Messrs. J. Gazzola, R. Pritchard, R. Wyatt, D. Daly, K. Baulk, P. Beaudry and Ms. D. Gilchrist. 1. CITY SUPPORT FOR BID AND GRANT REQUEST ONTARIO MIDGET BASEBALL CHAMPIONSHIPS The Committee was in receipt of a report from Mr. K. Baulk, Manager, Kitchener Memorial Auditorium Complex and Kitchener Farmers' Market, dated November 1, 1999, recommending that the City support the bid of the Kitchener Minor Baseball Association to host the Ontario Midget Championships for a 5 year period and that the City provide a grant each year to the sponsor for Opening Ceremonies Reception and Volunteer Reception should the event be awarded. Mr. B. Bisch, of Kitchener Minor Baseball, was in attendance to thank Council for its past support and to request future support as outlined in the staff report. He noted that they had formed a partnership with Kitchener Tournament Baseball. Mr. Bisch spoke of the number of volunteers for last year's event and how successful the event had been. Councillor J. Ziegler put forward the recommendation contained in the staff report. Councillor G. Lorentz advised that last year's event had been very exciting and he thanked the Kitchener Minor Baseball for providing the volunteers and for the benefits to the community. On motion by Councillor J. Ziegler - it was resolved: "That the City of Kitchener supports the bid of Kitchener Minor Baseball Association to host the Ontario Midget Baseball Championships for a 5 year period from 2000 - 2004; and further, That the City provide a grant of $1,500.00 per year to sponsor the Opening Ceremonies Reception and Volunteer Recognition should the event be awarded to the Kitchener Minor Baseball Association." BOTULISM IN VICTORIA PARK Mr. J. Hoshoian was in attendance to address his concerns with respect to the botulism problem at Victoria Park this year. He outlined the problem as he saw it and advised of information which he had collected from various sources with respect to the seriousness of the outbreak of botulism. When questioned by Councillor T. Galloway, Mr. Hoshoian noted that when he questions City staff about his concerns he gets no answers. He noted that there are also other things in the water that are harmful to humans which can cause problems. Councillor Galloway advised Mr. Hoshoian that the City had hired an expert and that the expert has given a report which staff are working on at this time. He questioned whether the delegation thought that the City was entitled to some time to implement the recommendations contained in the expert's report. When questioned by Councillor M. Yantzi, Mr. Hoshoian responded that he was asking to be included as part of the process. When questioned, the delegation advised it was his understanding that avian botulism effects things other than ducks. When questioned by the Committee, Mr. D. Daly advised that in very rare cases some animals are effected but they would have to be consuming carcasses. He noted that the Health Unit felt that the bacteria primarily affected waterfowl and they did test the water in the park. He noted that staff have received the recommendations contained in Dr. Planck's report and they will be in place by the year 2000. Mr. Daly noted that some require study, design and a public process. BOTULISM IN VICTORIA PARK (CONT'D) COMMUNITY SERVICES COMMITTEE MINUTES NOVEMBER 87 1999 - 79 - CITY OF KITCHENER Councillor G. Lorentz questioned Mr. Daly as to where staff are with the recommendations and he responded that some of them can be implemented immediately but some take more time for consultation. He advised that he was not aware that this was a public health issue and that the Regional Health Officer has tested the water and was at the roof where the dead seagull was found. KITCHENER FARMERS' MARKET - VENDOR CLASSIFICATION AND FEES The Committee was in receipt of a report from Mr. K. Baulk, Manager, Kitchener Memorial Auditorium Complex and Kitchener Farmers' Market, dated November 1, 1999, recommending a vendor classification and fees for the Kitchener Farmers' Market. Mr. Baulk addressed the Committee advising that the report was a result of a negotiated approach and he explained the background to the report. He publicly thanked the vendors who participated in this process, which he felt had opened communication channels. Councillor B. Vrbanovic put forward the recommendations contained in the staff report. Councillor T. Galloway stated that he supports the recommendation and applauds the process noting that he has had some good feedback. Councillor J. Haalboom questioned some of the entertainers at the Market and Mr. K. Baulk responded that there are 2 levels of entertainment, the first being those hired by staff for special events and the other being buskers. Councillor K. Taylor-Harrison stated that it had been a privilege to be on this committee noting it was a very interesting process and she congratulated everyone involved. On motion by Councillor B. Vrbanovic - it was resolved: "That the City of Kitchener re-enforces its support for a revised classification and fee structure for the Kitchener Farmers' Market that would move the Market to a break-even position over time; and, That the fees established to break-even be determined based on the premise that the Market would operate at 100% vendor capacity; and, That the vendors be placed in 1 of 4 classifications according to where they are located in the Market as follows: Upper Level, Lower Level, Garage and Cooler/Equipment; and, That new vendors pay on a per foot basis at the following rates: $1.50/foot/week; Lower Level - $3.50/foot/week; Garage Cooler/Equipment - $6.50/foot/week; and, Upper Level $3.20/foot/week; That all footage be measured in travelled aisles only and not include table or stand depth; and, That vendors operating prior to July 5, 1999 be grandfathered at their current rates (unless rates for new vendor categories are lower than the rate for current vendors); and, That future fee increases for grandfathered vendors shall be as follows: a) 2% over and above the annual inflationary increases approved by the City (for City-wide fee increases) until the rates are consistent with the new vendors in their classification; and, b) the total increase shall be capped at a maximum of 5% in any one year; and, 3. KITCHENER FARMERS' MARKET - VENDOR CLASSIFICATION AND FEES (CONT'D) COMMUNITY SERVICES COMMITTEE MINUTES NOVEMBER 87 1999 - 80 - CITY OF KITCHENER That requests for additional space by grandfathered vendors will be charged out at the rate established for new non-grandfathered vendors; and, That vendors who book Garage spaces for less than 3 months be charged $6.50/foot/week; and further, That vendors who book Garage spaces for more than 3 months, but less than the full year, be charged a $100.00 reservation fee to reserve the space." AMENDMENTS TO MUNICIPAL CODE CHAPTER 210 (CEMETERIES) - WILLIAMSBURG CREMATORIUM AND OTHER MINOR REVISIONS The Committee was in receipt of a report from the Cemetery & Golf Operations Division, dated November 2, 1999, with respect to a request for amendments to Chapter 210 of the City of Kitchener Municipal Code. Councillor J. Haalboom distributed a memorandum from herself, dated November 8, 1999, requesting a further amendment to Chapter 210 of the Municipal Code with respect to photographic images. Councillor T. Galloway put forward the recommendation contained in the staff report. Councillor G. Lorentz questioned whether Mr. G. Kett was aware of Councillor Haalboom's request and Mr. R. Pritchard advised that Mr. Kett had not received the memorandum yet so had not had an opportunity to respond. It was agreed that Councillor Haalboom's request would be referred to Council on November 15, 1999. On motion by Councillor T. Galloway - it was resolved: "That Chapter 210 of the City of Kitchener Municipal Code be amended in accordance with the draft by-law attached to a report dated November 2, 1999 from the Cemetery and Golf Operations Division to provide for the operation of the Williamsburg Crematorium and to effect minor revisions throughout the by-law; and, That staff be authorized to forward copies to the Registrar of the Cemeteries Regulations Branch; and further, That the request of Councillor J. Haalboom for a further amendment to Chapter 210 of the Municipal Code, with respect to photographic images, be deferred and referred to the November 15, 1999 Council meeting to allow the Manager of Cemetery and Golf Operations to review the request." 5. CiViC SQUARE ICE RINK LOGOS FOR 1999 - 2000 ICE SEASON The Committee was in receipt of a report from Mr. G. Collins, Supervisor, Community Arenas, dated November 2, 1999, recommending Iogos for the Civic Square Rink. Mayor C. Zehr advised of an event that he had attended at the RCMP office where they noted their appreciation for the 125th anniversary logo for the RCMP which had been on the Civic Square Rink. On motion by Councillor B. Vrbanovic - it was resolved: "That, for the 1999 - 2000 ice season at Civic Square Rink, the following Iogos be installed: a three events logo depicting Festival of the Night, Festival of Trees and Christkindl Market for the month of December, and a yet to be designed special logo celebrating the millennium for January and February." DELEGATION REGARDING KITCHENER MINOR HOCKEY COMMUNITY SERVICES COMMITTEE MINUTES NOVEMBER 87 1999 -81 - CITY OF KITCHENER Councillor T. Galloway reminded the Committee of the delegation which had attended the November 1, 1999 Council meeting with respect to an issue related to Kitchener Minor Hockey and that the delegation is expecting a response to their request. He put forward a recommendation that no action be taken on the request and that this be communicated to the individuals. He stated that he felt it was appropriate to take no action on their request and hoped that the City of Kitchener would not intervene. Councillor C. Weylie suggested that the delegation should be advised that the City does not run the organizations it funds. A brief discussion then took place with respect to funding of Kitchener Minor Hockey. It was noted that the delegations had asked that organizations funded by the City exercise fairness in the way they deal with people. Mr. R. Wyatt advised that he had reviewed that matter with Kitchener Minor Hockey noting improvements they could make in that regard. On motion by Councillor T. Galloway - it was resolved: "That no action be taken on the November 1, 1999 request of Mr. R. McCormick for the City to form a third party to review whether fair decisions had been rendered by the Kitchener Minor Hockey Association in respect to his activities as well as those of Mr. E. Stevenson with the Kitchener Minor Hockey Association." ADJOURNMENT On motion the meeting adjourned at 2:45 p.m.. Dianne H. Gilchrist Committee Administrator
